SUBMITTED BY: STRICKLAND, JASON 0583 (AR11119188) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: THE DEFENDANT DID HAVE A CLEAR CELLOPHANE WRAPPER CONTAINING SEVEN OXYCODONE PILLS IN HIS LEFT SWEATER POCKET, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 020511 AT APPROXIMATELY 1712 HOURS, I RESPONDED TO 2461 EAST GULF TO LAKE HIGHWAY, WALMART SUPERCENTER, IN INVERNESS IN REFERENCE TO BEING A BACKUP DEPUTY FOR DEPUTY WILLIAMS ON A SHOPLIFTING CALL. UPON ARRIVAL, I MADE CONTACT WITH DEPUTY WILLIAMS WHO ADVISED THAT WHEN HE HAD STEPPED OUT OF THE SECURITY OFFICE TO QUESTION ONE OF THE SUBJECTS; HE THEN RETURNED BACK IN TO THE SECURITY OFFICE WHERE HE OBSERVED A SMALL CLEAR CELLOPHANE BAGGIE CONTAINING SOME PILLS INSIDE IT. AT THAT TIME, I THEN SPOKE TO MR DALE WILLIAMS WHO IS THE LOSS PREVENTION OFFICER AT WALMART. MR WILLIAMS REPLAYED THE VIDEO SURVEILLANCE OF THE SECURITY OFFICE; WHERE I CLEARLY OBSERVED THE DEFENDANT, MR CRAIG STANAG, TAKE THE CLEAR CELLOPHANE BAGGIE OUT OF HIS SWEATER POCKET AND HAD PLACED IT IN-BETWEEN TWO CHAIRS. AFTER REVIEWING THE VIDEO, DEPUTY WILLIAMS ADVISED ME THAT HE HAD ALREADY READ THE DEFENDANT HIS MIRANDA WARNING. I THEN ASKED THE DEFENDANT MR STANAG IF HE WAS WILLING TO SPEAK TO ME IN REFERENCE TO THE FOUND PILLS AND HE HAD STATED YES. MR STANAG ADVISED THAT THE PILLS WERE ACTUALLY HIS AND HE HAD TAKEN THEM OUT OF HIS POCKET AND HAD PLACED THEM BETWEEN THE CHAIRS. THE DEFENDANT ALSO ADVISED ME THAT THEY WERE PERCOCET WHICH IS A FORM OF OXYCODONE AND THAT HE DOES NOT HAVE A PRESCRIPTION FOR THE MEDICATION. HE ADVISED ME THAT HE HAD OBTAINED THESE PILLS IN MICHIGAN BEFORE HE HAD MOVED DOWN TO CITRUS COUNTY. AFTER DEPUTY WILLIAMS CONCLUDED HIS INVESTIGATION OF THE DEFENDANT, MR CRAIG STANAG, WAS ISSUED A NOTICE TO APPEAR CITATION NUMBER 17337 BY DEPUTY WILLIAMS. THE DEFENDANT, MR CRAIG STANAG, WAS THEN ADVISED BY ME THAT HE WAS BEING PLACED UNDER ARREST FOR POSSESSION OF A CONTROLLED SUBSTANCE. THE DEFENDANT WAS THEN HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND THEN ESCORTED AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL, DEFENDANT STANAG WAS TURNED OVER TO DETENTION STAFF FOR FURTHER PROCESSING. I THEN MADE CONTACT WITH POISON CONTROL AND THEY ADVISED ME THAT THE SEVEN PILLS THE DEFENDANT HAD IN HIS POSSESSION BEAR NUMBER E712 AND ON THE OTHER 10-325 WERE IN FACT OXYCODONE WHICH IS A SCHEDULE ii NARCOTIC. THE DEFENDANT'S BOND WAS SET OF $2,000.00 PER THE BOND SCHEDULE.
