Probable cause affidavit: | SUBMITTED BY: HESSE, BRYAN 0755 (AR13-4648) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: 5.5 PILLS IDENTIFIED AS MORPHINE SULFATE 100 MILLIGRAMS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 022413 AT APPROXIMATELY 2245 HOURS, I RESPONDED AS BACKUP TO CANINE DEPUTY RITLI AND DEPUTY VIGGIANO ON A TRAFFIC STOP IN the AREA OF HIGHWAY 19 AND WEST VENABLE STREET. UPON ARRIVAL, I MADE CONTACT WITH DEPUTY VIGGIANO, WHO STATED THAT HE AND DEPUTY RITLI APPROACHED THE VEHICLE TO MAKE CONTACT WITH THE DRIVER AND PASSENGER AND TO RETRIEVE the DRIVERâS LICENSE, REGISTRATION AND INSURANCE. AFTER DEPUTY RITLI MADE CONTACT HE RETURNED TO HIS PATROL CAR. DEPUTY VIGGIANO, WHO WAS STILL SANDING BY the SUSPECT VEHICLE, NOTICED MS MOSELEY STUFF A SMALL, CLEAR PLASTIC BAGGIE DOWN THE FRONT OF HER PANTS. DEPUTY VIGGIANO THEN ASKED HER TO EXIT THE VEHICLE. SHE THEN REACHED IN TO HER PANTS AND RETRIEVED THE SMALL BAGGIE WHICH CONTAINED 5.5 SMALL, ROUND, GRAY PILLS. DEPUTY VIGGIANO THEN COLLECTED THE BAGGIE OF PILLS TO IDENTIFY WHAT THEY WERE. USING A PILL IDENTIFIER, HE DISCOVERED THEY WERE 100 MILLIGRAMS MORPHINE SULFATE, WHICH THE SUSPECT DID NOT HAVE A PRESCRIPTION FOR. the SUSPECT/DEFENDANT WAS THEN HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK AND PLACED IN THE REAR SEAT OF MY PATROL CAR. SHE WAS THEN TRANSPORTED WITHOUT INCIDENT TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING. HER BOND WAS SET AT $5,000.00, PER THE BOND SCHEDULE. THE BAGGIE, WHICH CONTAINED THE PILLS, WAS COLLECTED AND LATER TURNED OVER TO EVIDENCE. |
