SUBMITTED BY: MORAN, GREGORY 1246 (AR15-16462) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: POWDER COCAINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: FOUR OXYCODONE, 15 MG, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: ONE METHADONE, 10 MG, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: TWO SOMA, 350 MG, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A BLACK RUBBER SCREW ON CONTAINER WHICH CONTAINED METHAMPHETAMINE RESIDUE, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). DID UNLAWFULLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A WHITE ONE HITTER, WHICH IS USED FOR SMOKING MARIJUANA, THAT HAD THE IMAGE OF BOB MARLEY ON IT, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). ON 091615, I WAS DISPATCHED TO THE AREA OF 10350 WEST YULEE DRIVE, IN HOMOSASSA, IN REFERENCE TO ASSISTING K-9 DEPUTY LABORDA ON A TRAFFIC STOP. UPON MY ARRIVAL, K-9 DEPUTY LABORDA ADVISED THAT HE CONDUCTED A TRAFFIC STOP ON A MAROON TOYOTA CAR FOR FAILING TO COME TO A COMPLETE STOP AT THE STOP SIGN AT WEST YULEE DRIVE AND WEST FISHBOWL DRIVE. I THEN APPROACHED THE VEHICLE ON THE PASSENGER SIDE, AT WHICH TIME I MADE CONTACT WITH THE FRONT SEAT PASSENGER, LATER IDENTIFIED AS THE DEFENDANT, MS CRYSTAL HUGGINS, AND THE DRIVER OF THE VEHICLE, MS JOANNE WARD. AS I SPOKE WITH THE SUBJECTS, K-9 DEPUTY LABORDA RAN BOTH SUBJECTS IN FCIC/NCIC. I ASKED MS WARD IF THERE WAS ANYTHING ILLEGAL INSIDE THE VEHICLE THAT WE NEEDED TO KNOW ABOUT, AT WHICH TIME SHE STATED THERE WAS NOT. I ASKED MS WARD IF SHE WOULD GIVE CONSENT FOR AN INTERIOR SEARCH OF HER VEHICLE, TO WHICH SHE ADVISED WE COULD. I THEN ASKED MS WARD AND THE DEFENDANT TO STEP OUT OF THE VEHICLE. AT THAT TIME, THEY STEPPED OUT OF THE VEHICLE AND STOOD AT THE FRONT OF K-9 DEPUTY LABORDAâS PATROL VEHICLE. AS THE DEFENDANT EXITED THE VEHICLE I OBSERVED HER TO BE HOLDING HER PINK PURSE. AN INTERIOR SEARCH OF THE VEHICLE WAS CONDUCTED, WHICH MET WITH NEGATIVE RESULTS. K-9 DEPUTY LABORDA THEN ASKED THE DEFENDANT IF HE COULD SEARCH HER PURSE AND IF THERE WAS ANYTHING ILLEGAL INSIDE OF HER PURSE. THE DEFENDANT ADVISED K-9 DEPUTY LABORDA THAT HE COULD SEARCH HER PURSE AND THERE WERE A FEW PILLS IN HER PURSE THAT BELONGED TO HER HUSBAND. K-9 DEPUTY LABORDA THEN ADVISED ME THAT HE LOCATED THREE DIFFERENT TYPES OF PILLS INSIDE A ZIPPER CASE IN THE DEFENDANTâS PURSE. THE PILLS WERE LATER IDENTIFIED AS TWO SOMAS, (350 MG), ONE METHADONE (10 MG), AND FOUR OXYCODONE (15 MG). K-9 DEPUTY LABORDA ALSO LOCATED A BLACK RUBBER CONTAINER WITH A CRYSTAL RESIDUE INSIDE OF IT, WHICH HE RECOGNIZED THROUGH HIS TRAINING AND EXPERIENCE TO BE METHAMPHETAMINE RESIDUE. HE ALSO LOCATED A SMALL ONE HITTER MARIJUANA SMOKING PIPE WITH A BOB MARLEY IMAGE ON IT. AT THAT TIME, THE DEFENDANT WAS PLACED IN HANDCUFFS (DOUBLE LOCKED) BEHIND HER BACK WHILE FURTHER INVESTIGATION WAS DONE. AFTER THE DEFENDANT WAS HANDCUFFED, K-9 DEPUTY LABORDA AND I ASKED HER IF SHE HAD ANYTHING CONCEALED ON HER PERSON, AT WHICH TIME SHE STATED THAT SHE HAD THREE SMALL CLEAR BAGGIES OF COCAINE CONCEALED IN HER UNDERWEAR. AT THAT TIME, THE HANDCUFFS WERE TAKEN OFF THE DEFENDANT AND SHE WAS ADVISED TO FACE K-9 DEPUTY LABORDAâS PATROL VEHICLE FACING AWAY FROM US, REMOVE THE THREE BAGGIES OF COCAINE, AND PLACE THEM ON THE HOOD OF K-9 DEPUTY LABORDAâS PATROL VEHICLE, TO WHICH SHE COMPLIED. THE DEFENDANT WAS THEN PLACED BACK IN HANDCUFFS (DOUBLE LOCKED) BEHIND HER BACK. THE DEFENDANT WAS ADVISED SHE WAS BEING PLACED UNDER ARREST FOR FOUR COUNTS OF POSSESSION OF A CONTROLLED SUBSTANCE AND TWO COUNTS OF POSSESSION OF DRUG PARAPHERNALIA. K-9 DEPUTY LABORDA FIELD TESTED THE COCAINE USING AN AGENCY ISSUED FIELD TEST KIT, WHICH TESTED POSITIVE FOR THE PRESENCE COCAINE. THE COCAINE WAS WEIGHED WITH A WEIGHT OF 2.8 GRAMS. THE RUBBER CONTAINER WAS FIELD TESTED USING AN AGENCY ISSUED FIELD TEST, WHICH TESTED POSITIVE FOR THE PRESENCE OF METHAMPHETAMINE. THE MARIJUANA PIPE WAS ALSO FIELD TESTED AND YIELDED A POSITIVE RESULT FOR THE PRESENCE OF MARIJUANA. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANTâS BOND WAS SET AT $8,000.00 FOR POSSESSION OF A CONTROLLED SUBSTANCE ($2,000.00 PER COUNT/FOUR COUNTS) AND $2,000.00 FOR POSSESSION OF DRUG PARAPHERNALIA ($1,000.00 PER COUNT/TWO COUNTS). THE DEFENDANTâS TOTAL BOND WAS SET AT $10,000.00, PER THE BOND SCHEDULE. |
