Probable cause affidavit: | SUBMITTED BY: LABORDA, MICHAEL 0735 (AR12-3763) (12-314760) UNLAWFULLY ENDANGER THE SAFETY OF ANOTHER OR THEIR PROPERTY WHILE INTOXICATED OR DID WHILE INTOXICATED OR DRINKING AN ALCOHOLIC BEVERAGE IN A PUBLIC PLACE CAUSE A PUBLIC DISTURBANCE, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 856.011. ON 120812 AT APPROXIMATELY 1952 HOURS, I WAS DISPATCHED TO 2341 NORTH JUNIPERUS IN BEVERLY HILLS IN REFERENCE TO A DISTURBANCE WHERE THE COMPLAINANT HAD TO DETAIN A SUBJECT CAUSING A DISTURBANCE AT HIS RESIDENCE. UPON ARRIVAL, CONTACT WAS MADE WITH THE COMPLAINANT, MR ARDEL WILTSHIRE, IN THE BACK YARD OF HIS RESIDENCE WHERE HE HAD THE DEFENDANT, MR CURT IVERSON, LAYING ON THE GROUND AND WAS HOLDING HIM DOWN UNTIL LAW ENFORCEMENT COULD ARRIVE. THE DEFENDANT WAS SECURED IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK AND PLACED IN REAR SEAT OF MY PATROL VEHICLE FOR SAFETY PURPOSES, UNTIL I COULD DETERMINE WHAT HAD OCCURRED. WITHOUT SPEAKING WITH THE DEFENDANT, I COULD IMMEDIATELY TELL THAT HE WAS HEAVILY INTOXICATED AND HAD AN STRONG ODOR OF ALCOHOL EMITTING FROM HIS BREATH AND PERSON. THE DEFENDANT WAS BARELY ABLE TO STAND ON HIS OWN AND WAS SLURRING WORDS THAT I COULD NOT UNDERSTAND. I THEN SPOKE WITH THE COMPLAINANT, WHO ADVISED ME THAT HE WAS HAVING A BIRTHDAY PARTY FOR HIS WIFE AND HAD SEVERAL FRIENDS AND FAMILY MEMBERS OVER, INCLUDING CHILDREN, WHO WERE OUTSIDE PLAYING DURING THE INCIDENT. THE COMPLAINANT ADVISED THAT HE DOES NOT KNOW THE DEFENDANT, BUT SAID THAT ON FOUR SEPARATE OCCASIONS THE DEFENDANT WALKED IN TO HIS YARD UNINVITED AND WAS ACTING âCREEPYâ, STARING AT THE CHILDREN AND âFREAKING THEM OUTâ. THE COMPLAINANT SAID THAT HE TOLD THE DEFENDANT MULTIPLE TIMES TO GET OFF OF HIS PROPERTY AND THE DEFENDANT WOULD LEAVE FOR A SHORT TIME AND WALK DOWN THE STREET, BUT THEN WOULD COME BACK IN TO HIS YARD AND STUMBLE AROUND SCARING THE CHILDREN FURTHER. THE COMPLAINANT SAID THAT THE DEFENDANT WAS TALKING AND YELLING, BUT NO ONE COULD UNDERSTAND WHAT HE WAS SAYING, DUE TO HIM BEING TOO INTOXICATED. THE COMPLAINANT ADVISED THAT HE TOLD THE DEFENDANT AGAIN TO LEAVE HIS PROPERTY AND THAT HE HAD CONTACTED LAW ENFORCEMENT. THE COMPLAINANT ADVISED THAT THE DEFENDANT STARTED TO GET AGITATED AND WOULD NOT LEAVE HIS PROPERTY. THE COMPLAINANT SAID THAT HE THEN HELD THE SUBJECT ON THE GROUND, UNTIL LAW ENFORCEMENT COULD ARRIVE FOR SAFETY PURPOSES. I THEN ATTEMPTED TO SPEAK TO THE DEFENDANT, BUT HE WAS VERY INTOXICATED AND DID NOT KNOW WHERE HE WAS. HE STATED THAT HE WAS âWASTEDâ AND UPON TELLING HIM THAT HE WAS IN BEVERLY HILLS, HE ACTED SURPRISED AND WAS UNDER THE IMPRESSION THAT HE WAS IN HERNANDO. THE DEFENDANT COULD NOT PROVIDE A REASON FOR BEING IN BEVERLY HILLS, BUT JUST STATED THAT HE WAS DRUNK AND DID NOT KNOW WHAT HE WAS DOING. THE DEFENDANT WAS THEN PLACED UNDER ARREST FOR DISORDERLY INTOXICATION, AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $150.00, PER THE BOND SCHEDULE. |
