Probable cause affidavit: SUBMITTED BY: TAYLOR, RICHARD L 2984 FHP (AR15-16880) At approximately 21:01 HOURS I was dispatched to a vehicle crash in Citrus County in the area of West Gulf to Lake Highway and North Rock Crusher Road. Upon my arrival, I observed a White Toyota Prius (BEARING New York LICENSE PLATE NUMBER FYN1153) in the westbound lane of West Gulf To Lake Highway facing East. The vehicle had damage to the right front bumper. I observed a second vehicle (White Lincoln Town car BEARING Florida LICENSE PLATE NUMBER HKX8Y) also facing east on the southeast corner of West Gulf to Lake Highway and North Rock Crusher Road and was up on the raised curbed shoulder. I made contact with the Citrus County Sheriff's Office and they stated that there were no injuries and that both drivers were still on scene. I made contact with one of the drivers, MS Sherrie Evelyn Reeves, Florida DRIVER'S LICENSE NUMBER R120785629280. She stated that she was traveling north on North Rock Crusher Road and was stopped at the red light. Her light turned green so she proceeded to travel through the intersection to go west on West Gulf to Lake Highway and then her vehicle was struck by the Toyota Prius. I then made contact with the driver of the Toyota Prius, DEFENDANT, MS Cynthia L Glass, New York Driver’s License Number 663613166. She stated to me that she had just left Crackers Bar & Grill LOCATED ON 502 NORTHWEST SIXTH StREET IN Crystal River, FLORIDA, and did NOT see the red light. During my investigation, I could immediately smell an odor of alcohol emitting from her person that intensified as she spoke. Her speech was slurred and mumbled as she spoke. She was unsteady on her feet and was swaying back and forth. I asked her if she had anything to drink tonight and she stated, "Yes, way too much." I returned to my patrol vehicle to activate my camera and deactivated my emergency lights on the front of my marked patrol vehicle but left the headlights on to illuminate the surface in front of my vehicle. It was a paved roadway clear of debris and was dry. a Citrus County Deputy AND I walked with the DEFENDANT towards the front of my vehicle. As she walked, again SHE was unsteady on her feet. I told her that I concluded my crash investigation and was now conducting a criminal investigation for DRIVING UNDER THE INFLUENCE. I asked THE DEFENDANT if she HAD performED roadside sobriety tasks several times and she responded by, "I don't know and I just want to do what will keep me safe." She also stated that she knows she screwed up by drinking too much. I read her Implied Consent and she stated that she WOULD give a breath sample. I asked her again to perform Roadside Sobriety tasks and again she would NOT give a yes or no answer so based on my investigation I placed THE DEFENDANT under arrest for DRIVING UNDER THE INFLUENCE. I placed her in handcuffs and made sure for fit and that they WERE double lockED. I then placed her in the right rear of my patrol vehicle and read her Miranda Rights, which she stated she understood. On the way to jail, I asked THE DEFENDANT again where she was coming from and she stated Crackers. I asked her how much she had to drink and she stated enough. I asked her if she ate anything and she stated no. I asked her if she was on any medication and she stated no. Adams Towing towed both vehicles to their facility and I transported her to the CITRUS COUNTY DETENTION FACILITY where THE DEFENDANT submitted a breath sample for the purposes of determining its alcohol content. Test results are .211 and .210. Charges are as follows: DUI: 316.193(1)-Driving under the influence; penalties.— (1) A person is guilty of the offense of driving under the influence and is subject to punishment as provided in subsection (2) if the person is driving or in actual physical control of a vehicle within this state and: (a) The person is under the influence of alcoholic beverages, any chemical substance or any substance controlled under chapter 893, when affected to the extent that the person’s normal faculties are impaired.
