Probable cause affidavit: |
SUBMITTED BY: SMITH, STEVE 0292 (AR10115980) OVER THE PAST SEVERAL MONTHS, THIS DEPUTY HAS RECEIVED INFORMATION FROM CONFIDENTIAL SOURCES IN REFERENCE TO THE ILLEGAL SALE AND MANUFACTURE OF METHAMPHETAMINE AT 53 SOUTH ELMHURST STREET IN LECANTO. IT SHOULD BE NOTED THAT SEVERAL MONTHS AGO AN ARREST DID OCCUR AT THE RESIDENCE IN REFERENCE TO A METH LAB, HOWEVER, THAT SUBJECT IS STILL INCARCERATED. THE INFORMATION PROVIDED TO THIS DEPUTY WAS THAT THE SUBJECT'S GIRLFRIEND /DEFENDANT, MS CYNTHIA KIMSEY, KNOWS HOW TO MANUFACTURE METHAMPHETAMINE AND HAS BEEN COOKING AT THE RESIDENCE AND DISCARDING THE GARBAGE IN A BURN PILE. ON 071910, THIS DEPUTY WAS AT THE RESIDENCE ON AN UNRELATED MATTER. UPON ARRIVAL, I MADE CONTACT WITH ONE OF THE HOMEOWNERS WHO DID GIVE THIS DEPUTY PERMISSION TO WALK THE PERIMETER OF HIS PROPERTY. DIRECTLY TO THE EAST ON THE PROPERTY IS A BURN PILE WHICH DID CONTAIN NUMEROUS ITEMS USED IN THE MANUFACTURE OF METHAMPHETAMINE. THIS DEPUTY WAS ABLE TO ASCERTAIN A SEARCH WARRANT SIGNED BY THE HONORABLE JUDGE MARK YERMAN. SAID SEARCH WARRANT WAS EXECUTED ON TODAY'S DATE AT 0833 HOURS. UPON SERVING THE SEARCH WARRANT, CONTACT WAS MADE WITH THE DEFENDANT AS WELL AS A CODEFENDANT. THE WARRANT WAS READ TO THEM. AT THIS TIME, A SEARCH OF THE RESIDENCE AND ALL OUTBUILDINGS WAS CONDUCTED. IN THE DEFENDANT'S BEDROOM, THREE GLASS PIPES USED FOR SMOKING METHAMPHETAMINE WERE LOCATED. THESE PIPES DID TEST POSITIVE FOR METHAMPHETAMINE. A GLASS TUBE WITH WHITE RESIDENCE DID TEST POSITIVE FOR COCAINE, MULTIPLE ZIPLOC BAGS, LITHIUM BATTERIES AND A MULTITUDE OF OTHER PARAPHERNALIA WAS LOCATED IN THE ROOM. ALSO LOCATED UNDER THE BED WAS A BAG CONTAINING TURKEY BASTTERS, METAL WIRE CLIPPERS USED FOR CUTTING LITHIUM BATTERIES AND PLIERS ALSO USED IN THE STRIPPING OF THE BATTERY CASINGS. ALSO LOCATED UNDER THE BED WAS A PYREX GLASS CONTAINER WHICH DID CONTAIN WHITE CHUNKY RESIDUE WHICH DID FIELD TEST POSITIVE FOR METHAMPHETAMINE. UPON SEARCHING THE SHEDS OUTSIDE, SHED NUMBER ONE SITS DIRECTLY ADJACENT TO THE RESIDENCE TO THE SOUTHWEST. LOCATED INSIDE THIS SHED WAS NUMEROUS UNKNOWN CHEMICALS AS WELL AS USED COFFEE FILTERS WHICH HAD BEEN USED IN THE MANUFACTURE OF METHAMPHETAMINE. SEVERAL CONTAINERS CONTAINING ACID, LITHIUM BATTERIES AND SEVERAL GARBAGE BAGS WHICH CONTAINED GARBAGE FROM PREVIOUS METH COOKS. UPON SEARCHING SHED NUMBER TWO, AN OLD ONE POT COOK WAS LOCATED AS WELL AS A DRAWER CONTAINING PYREX ALUMINUM FOIL. THERE WERE ALSO SEVERAL UNKNOWN CHEMICALS LOCATED INSIDE SHED NUMBER TWO AND SEVERAL OTHER CHEMICALS WHICH WERE MARKED ONE OF WHICH BEING A BOTTLE OF AMMONIA AND A BOTTLE OF SURPHERIC ACID. LOCATED OUTSIDE OF SHED TWO IN A GARBAGE CAN WAS NUMEROUS PREVIOUS ONE POT COOKS AS WELL AS EITHER CANS, USED COFFEE FILTERS, BATTERY CASINGS WHICH ALL HAD BEEN DISCARDED INTO THE GARBAGE. LOCATED IN SHED NUMBER FIVE WAS A BAG OF AMMONIA NITRATE. ALL THE CHEMICALS AND BYPRODUCTS OF THE METHAMPHETAMINE MANUFACTURING PROCESS WERE PHOTOGRAPHED AND TURNED OVER TO THE CLEAN UP CREW FOR DESTRUCTION. ALL NONTOXIC ITEMS FROM THE DEFENDANT'S ROOM WERE COLLECTED AND TURNED IN TO EVIDENCE. THIS DEPUTY DID CONDUCT A TAPED INTERVIEW WITH THE DEFENDANT. THE DEFENDANT WAS READ MIRANDA FROM A PREPRINTED CARD. WHEN ASKED IF SHE UNDERSTOOD HER RIGHTS, SHE STATED SHE DID. WHEN ASKED IF SHE STILL WANTED TO SPEAK WITH THIS DEPUTY, SHE STATED SHE DID. THE DEFENDANT DID ADMIT TO THIS DEPUTY THAT SHE HAS MANUFACTURED METHAMPHETAMINE WITHIN THE PAST MONTH, HOWEVER, SHE WOULD NOT ADMIT TO MANUFACTURING IT AT THE RESIDENCE. HOWEVER, SHE DID ADVISE THE CHEMICALS SHE USED TO MANUFACTURE METHAMPHETAMINE WERE FROM THE SAME CONTAINERS THAT WERE LOCATED AT THE RESIDENCE. SHE ALSO ADVISED THIS DEPUTY OF ALL THE ILLEGAL CONTRABAND INSIDE HER BEDROOM AND ITS LOCATION. SHE DID ADVISE IN REFERENCE TO THE PYREX GLASS CONTAINER UNDER THE BED AS WELL AS THE BAG CONTAINING THE TURKEY BASTTERS AND OTHER TOOLS USED FOR MANUFACTURING METHAMPHETAMINE THAT THESE WERE ITEMS THAT SHE DID USE IN THE MANUFACTURING OF METHAMPHETAMINE. UPON COMPLETION OF THE SEARCH, THE DEFENDANT WAS ARRESTED, HANDCUFFED (DOUBLE LOCKED), AND WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WITHOUT INCIDENT. UPON ARRIVAL, HER BOND WAS SET AT $20,500. IT SHOULD ALSO BE NOTED THAT A COMPUTER CHECK DID SHOW THE DEFENDANT HAVING AN ACTIVE CITRUS COUNTY WRIT OF BODILY ATTACHMENT. THE DEFENDANT WAS ALSO SUBSEQUENTLY ARRESTED ON SAID WRIT OF BODILY ATTACHMENT. *NOT-EXEMPT* |
