Probable cause affidavit: |
SUBMITTED BY: WEATHERFORD, D KEAGON 0710 (AR11123995) THE DEFENDANT DID CORRUPT THE PUBLIC MORALS, OR OUTRAGE THE SENSE OF PUBLIC DECENCY, OR AFFECT THE PEACE AND QUIET OF PERSONS WHO MAY WITNESS THEM, OR ENGAGED IN BRAWLING OR FIGHTING, OR ENGAGED IN SUCH CONDUCT AS TO CONSTITUTE A BREACH OF PEACE OR DISORDERLY CONDUCT, IN VIOLATION OF FLORIDA STATE STATUTE 877.03 ON 121711 AT APPROXIMATELY 0415 HOURS, I WAS TRAVELING SOUTHBOUND ON NORTH CITRUS AVENUE, PASSING THE CHEVRON GAS STATION LOCATED AT 7985 NORTH CITRUS AVENUE IN CRYSTAl river WHEN I OBSERVED TWO WHITE MALE SUBJECTS BRAWLING IN THE PARKING LOT OF THE CONVENIENCE STORE. I PULLED IN TO THE PARKING LOT AND OBSERVED THE TWO WHITE MALES, LATER IDENTIFIED AS DEFENDANT TWO, MR DAKOTA GLASCO, AND DEFENDANT ONE, MR TIMOTHY WHEELER, WHO ATTEMPTED TO WALK INTO THE GAS STATION. AS I EXITED MY PATROL, I YELLED FOR BOTH SUBJECTS TO STOP AND COME TO MY PATROL VEHICLE. AT THAT TIME, BOTH DEFENDANTS BEGAN TO WALK TOWARD ME. DEFENDANT WHEELER STATED SEVERAL TIMES TO DEFENDANT GLASCO, "YOU STOLE ME IN THE FACE TWICE, WHY DID YOU DO THAT?" DEFENDANT GLASCO STATED OVER AND OVER AGAIN "I DIDN'T HIT YOU MAN. I JUST TRIED TO CALM YOU DOWN SO WE COULD GET A RIDE." I TRIED TO CONDUCT MY INVESTIGATION BY INTERVIEWING BOTH DEFENDANTS HOWEVER, THEY BOTH CONTINUALLY ARGUED WITH EACH OTHER, AT WHICH TIME DEPUTY MATOS ARRIVED ON SCENE. I THEN DETAINED DEFENDANT GLASCO IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK, WHILE DEPUTY MATOS HANDCUFFED DEFENDANT WHEELER (DOUBLE LOCKED) BEHIND HIS BACK. DEFENDANT GLASCO WAS PLACED IN THE REAR SEAT OF DEPUTY MATOS' PATROL VEHICLE WHILE DEFENDANT WHEELER STOOD AT THE FRONT OF DEPUTY MATOS' PATROL VEHICLE. I WENT INSIDE THE STORE AND MADE CONTACT WITH THE CLERK, MR SEAN HAYES, AND ASKED HIM IF HE HAD OBSERVED THE TWO MALE SUBJECTS FIGHTING OUTSIDE. HE ADVISED HE HAD NOT BUT STATED THAT JUST PRIOR TO MY ARRIVAL, THE TWO MALE SUBJECTS WERE INSIDE THE STORE ARGUING. MR HAYES ADVISED THE MALES BEGAN SHOVING EACH OTHER AND, BELIEVING A FIGHT WAS ABOUT TO TAKE PLACE INSIDE THE STORE, MR HAYES YELLED AT THE MALES TO EXIT THE STORE. MR HAYES STATED BOTH MALES EXITED THE STORE AND ONCE OUTSIDE, BEGAN CHASING EACH OTHER AROUND THE PARKING LOT. MR HAYES ADVISED HE COULD SPEAK WITH HIS MANAGER ABOUT OBTAINING A COPY OF THE SURVEILLANCE VIDEO WHICH RECORDED THE ALTERCATION THAT occurred INSIDE THE STORE. MR HAYES WAS ADVISED THAT CONTACT WOULD BE MADE WITH HIM AT A LATER DATE TO OBTAIN THE SURVEILLANCE FOOTAGE. I RETURNED TO DEPUTY MATOS AND ADVISED BOTH DEFENDANTS THAT THEY WERE BEING PLACED UNDER ARREST FOR DISORDERLY CONDUCT/BREACH OF THE PEACE. DEFENDANT WHEELER WAS SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. DEPUTY MATOS TRANSPORTED DEFENDANT GLASCO. WHILE EN ROUTE TO THE DETENTION FACILITY, DEFENDANT WHEELER STATED SEVERAL TIMES THAT DEFENDANT GLASCO PUNCHED HIM IN THE FACE TWICE AND THAT HE HAD NOT DONE ANYTHING OTHER THAN PUSH HIM BACK A FEW TIMES AND THAT HE WOULD NOT BE GOING TO JAIL. UPON ARRIVAL AT THE DETENTION FACILITY, BOTH DEFENDANT WHEELER AND DEFENDANT GLASCO WERE BOOKED AND HELD ON INDIVIDUAL BONDS OF $250.00, IN ACCORDANCE WITH THE BOND SCHEDULE.
