SUBMITTED BY: WILSON, JAMES 0707 (AR1471) THE DEFENDANT, MR DALTON HOYT JONES, DID OPERATE A VEHICLE IN THE STATE OF FLORIDA AND, HAVING KNOWLEDGE THAT HE HAD BEEN DIRECTED TO STOP SUCH VEHICLE BY A DULY AUTHORIZED LAW ENFORCEMENT OFFICER, DID WILLFULLY REFUSE OR FAIL TO STOP SUCH VEHICLE IN COMPLIANCE WITH SUCH DIRECTIVE, IN VIOLATION OF FLORIDA STATE STATUTE 316.1935(1). THE DEFENDANT, MR DALTON HOYT JONES, DID OPERATE A MOTOR VEHICLE ON THE ROADWAYS OR HIGHWAYS OF THE STATE OF FLORIDA WITH WILLFUL AND WANTON DISREGARD FOR THE SAFETY OF PERSONS OR PROPERTY; TO WIT: EXCEEDED THE SPEED LIMIT ON SEVERAL ROADS, INCLUDING DOING 75 MILES PER HOUR (MPH) IN A 35 MPH ZONE ON PAIGE AVENUE, AND APPROXIMATELY 100 MPH ON US HIGHWAY 41 NORTH, ALSO RUNNING A RED LIGHT AT 486 AND CROFT, AND FIVE STOP SIGNS THROUGHOUT THE FOREST LAKE NORTH AREA IN VIOLATION OF FLORIDA STATE STATUE 316.192(1)(A) THE DEFENDANT, MR DALTON HOYT JONES, DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). ON 060612, THE CITRUS COUNTY SHERIFF'S OFFICE’S AIR UNIT ADVISED DISPATCH OF A POSSIBLE SUSPICIOUS VEHICLE IN THE AREA OF BEA AVENUE, I THEN LISTENED TO THE RADIO TRAFFIC, AS IT APPEARED THAT THE DRIVER OF THE VEHICLE, LATER IDENTIFIED AS THE DEFENDANT, MR DALTON HOYT JONES, WAS ATTEMPTING TO ELUDE THE DEPUTIES WHO WERE ATTEMPTING TO LOCATE HIM. I THEN PARKED MY VEHICLE IN THE CENTER MEDIAN OF HIGHWAY 486/WEST NORVELL BRYANT HIGHWAY, FACING WEST, and APPROXIMATELY 30 YARDS EAST OF CROFT AVENUE. AT THIS TIME I OBSERVED A SMALL RED VEHICLE, MATCHING THE DESCRIPTION OF THE SUSPECT’S VEHICLE, TRAVELLING NORTH OF CROFT AVENUE, AND DRIVING THROUGH THE INTERSECTION OF CROFT AND HIGHWAY 486, WITHOUT STOPPING OR SLOWING DOWN THIS VEHICLE THEN TRAVELLED WESTBOUND ON HIGHWAY 486. AS THE DEFENDANT DROVE THROUGH THE INTERSECTION, THE LIGHT FOR TRAFFIC ON 486 WAS STILL YELLOW. I COULD SEE THE RED LIGHT EMITTING FROM THE TRAFFIC CONTROL LIGHT FOR CROFT AVENUE. I WAS ABLE TO IDENTIFY THE TAG NUMBER ON THE FLEEING VEHICLE AS 3782JF. I THEN GOT BEHIND THE VEHICLE, AND INITIATED MY OVERHEAD LIGHTS, IN AN ATTEMPT TO INITIATE A TRAFFIC STOP AT THE AREA OF HIGHWAY 486 AND NORTH PAGE AVENUE THE VEHICLE MADE A RIGHT HAND TURN ONTO NORTH PAGE AVENUE, TRAVELING NORTH, AND ACCELERATED. I THEN ACTIVATED MY SIREN AS WELL. THE VEHICLE THEN REACHED A SPEED OF APPROXIMATELY 75 MPH, TRAVELING NORTH ON PAGE AVENUE. THE VEHICLE THEN MADE A LEFT ONTO EAST KEEPSAKE LANE, WITHOUT STOPPING AT THE STOP SIGN. THE VEHICLE THEN MADE A RIGHT ON NORTH CALUMET TERRACE. THE VEHICLE THEN TRAVELED TO THE END OF NORTH CALUMET TERRACE, AND MADE A LEFT ONTO EAST MARYANN LANE, AGAIN FAILING TO STOP AT THE STOP SIGN. THE VEHICLE MADE A RIGHT ONTO NORTH FOREST LAKE DRIVE, TRAVELLING THIS ROAD TO THE END, AND MAKING A LEFT ONTO EAST DEARBORN DRIVE, ALSO FAILING TO STOP FOR THE STOP SIGN AT THIS INTERSECTION THE VEHICLE THEN TURNED RIGHT ONTO NORTH WESTERN DRIVE, REACHING A SPEED OF APPROXIMATELY 50-55 MPH, AT ONE POINT ACCELERATING TO APPROXIMATELY 70 MPH, AND THEN SLOWING BACK DOWN TO 50 MPH. THE VEHICLE THEN MADE A RIGHT ONTO NORTH IRVING PARK AVENUE, ALSO FAILING TO STOP FOR THIS STOP SIGN. THE VEHICLE THEN MADE A LEFT ONTO NORTH BACK DOOR TERRACE, TRAVELING TO THE END OF THIS SHORT ROAD, AND THEN MADE A RIGHT ONTO EAST OVERDRIVE CIRCLE, WITHOUT STOPPING FOR THE STOP SIGN AT THIS INTERSECTION AS WELL. THE VEHICLE THEN MADE A LEFT AT HIGHWAY 41, AGAIN TRAVELING NORTH ON US HIGHWAY 41, AND CONTINUED TO FAIL TO STOP FOR THE STOP SIGNS AT ALL INTERSECTIONS. AT ALL SIX SIGNS, THE DEFENDANT ONLY SLOWED HIS VEHICLE DOWN ENOUGH TO BE ABLE TO MAINTAIN CONTROL OF HIS VEHICLE WHILE TRAVELING THROUGH THE INTERSECTIONS AT A HIGH RATE OF SPEED. THE VEHICLE ALSO MAINTAINED A SINGLE LANE, EXCEPT FOR THE END OF DRIVING THROUGH FOREST LAKE NORTH, WHEN HE BEGAN TO TURN ONTO OVERDRIVE CIRCLE. UPON MAKING A RIGHT ON OVERDRIVE CIRCLE, HIS VEHICLE TRAVELLED TO THE FAR LEFT SID OF THE ROAD, BEFORE HE MAINTAINED IT TO BRING BACK TO THE RIGHT SIDE. ONCE THE DEFENDANT WAS AGAIN TRAVELING ON NORTH HIGHWAY 41, THE VEHICLE WAS TRAVELING NORTH AT A SPEED OF APPROXIMATELY 70-80 MPH. AFTER WE PASSED S LECANTO HIGHWAY/STATE ROAD 491, AND STILL CONTINUING NORTH ON HIGHWAY 41, THE DEFENDANT’S VEHICLE BEGAN ACCELERATING TO 100 MILES PER HOUR (MPH). ONCE WE PASSED WEST CITRUS SPRINGS BOULEVARD, I WAS NOTIFIED THAT DEPUTY FULLER WAS IN PLACE TO DEPLOY SPIKE STRIPS IN THE ROADWAY. I OBSERVED DEPUTY FULLER’S VEHICLE TO BE PARKED ON THE SIDE OF THE ROAD. THE DEFENDANT’S VEHICLE ABRUPTLY SWERVED TO THE LEFT IN AN ATTEMPT TO AVOID THE SPIKE STRIPS; HOWEVER A SHORT TIME AFTER THE DEPLOYMENT OF THE SPIKE STRIPS, THE DEFENDANT’S VEHICLE SWERVED INTO ONCOMING A TRAFFIC LANE AS IT ATTEMPTED TO NEGOTIATE A RIGHT HAND CURVE. IT APPEARED TO THIS DEPUTY AS THOUGH THE DEFENDANT STRUGGLED TO PUT THE VEHICLE BACK IN THE PROPER LANE, AND I BEGAN SMELLING WHAT SEEMED TO BURNING RUBBER. THE VEHICLE’S FRONT LEFT TIRE WAS OBSERVED TO BE LOW. THE VEHICLE THEN TURNED WEST ON COUNTRY CLUB BOULEVARD, AND I OBSERVED THE FRONT LEFT TIRE TO BE DAMAGED. WHILE TRAVELING WEST ON COUNTY CLUB BOULEVARD, THE VEHICLE’S FRONT LEFT TIRE CAME OFF THE RIM. THE DEFENDANT THEN LOST CONTROL OF HIS VEHICLE, CAUSING IT TO DRIVE INTO ONCOMING TRAFFIC AND HIT THE DRIVER’S SIDE OF A PARKED, UNOCCUPIED TRUCK, AT 700 WEST COUNTRY CLUB BOULEVARD. THE DEFENDANT THEN COMPLIED WITH THE LAW ENFORCEMENT OFFICIAL’S ORDERS TO EXIT THE VEHICLE. A THAT TIME, THE DEFENDANT WAS PLACED UNDER ARREST, HAND CUFFED AND DOUBLE LOCKED BEHIND HIS BACK. THE DEFENDANT WAS THEN READ MIRANDA FROM A PREPRINTED AGENCY CASE CARD. HE STATED THAT HE WAS FLEEING FROM LAW ENFORCEMENT BECAUSE HE THOUGHT THE HELICOPTER WAS FOLLOWING HIM. THE DEFENDANT FURTHER ADVISED THAT HE THOUGHT HE WOULD GET IN TROUBLE WITH LAW ENFORCEMENT, BECAUSE HE HAD JUST BROKEN UP WITH HIS GIRLFRIEND, AND THAT SHE HAD CALLED TO REPORT HIM FOR STALKING HER. EMERGENCY MEDICAL SERVICES (EMS) MEDIC 2 ARRIVED ON SCENE AND ASSESSED THE DEFENDANT. DEPUTY DOWLING SEARCHED THE VEHICLE COMPARTMENT WITHIN THE WINGSPAN OF THE DRIVER, AND FOUND AN UNLABELLED PRESCRIPTION MEDICINE BOTTLE, WITH A GREEN LEAFY SUBSTANCE INSIDE. THIS SUBSTANCE WAS LATER IDENTIFIED AS CANNABIS. DEPUTY DOWLING ADVISED THAT THE MEDICINE BOTTLE HAD BEEN LOCATED IN THE CENTER CONSOLE OF THE DEFENDANT’S VEHICLE. THE DEFENDANT THEN STATED THAT HE HAD FORGOTTEN THE CANNABIS WAS IN HIS VEHICLE. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY, WHERE HE WAS RELEASED TO DETENTION FACILITY STAFF FOR BOOKING AND PROCESSING WITHOUT FURTHER INCIDENT. THE DEFENDANT’S TOTAL BOND WAS SET AT $5,750.00, PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED FLORIDA UNIFORM TRAFFIC CITATION 5651GQF5, FOR THE OFFENSE OF FLEEING AND ELUDING LAW ENFORCEMENT, WITH A MANDATORY COURT DATE OF 062112 AT 1300 HOURS. THE DEFENDANT WAS ALSO ISSUED FLORIDA UNIFORM TRAFFIC CITATION 5700GQF8, FOR RECKLESS DRIVING, WITH A MANDATORY COURT DATE OF 062112 AT 1300 HOURS. THE DEFENDANT WAS ALSO ISSUED FLORIDA UNIFORM TRAFFIC CITATION 5699GQFX, FOR FAILURE TO STOP AT A TRAFFIC SIGNAL, WITH A FINE OF $266.00, WITHIN PAY IN FULL WITHIN THIRTY DAYS. THE DEFENDANT’S VEHICLE WAS TOWED BY SCALLY’S TOWING. CONTACT WAS THEN MADE WITH MR WILLIAM PETERSON, IN REFERENCE TO HIS VEHICLE BEING THE VEHICLE WHICH HAD BEEN STRUCK IN THE ACCIDENT. HE WAS PROVIDED WITH MY AGENCY CASE CARD, BEARING MY NAME, ID AND THIS CASE NUMBER, AND WAS ADVISED TO CONTACT THIS AGENCY WITH ANY FURTHER QUESTIONS OR INFORMATION. HE WAS ADVISED TO CONTACT HIS INSURANCE COMPANY WITH THIS INFORMATION. THE GREEN LEAFY SUBSTANCE WAS TESTED WITH A FIELD TEST KIT, WHICH DID TEST POSITIVE FOR TETRAHYDROCANNABINOL (THC). THE CANNABIS WAS WEIGHED ON A TRIPLE BEAM SCALE, AND WAS FOUND TO WEIGH APPROXIMATELY 3.5 GRAMS. THE CANNABIS WAS TURNED INTO EVIDENCE, AND ALL PAPERWORK WAS COMPLETED AND TURNED INTO RECORDS. |
