Probable cause affidavit: | Submitted by Detective Ed Blair-Tactical Impact Unit On May 2nd, 2012, This Detective and Deputy Neal were conducting traffic enforcement in the Citrus Springs area of Citrus County. While conducting said enforcement at approximately 1828 hours this Detective observed a black Chevy 2 door traveling east on North Citrus Springs Boulevard. This Detective observed the driver to be drinking a large Natural Light Beer while operating the vehicle. A traffic stop was conducted in the parking lot of the Cumberland Farms store located at the intersection of North Citrus Springs Boulevard and North Deltona Boulevard. This Detective made contact with the Driver, Timothy Armstrong. The driver was asked for his driver’s license, registration, and proof of insurance. The Driver provided this Detective with his Name and Date of Birth, as he did not have his Driver’s License. While gathering the Driver’s Information from the Driver, Deputy Casey Phillips arrived on scene. Deputy Phillips walked K-9 Kino around the vehicle to detect the odor of drugs. Deputy Phillips advised this Detective K-9 Kino alerted to the odor of drugs. With this information, this Detective and Deputy Neal began a search of the vehicle. The occupants were asked to exit the vehicle, to which they complied. This Detective conducted a search of the Driver’s side of the vehicle which was met with no results. Deputy Neal conducted a search of the passenger’s side of the vehicle. Deputy Neal located a small plastic baggie containing a green leafy substance on the floor board of the rear passenger’s seat. Based on this Detective’s training and experience, the substance was that of Cannabis and had an approximate weight of 3 grams. The rear seat passenger, Defendant Daniel Cook was advised of the findings. At first, Defendant Cook denied possession. He was than hand cuffed and advised he was being placed under arrest by Deputy Neal. Deputy Neal advised Defendant Cook of his Miranda Warnings, to which Defendant Neal advised he understood and would speak with Deputy Neal. Defendant Cook admitted the cannabis was his and he had just purchased the Cannabis for $10. This Detective drafted Misdemeanor Citation 18135 for Possession of Cannabis. Defendant Cook was uncuffed and advised of his court date of May 17th at 1300 hours. After signing the Citation, Defendant Cook was provided a copy of the citation and was released on scene. The above listed cannabis was collected and later turned into the Citrus County Sheriff’s Office Evidence Locker and logged as evidence in this case. |
