Probable cause affidavit: SUBMITTED BY: HRYC, CHRISTOPHER 0701 (AR13-5698) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: 1.6 GRAMS OF METH, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 052013, I RESPONDED AS A BACK UP DEPUTY FOR DEPUTY CRIDLAND AT 430 SOUTH POINSETTIA TERRACE IN CRYSTAL RIVER, IN REFERENCE TO SUBJECTS REMOVING ITEMS FROM A VACANT LOT. WHILE EN ROUTE, DEPUTY CRIDLAND ADVISED THAT THERE WAS A SMALL PICKUP TRUCK ATTEMPTING TO LEAVE THE SCENE AND HE WAS GOING TO CHECK OUT WITH IT. UPON MY ARRIVAL, THE SUSPECT VEHICLE WAS SITTING HALFWAY IN THE DRIVEWAY OF THE RESIDENCE WHERE THE CRIME WAS SUSPECTED TO BE OCCURRING AT. IT WAS OCCUPIED BY THE DEFENDANT/PASSENGER, MR DANIEL KESTER AND THE WITNESS/DRIVER, MR JAMES DONAHUE. DEPUTY CRIDLAND STATED THAT HE WAS ATTEMPTING TO MAKE CONTACT WITH THE LANDLORD, DUE TO THE FACT THAT THE WITNESS STATED THAT HE HAD PERMISSION TO TAKE THE ITEMS. I NOTICED THAT THE TRUCK HAD A LOT OF ITEMS IN THE BED AND THEY WERE TIED DOWN. I ASKED THE WITNESS IF WHILE WE WERE WAITING IF HE WOULD MIND IF I LOOKED THROUGH HIS VEHICLE FOR ANYTHING POSSIBLY STOLEN OR NARCOTICS RELATED. BOTH THE WITNESS AND THE DEFENDANT AVOIDED EYE CONTACT WITH ME AND BOTH STATED THAT “THERE SHOULD NOT BE ANYTHING IN THE VEHICLE”. THE WITNESS STATED THAT HE DID NOT WANT ME LOOKING THROUGH THE VEHICLE. I THEN DEPLOYED MY CERTIFIED NARCOTICS DETECTION K-9 PARTNER ZEUS, FOR A 360 DEGREE SNIFF OF THE FREE AND OPEN AIR AROUND THE 1999 GREY CHEVROLET S10 BEARING FLORIDA LICENSE PLATE K154RZ, OCCUPIED BY THE DRIVER/WITNESS, MR DONAHUE AND THE PASSENGER/DEFENDANT, MR KESTER. ZEUS WAS BROUGHT TO THE DRIVER’S SIDE HEADLIGHT AND WORKED COUNTERCLOCKWISE. AT THE DRIVER’S DOOR SEAM HE SHOWED A NOTICEABLE DIFFERENCE AND ALERTED TO THE ODOR OF NARCOTICS. AN INTERIOR SEARCH OF THE VEHICLE WAS COMPLETED AND INSIDE OF THE GLOVE BOX DIRECTLY IN FRONT OF THE DEFENDANT, THERE WAS A SMALL PLASTIC BAGGIE CONTAINING A CLEAR CRYSTAL SUBSTANCE, THAT THROUGH MY TRAINING AND EXPERIENCE I RECOGNIZED IT TO BE METHAMPHETAMINE. THIS SUBSTANCE WAS FIELD TESTED IN AN AGENCY FIELD TEST KIT AND IT YIELDED A POSITIVE REACTION FOR THE PRESENCE OF METHAMPHETAMINE. ALSO INSIDE THE CENTER CONSOLE WAS A GLASS PIPE COMMONLY USED FOR SMOKING METHAMPHETAMINE AND IT DID CONTAIN A RESIDUE WHICH TESTED POSITIVE AS WELL FOR METHAMPHETAMINE. DEPUTY CRIDLAND PLACED THE DEFENDANT UNDER ARREST, HANDCUFFED, (DOUBLE LOCKED), BEHIND HIS BACK AND SECURED IN THE REAR OF DEPUTY CRIDLAND’S PATROL VEHICLE. I THEN READ THE DEFENDANT MIRANDA RIGHTS VIA PREPRINTED AGENCY CARD AND ASKED IF HE UNDERSTOOD HIS RIGHTS, TO WHICH HE REPLIED THAT HE DID. I THEN ASKED HIM IF HE WISHED TO SPEAK WITH ME AT THIS TIME, TO WHICH HE ADVISED THAT HE WOULD. I ASKED WHO THE METHAMPHETAMINE BELONGED TO AND HE STATED THAT IT WAS HIS AND HE PAID $70.00 FOR IT. HE ALSO STATED THAT IT SHOULD BE A LITTLE LESS THAN A GRAM. I ASKED WHERE HE PURCHASED IT AND HE STATED OFF OF CITRUS AVENUE IN THE GRASS ROADS. I ASKED WHO HE PURCHASED IT FROM AND HE WOULD NOT TELL ME FROM WHOM. I ASKED IF WE FINGERPRINTED THE BAGGIE CONTAINING THE METHAMPHETAMINE IF HIS FINGERPRINTS WOULD SHOW UP ON THE BAGGIE AND HE STATED THAT THEY WOULD. I THEN ASKED IF THE METHAMPHETAMINE PIPE BELONGED TO HIM AND HE STATED THAT IT DID NOT. DEPUTY CRIDLAND TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. I THEN MADE CONTACT WITH THE WITNESS. HE DENIED HAVING ANY KNOWLEDGE OF THE METHAMPHETAMINE IN HIS GLOVE BOX AND HE HAD NO IDEA WHERE THE GLASS METHAMPHETAMINE PIPE HAD COME. HE WAS RELEASED ON SCENE. I THEN RESPONDED TO THE JAIL WHERE THE DEFENDANT'S BOND WAS SET AT $2,000.00, PER THE BOND SCHEDULE THE EVIDENCE WAS WEIGHED AND IT WEIGHED APPROXIMATELY 1.6 GRAMS PACKAGED IN THE BAGGIE. BOTH THE METHAMPHETAMINE AND THE GLASS METHAMPHETAMINE PIPE WERE TURNED INTO EVIDENCE. THE GLASS METHAMPHETAMINE PIPE WAS NOTED FOR DESTRUCTION.
