SUBMITTED BY: EMRICK, AL 0104 (AR11122051) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: A RECUMBENT TRICYCLE, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: $3,200.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)(C)(1). THE DEFENDANT, MR DANIEL MCKEOWN, WAS PLACED ON PROBATION FOR INDECENT EXPOSURE AND TRESPASSING. HIS PROBATION COMMENCED ON 042010 IN HERNANDO COUNTY IN REFERENCE TO CASE 2010CF621. THE DEFENDANT DID VIOLATE THE TERMS OF HIS PROBATION IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 948.06, TO WIT: HE COMMITTED A NEW LAW VIOLATION OF GRAND THEFT. ON 072911 THE VICTIM REPORTED TO THE SHERIFF'S OFFICE THAT UNKNOWN PERSON(S) ENTERED ONE OF THEIR STORAGE SHEDS AND STOLE TWO TRICYCLES. ON 080311 CONTACT WAS MADE WITH THE DEFENDANT AND HE GAVE MYSELF AND DEPUTY CHRIS HOLLOWAY CONSENT TO SEARCH TO THE RESIDENCE AND INSIDE THE SPARE ROOM OF THE TRAILER WAS A GREENSPEED X3 RECUMBENT TRICYCLE REPORTED STOLEN BY THE VICTIM. WHEN ASKED HOW HE OBTAINED THE TRICYCLE, HE STATED that HIS BROTHER HAD PURCHASED TWO RECUMBENT TRICYCLES FOR $600.00 OFF OF CRAIG'S LIST. HE STATED THAT A MAN, POSSIBLY NAMED STEVE, HAD DELIVERED THE TRICYCLES to the RESIDENCE. WHEN ASKED HOW LONG they HAD THE TRICYCLES, HE STATED ONE AND A HALF TO TWO WEEKS. IT SHOULD BE NOTED THAT the BURGLARY AND THEFT WAS REPORTED SIX DAYS AGO. CONTACT WAS MADE WITH THE BROTHER, WHO HAD ALSO BEEN CHARGED IN this CASE, WHO STATED HE HAD STOLEN THE TRICYCLES and THEY WERE NOT PURCHASED OFF OF CRAIG'S LIST, WHICH WAS SIMPLY A COVER STORY. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS HELD UNDER NO BOND WAS SET FOR THE VIOLATION OF PROBATION AND $2,000.00 FOR THE GRAND THEFT.
