| Commentaries: | Comments According to official documents Nicholson was found guilty by stipulated trial of one count of Voyeurism with Sexual Motivation in Snohomish County Superior Court on 04/19/2002. He was sentenced to 24 months in prison. This conviction was the result of Nicholson watching a nine year old unknown male victim use the bathroom facilities at an Everett department store. The victim was in the restroom in a stall and looked up to find Nicholson looking over the stall divider at him. Nicholson apologized and ducked back down. A short time later the victim looked up again to find Nicholson looking over the divider at him again. The victim left the restroom and told his mother what had happened. Nicholson was identified through investigation and when contacted by police admitted that he had a ?sexual addiction?. He admitted to taking a pornographic magazine into the bathroom stall to masturbate. He said that he had looked over the stall divider solely for his sexual gratification. During this investigation Nicholson was also identified by a neighbor who reported that he had regularly sat in his van with the door open and masturbated. Both her and her children had observed this activity. He also admitted to following a 13 year old unknown male and leaving pornographic magazines for the victim to find. He followed the victim until he ran into a neighbor's home for safety. Nicholson has also been convicted on three separate occasions for Public Indecency and two times for indecent exposure. Nicholson has admitted to hundreds of incidents of looking at people in public restrooms for his sexual gratification. He also reported incidents of exposing himself and masturbating in public places that occurred several times a week for a period of two years. Nicholson did not participate in the Sex Offender Treatment Program during his incarceration. This was due to the length of his sentence and program?s prioritizing system. Nicholson is on active supervision with the Wahington State Department of Corrections, Everett Field Office (425) 290-3200, and has the following conditions: Do not purchase, own or have in your possession or under your control any firearm or deadly weapon Do not use, possess or consume controlled substances unless you have a legally issued prescription Maintain lawful employment and provide proof of employment to DOC staff as directed Obey all municipal, county, state, tribal and federal laws Report to and be available for contact with assigned community corrections officer as directed Shall reside at a location and under living arrangements as approved by CCO |
