SUBMITTED BY: PHILLIPS, SHANNON 0223 (2012-37427) DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY THOMAS PERUCHE OF THE CITRUS COUNTY SHERIFFâS OFFICE, WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: INVESTIGATING A PHYSICAL ALTERCATION, WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02. ON 022512 I WAS DISPATCHED TO MACRAEâS LOCATED AT 5301 SOUTH CHEROKEE WAY IN HOMOSASSA IN REFERENCE TO A LARGE PHYSICAL ALTERCATION. UPON ARRIVAL, I WAS STOPPED BY SEVERAL SUBJECTS WHO HAD POINTED OUT THE DEFENDANT, LATER IDENTIFIED AS MS DANIELLE WILLIAMSON, TO BE ONE OF THE PEOPLE WHO HAD INSTIGATED THE PHYSICAL ALTERCATION. AS I APPROACHED THE FRONT OF THE MOTEL, I OBSERVED TEN TO FIFTEEN PEOPLE STANDING IN FRONT OF THE ROOMS, SEVERAL OF WHOM INDICATED THAT THE DEFENDANT HAD BEEN INVOLVED IN THE PHYSICAL ALTERCATION. DEPUTY PERUCHE, CANINE DEPUTY VIGGIANO AND I WENT TO THE ROOM WHERE THE DEFENDANT WAS STAYING IN AN ATTEMPT TO MAKE CONTACT AND TO FIND OUT WHAT HAD HAPPENED. AFTER WAITING SEVERAL MINUTES FOR THE DEFENDANT TO USE THE RESTROOM AND PUT A SHIRT ON, THE DEFENDANT CAME INTO THE LIVING ROOM AREA AND SAT ON THE COUCH NEXT TO HER SMALL CHILD. DEPUTY PERUCHE ASKED THE DEFENDANT TO STEP OUTSIDE SO WE COULD TALK TO HER ABOUT THE INCIDENT. THE DEFENDANT BECAME VERY BELLIGERENT, REFUSING TO COME OUTSIDE, ADVISING WE COULD âFUCKING COME INSIDEâ IF WE WANTED TO TALK TO HER. DEPUTY PERUCHE EXPLAINED TO THE DEFENDANT THAT WE WANTED HER TO STEP OUTSIDE, AWAY FROM THE CHILD, SO WE COULD DISCUSS THE INCIDENT WITHOUT HIS INVOLVEMENT. AGAIN, THE DEFENDANT STATED âFUCK YOU, YOU CAN COME IN HERE.â DEPUTY PERUCHE AND CANINE DEPUTY VIGGIANO ADVISED THE DEFENDANT THAT IF SHE DID NOT COOPERATE, SHE COULD BE ARRESTED FOR OBSTRUCTION. THE DEFENDANT CONTINUED WITH PROFANITIES. DEPUTY PERUCHE THEN STOOD HER UP FROM THE COUCH, PLACED THE DEFENDANT IN HANDCUFFS (DOUBLE LOCKED) BEHIND HER BACK AND WALKED HER OUTSIDE. DEPUTY PERUCHE ADVISED THAT AS HE WALKED THE DEFENDANT OUTSIDE, HE HAD HIS RIGHT HAND ON THE HANDCUFFS AND THE DEFENDANT GRABBED TWO OF HIS FINGERS AND TRIED TO BEND THEM BACKWARD. THE DEFENDANT WAS SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. WHILE EN ROUTE TO THE DETENTION FACILITY, THE DEFENDANT CONTINUED TO BE BELLIGERENT, USING PROFANITY. UPON ARRIVAL, THE DEFENDANT WAS BOOKED ON ONE COUNT OF RESISTING ARREST WITHOUT VIOLENCE. SHE WAS HELD ON A BOND OF $500.00, IN ACCORDANCE WITH THE BOND SCHEDULE. |
