Probable cause affidavit: | SUBMITTED BY: CROSNOE, ROBERT 0234 (AR08102490) DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: THE DEFENDANT PUSHED THE VICTIM AND THEN PUNCHED HIM IN THE HEAD, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 040108 AT APPROXIMATELY 1730 HOURS, I WAS DISPATCHED TO ADVANCED AUTO PARTS IN INVERNESS IN REFERENCE TO A BATTERY ALREADY OCCURRED. UPON ARRIVAL, I MADE CONTACT WITH THE VICTIM. THE VICTIM STATED THAT HE WAS TRAVELING WEST BOUND ON HIGHWAY 44 ON HIS RED MOTORCYCLE WHEN A BLACK "SUV" CUT HIM OFF. AT THAT TIME, THE VICTIM STATED THAT HE PASSED THE DRIVER AND HAD TO STOP IN TRAFFIC IN FRONT OF ADVANCED AUTO PARTS IN INVERNESS. THE VICTIM STATED THAT THE BLACK "SUV" PULLED WITHIN TWO INCHES OF HIS REAR TIRE AND THE DRIVER, WHO WAS LATER IDENTIFIED AS THE DEFENDANT MR DANNY SUGGS, EXITED THE DRIVER'S SIDE OF THE VEHICLE, WALKED UP TO HIM, PUSHED HIM WITH BOTH HANDS IN THE CHEST AND THEN PUNCHED HIM IN THE HELMET. THE VICTIM STATED THAT WHEN THE DEFENDANT PUNCHED HIM IT CAUSED HIS NECK TO WHIP AROUND AND THE VICTIM WAS COMPLAINING OF SLIGHT NECK PAIN AND STIFFNESS. AT THAT TIME, THE VICTIM STATED HE DID WISH TO PURSUE CHARGES AGAINST THE DEFENDANT. ALSO ON SCENE WERE THREE INDEPENDENT WITNESSES WHO HAD OBSERVED THE ENTIRE ALTERCATION. ALL THREE WITNESSES DID NOT KNOW THE VICTIM PRIOR TO THIS INCIDENT AND ALL THREE WITNESSES GAVE THIS DEPUTY STATEMENTS THAT THE DEFENDANT EXITED HIS VEHICLE, WALKED UP TO THE VICTIM, AND PUSHED HIM AND THEN PUNCHED HIM IN THE HELMET. ALL THREE WITNESSES STATED THE VICTIM NEVER RAISED HIS HANDS IN DEFENSE. THE DEFENDANT GOT BACK INTO HIS VEHICLE, HAD TO BACK HIS VEHICLE UP IN TRAFFIC, AND SWERVED AROUND THE MOTORCYCLE ALMOST HITTING ONE OF THE WITNESSES' VEHICLE. AT THAT TIME, TWO OF THE WITNESSES STOPPED TO MAKE SURE THE VICTIM WAS ALRIGHT AND THE THIRD WITNESS FOLLOWED THE DEFENDANT'S VEHICLE AND WAS ABLE TO GIVE ME A FLORIDA LICENSE PLATE NUMBER OF H83RPW. THE WITNESS ALSO FOLLOWED THE DEFENDANT TO THE APPLEBEE'S PARKING LOT. AFTER I RETRIEVED EVERYONE'S INFORMATION AT THE ORIGINAL SCENE, I DID RESPOND TO THE APPLEBEE'S PARKING LOT WHERE I DID LOCATE THE DEFENDANT'S VEHICLE PARKED IN THE PARKING LOT. AT THAT TIME, I DID CONTACT ONE WITNESS ALONG WITH THE VICTIM AND HAD THEM RESPOND TO APPLEBEE'S TO POSITIVELY IDENTIFY THE DEFENDANT. BOTH THE WITNESS AND THE VICTIM DID ARRIVE AT APPLEBEE'S ABOUT THE SAME TIME THAT THE DEFENDANT WAS WALKING OUT OF APPLEBEE'S . BOTH THE WITNESS AND THE VICTIM POSITIVELY IDENTIFIED THE DEFENDANT AS BEING THE ONE WHO BATTERED THE VICTIM. AT THAT TIME, I DID MAKE CONTACT WITH THE DEFENDANT, WHO WAS IDENTIFIED BY HIS FLORIDA DRIVER'S LICENSE AS MR DANNY SUGGS. I ASKED MR SUGGS IF HE COULD GIVE ME HIS SIDE OF THE STORY IN REFERENCE TO THE ALTERCATION THAT OCCURRED IN INVERNESS. MR SUGGS STATED THAT HE HAD PASSED THE RED MOTORCYCLE WHICH THE VICTIM WAS RIDING ON HIGHWAY 44 AND A SHORT TIME LATER THE RED MOTORCYCLE PASSED HIM BACK, REVVED HIS MOTOR UP TWICE, AND SHOT HIM A "BIRD" AS HE DROVE PAST. MR SUGGS STATED THAT WHEN THEY WERE STOPPED IN TRAFFIC HE SIMPLY GOT OUT OF HIS VEHICLE TO ASK THE DRIVER OF THE MOTORCYCLE WHAT HIS PROBLEM WAS. MR SUGGS ADVISED THAT THE DRIVER OF THE MOTORCYCLE PUSHED HIM SO HE SIMPLY DEFENDED HIMSELF BY PUSHING THE VICTIM BACK AND DENIED EVER PUNCHING HIM. AT THAT TIME, DUE TO THREE INDEPENDENT WITNESSES GIVING ME THE SAME EXACT STORY, I PLACED MR SUGGS UNDER ARREST FOR BATTERY WHERE HE WAS PLACED IN THE REAR O F MY PATROL VEHICLE AND WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $500. ALL THREE WITNESSES AS WELL AS THE VICTIM DID PROVIDE THIS DEPUTY WITH WRITTEN STATEMENTS. *NOT-EXEMPT* |
