Probable cause affidavit: | SUBMITTED BY: PARSONS, TRAVIS 0358 (AR10116246) did unlawfully enter or remain in a certain conveyance, to-wit: A WHITE MERCEDES FOUR DOOR, the property of THE VICTIM, without said person's consent, with the intent to commit an offense therein, to-wit: THEFT and the said conveyance was not open to the public at the time, and THE DEFENDANT was not licensed or invited to enter or remain in said conveyance, in violation of Florida Statute 810.02(4)(B). ON 080810 I WAS DISPATCHED TO THE BELLA OASIS HOTEL IN REFERENCE TO A VEHICLE BURGLARY. BEFORE MY ARRIVAL DEPUTY TAYLOR ARRIVED ON SCENE AND ADVISED THAT THE SUSPECT HAD FLED ON FOOT IN A SOUTHERLY DIRECTION. THE WITNESS TOLD DEPUTY TAYLOR THAT HE BELIEVED THE SUSPECT WAS NOW STANDING ACROSS THE STREET NEXT TO THE WALGREENS WITH A WHITE FEMALE AND TWO DOGS. I "BOLO'D" THE AREA AND DISCOVERED THE DEFENDANT AND A WHITE FEMALE WALKING ON GROVER CLEVELAND NEAR SOUTH OHIO AVENUE. I MADE CONTACT WITH THE DEFENDANT AND ASKED HIM WHAT HE WAS DOING. HE STATED HE WAS WAITING FOR A RIDE BECAUSE HE COULD NOT GET A ROOM AT HE BELLA OASIS HOTEL. HE PROVIDED ME WITH HIS FLORIDA IDENTIFICATION CARD AND AS I WAS RUNNING IT, A VEHICLE PULLED UP AND STATED THEY WERE THERE TO PICK UP THE DEFENDANT AND THE WHITE FEMALE. DEPUTY TAYLOR ADVISED ME THAT THE DEFENDANT SHOULD BE WEARING A BACK PACK AND A BLUE IN COLOR TEE SHIRT. THE DEFENDANT WAS WEARING A BACK PACK AND WAS CARRYING A BLUE TEE SHIRT, WHICH WAS VERY DAMP. THE DEFENDANT'S PANTS WERE ALSO VERY DAMP. DEPUTY TAYLOR RESPONDED TO THE AREA WITH THE WITNESS and THE WITNESS POSITIVELY IDENTIFIED THE DEFENDANT AS THE ONE WHO HAD ENTERED HIS AUNT'S VEHICLE. I THEN MADE CONTACT WITH THE WITNESS AND HE ADVISED THAT HE WAS USING HIS CELLULAR TELEPHONE IN the PARKING LOT OF THE BELLA OASIS HOTEL, WHERE HE WAS STAYING, and NOTICED MOVEMENT BY HIS AUNT'S VEHICLE. HE STATED HE BELIEVED THE PERSON ENTERING the VEHICLE WAS HIS COUSIN AND WALKED TOWARDS IT. HE STATED THAT A SPORT UTILITY VEHICLE WAS PARKED NEXT TO HIS AUNT'S VEHICLE AND HE COULD NOT SEE CLEARLY THROUGH IT TO DETERMINE IF THE PERSON IN HIS AUNT'S VEHICLE WAS HIS COUSIN. HE ADVISED AS HE GOT CLOSER, THE INDIVIDUAL GOT OUT OF THE VEHICLE AND HE NOTICED THAT HE WAS WEARING A BACK PACK. THE CLOSER HE GOT HE REALIZED THE INDIVIDUAL WAS NOT HIS COUSIN AND SHOUTED OUT TO STOP. HE STATED THE DEFENDANT SLAMMED THE DOOR AND RAN SOUTH THROUGH THE COMPLEX. HE STATED HE BEGAN CHASING THE DEFENDANT AND LOST HIM IN the WOODS BEHIND BELLA OASIS BECAUSE IT WAS SO THICK AND WET. THE WITNESS STATED HE RETURNED TO THE ROOM AND CALLED THE FRONT DESK TO HAVE THEM NOTIFY LAW ENFORCEMENT. HE STATED HE GOT A GOOD LOOK AT THE DEFENDANT AND ADVISED DEPUTY TAYLOR THAT HE BELIEVED THE INDIVIDUAL HE CHASED WAS NOW STANDING OVER AT THE WALGREENS. THE WITNESS PROVIDED ME WITH A SWORN WRITTEN STATEMENT WHICH WAS TURNED IN TO RECORDS. I MADE CONTACT WITH THE OWNER OF THE VEHICLE, THE VICTIM, AND SHE WISHED TO PURSUE CHARGES. SHE STATED SHE DID NOT BELIEVE ANYTHING WAS MISSING FROM HER VEHICLE. I THEN RE-INTERVIEWED THE DEFENDANT AND READ HIM HIS RIGHTS FROM A PRE-PRINTED AGENCY CARD. HE ADVISED THAT HE HAD GONE TO BELLA OASIS TO GET A ROOM, BUT WAS TURNED DOWN. HE STATED HE EXITED THE LOBBY, WALKED OVER TO THE WHITE FEMALE WHO HE WAS STAYING WITH (WITNESS TWO) AND WALKED OVER TO WALGREENS. HE STATED HE CONTACTED A FRIEND TO COME PICK HIM UP AND THAT IS WHEN I HAD GOTTEN OUT WITH HIM. I MADE CONTACT WITH WITNESS TWO, WHO STATED THAT SHE HELD THE DOGS WHILE THE DEFENDANT WENT IN TO TRY AND GET A ROOM. I ASKED HER WHY SHE WAITED OUTSIDE and SHE STATED THAT SHE DID NOT BELIEVE THEY ALLOWED DOGS SO THEY WERE GOING TO TRY TO SNEAK THE DOGS INTO THE ROOM. SHE STATED THAT SHE OBSERVED THE DEFENDANT WALK OUT OF THE LOBBY AND IN HER DIRECTION. SHE STATED WHEN THE DEFENDANT MET UP WITH HER, THEY WALKED ACROSS THE STREET TO WALGREENS AND HE CALLED A FRIEND. WITNESS TWO PROVIDED ME WITH A SWORN WRITTEN STATEMENT WHICH WAS TURNED IN TO RECORDS. THE DEFENDANT WAS ARRESTED, HANDCUFFED (DOUBLE LOCKED) AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING. BOND WAS SET AT $3,000.00 PER THE BOND SCHEDULE. *NOT-EXEMPT* |
