SUBMITTED BY: POLLARD, RANDALL 0677 (AR15-14909) (15-60904) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: ONE GRAM OF METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(1)(A)(1); AND DID, KNOWING HIS DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). ON 050915, WHILE TRAVELING NORTHBOUND ON SOUTH FLORIDA AVENUE, I WAS BEHIND A RED HYUNDAI SPORT UTILITY VEHICLE (SUV), WHICH WAS TURNING ONTO HARVARD BOULEVARD. I COULD SEE THE DRIVER OF THAT VEHICLE TO BE MR DAVID ADAMS, WHO I HAD PREVIOUS KNOWLEDGE THAT HIS LICENSE HAD BEEN SUSPENDED. I THEN RAN MR ADAMS THROUGH THE DRIVER AND VEHICLE INFORMATION DATABASE (DAVID) AGAIN, TO MAKE SURE HIS DRIVER'S LICENSE STATUS HAD NOT CHANGED. UPON DOING SO, I FOUND IT TO STILL BE SUSPENDED AS OF 070714. I THEN CONDUCTED A TRAFFIC STOP ON THAT VEHICLE AT HARVARD BOULEVARD AND RUTGERS TERRACE. UPON DOING SO, I OBSERVED IN THE FRONT PASSENGER SEAT MS JILL TUTEN AND IN THE REAR PASSENGER SEAT MS AMY GERHARDT. DUE TO MY PREVIOUS ENGAGEMENT WITH ALL THREE SUBJECTS, I REQUESTED A K-9 UNIT TO RESPOND TO MY LOCATION. I THEN REQUESTED MR ADAMS TO STEP OUT OF THE VEHICLE WHERE HE WAS PLACED IN HANDCUFFS AND DETAINED DUE TO HIS KNOWLEDGE OF HIS LICENSE BEING SUSPENDED. SHORTLY AFTER, K-9 DEPUTY JUSTIN WILLIAMS (0730) ARRIVED ON SCENE AND CONDUCTED AN EXTERIOR SNIFF OF THE VEHICLE. AFTER DOING SO, K-9 DEPUTY WILLIAMS ADVISED ME HIS CANINE HAD ALERTED TO THE ODOR OF NARCOTICS IN THE VEHICLE. AT that TIME, A SEARCH OF THE VEHICLE WAS CONDUCTED. MARIJUANA "SHAKE" WAS FOUND IN THE VEHICLE. I THEN WENT TO SPEAK WITH MR ADAMS and INFORMED HIM HE WAS BEING PLACED UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED WITH KNOWLEDGE. I ADVISED HIM IF THERE WAS ANYTHING ON HIS PERSON THAT I NEEDED TO BE AWARE OF that HE SHOULD INFORM ME BEFORE REACHING THE DETENTION FACILITY. MR ADAMS THEN BEGAN SCREAMING "DAMN, DAMN, DAMN, IT'S IN MY PANTS" AS HE INDICATED TOWARDS HIS PUBIC REGION. AT THAT TIME, HE BEGAN SHAKING HIS LEG AND A CLEAR PLASTIC BAGGIE FELL OUT FROM HIS LEFT PANT LEG ONTO THE ROADWAY. I RECOGNIZED THE SUBSTANCE, THROUGH MY TRAINING AND EXPERIENCE, TO BE METHAMPHETAMINE. AT THAT TIME, I RETRIEVED THE BAGGIE AND CONDUCTED A PRESUMPTIVE FIELD TEST OF THE PRODUCT INSIDE, WHICH DID TEST POSITIVE FOR METHAMPHETAMINE. AT THAT TIME, THE METHAMPHETAMINE WAS WEIGHED. IT WAS SEPARATED INTO TWO SEPARATE BAGGIES FOR SELL. ONE WEIGHED APPROXIMATELY .52 GRAMS AND THE OTHER WEIGHED APPROXIMATELY .48 GRAMS. AT THAT TIME, I BEGAN TRANSPORT OF MR ADAMS TO THE CITRUS COUNTY DETENTION FACILITY. WHILE EN ROUTE TO THE DETENTION FACILITY, MR ADAMS WAS READ HIS MIRANDA RIGHTS VIA A PREPRINTED CARD. MR ADAMS DID ADMIT TO KNOWING HIS LICENSE WAS SUSPENDED. HE CONFESSED THE METHAMPHETAMINE WAS HIS AND STATED HE STUCK IT IN HIS PANTS AS I WAS CONDUCTING THE TRAFFIC STOP ON HIM. MR ADAMS ALSO ADMITTED TO SELLING THE METHAMPHETAMINE FOR EXTRA CASH TO PAY FOR HIS GIRLFRIEND'S CHILD SUPPORT. HE STATED HE WAS TRYING TO PAY IT FOR HER SO A WRIT OF BODILY ATTACHMENT WAS NOT ISSUED FOR HER. MR ADAMS WAS THEN RELEASED TO DETENTION STAFF. THE METHAMPHETAMINE THAT WAS SEIZED WAS PLACED INTO EVIDENCE AT THE CITRUS COUNTY SHERIFF'S OFFICE OPERATION CENTER. MR ADAMS WAS GIVEN A FLORIDA UNIFORM TRAFFIC CITATION, NUMBER 2138FYA2, WITH A MANDATORY COURT DATE OF 052815 AT 1300 HOURS. HIS BOND WAS SET AT A TOTAL OF $5,500.00 PER THE BOND SCHEDULE. THE VEHICLE THE DEFENDANT WAS DRIVING WAS BLOCKING RUTGERS TERRACE AND WAS ON THE WRONG SIDE OF the ROAD. MR ADAMS DID NOT HAVE A CELLULAR TELEPHONE TO CONTACT the OWNER OF the VEHICLE, THEREFORE IT WAS TOWED BY SCALLY'S. |
