Probable cause affidavit: SUBMITTED BY: MENDIGUTIA, RICARDO 0529 (AR09110303) UNLAWFULLY, ACTUALLY AND INTENTIONALLY TOUCH OR STRIKE THE VICTIM AGAINST HIS WILL OR INTENTIONALLY CAUSE BODILY HARM TO SAID PERSON, IN VIOLATION OF FLORIDA STATE STATUTE 784.045. ON 080209 AT APPROXIMaTELY 1840 HOURS, I RESPONDED TO CITRUS MEMORIAL HEALTH SYSTEM IN REFERENCE TO A FOLLOW UP TO DEPUTY BERRIOS' CASE REGARDING A BATTERY THAT OCCURRED At approximately 1425 hours on this date. upon arrival, i made contact with deputy berrios, via telephone, who advised he responded to the incident address, reference a battery. he made contact with the victim who advised he was having a dispute with his live-in girlfriend, at which time his girlfriend's father/defendant, mr david gasiorek, responded to their residence. deputy berrios advised the defendant was asked to go home by the witness/daughter who said she could take care of the problem she was having with the victim. deputy berrios advised the witness attempted to call her mother to tell the defendant to go home. deputy berrios advised the witness stated the defendant gently pushed the witness out of the way and approached the victim who was standing inside the residence holding a baseball bat. the defendant picked up a metal dog crate, lifted it over his head and attempted to hit the victim over the head with the metal dog crate. deputy berrios advised the victim stepped out onto the patio, and with his left arm blocking the defendant's attempt to hit him, at which time the victim struck the defendant on the left side of his head with the baseball bat. the victim threw the baseball bat on the ground and started running from his residence toward the end of the road. the victim stated the defendant continued to swing the metal dog crate, then picked up the baseball bat and briefly tried to catch the victim; however the defendant was unable to catch the victim. the victim had a small laceration on his right hand. deputy berrios also advised he spoke with the witness who corroborated the victim's statements. I proceeded into the emergency room and made contact with the medical staff who advised the defendant was about to be released. once the defendant signed the hospital release paperwork, i explained to him the reason for my presence and placed the defendant under arrest. the defendant's left arm was in a sling and his right hand was in a wrist brace with sutures on his index finger; therefore, the defendant was not secured in handcuffs. the defendant was escorted to my patrol vehicle, secured in the rear seat and transported to the citrus county detention facility for booking and processing. upon arrival, the defendant's bond was set at $5,000.00, per the bond schedule. *NOT-EXEMPT*
