Probable cause affidavit: | SUBMITTED By: LOVULLO, SARA 0723 (AR13-4656) did knowingly, actually and intentionally touch or strike DEPUTY LOVULLO, a LAW ENFORCEMENT OFFICER, against the will of that person while knowing that the said OFFICER was engaged in a lawful performance of HIS legal duties, in violation of Florida Statute 784.07(2) ON 022513, AT APPROXIMATELY 2107 HOURS, I WAS DISPATCHED TO 9124 SOUTH SPOONBILL AVENUE IN FLORAL CITY, IN REFERENCE TO AN UNKNOWN PROBLEM. WHILE EN ROUTE, I MADE CONTACT BY PHONE WITH THE COMPLAINANT, LATER IDENTIFIED AS THE DEFENDANT, MR DEAN GREGG. HE ADVISED THAT HIS FRIEND WAS HAVING A POSSIBLE HEART ATTACK AND THAT THEY NEEDED EMS (EMERGENCY MEDICAL SERVICES) RIGHT AWAY. I THEN CONTACTED DISPATCH AND ADVISED THEM TO HAVE EMS EN ROUTE. UPON MY ARRIVAL, EMS MEDIC 116 WAS ALREADY ON SCENE. I THEN MADE CONTACT WITH EMS PERSONNEL/WITNESSES, MR ROBERT YEARLING AND MR GLEN CADDEN. THEY ADVISED THAT THE DEFENDANT AND HIS FRIEND WERE EXTREMELY INTOXICATED, AND THAT THEY WOULD BE TRANSPORTING THE DEFENDANTâS FRIEND FOR TREATMENT. AT THAT TIME, THE DEFENDANT APPROACHED ME AND STATED THAT HE AND HIS FRIEND HAD BEEN DRINKING TONIGHT AND HIS FRIEND FELL DOWN A COUPLE OF TIMES AND HE HAD EMS RESPOND TO HELP HIS FRIEND. AT THAT TIME, I COULD SMELL A STRONG ODOR OF ALCOHOLIC BEVERAGE ON HIS BREATH. HE HAD SLURRED SPEECH AND HE WAS VERY UNSTEADY ON HIS FEET. I ASKED HIM IF HE WAS OK AND HE ADVISED THAT HE WAS AND THAT HE WOULD BE DRIVING HIMSELF HOME TO GO TO BED. I ADVISED HIM THAT IT WOULD BE BETTER FOR HIM TO CONTACT A FRIEND OR FAMILY MEMBER TO HAVE THEM TAKE HIM HOME, DUE TO HIM BEING INTOXICATED. THE DEFENDANT ADVISED THAT HE WOULD NOT BE CALLING ANYONE AND THAT HE WOULD DRIVE HIMSELF HOME. THE DEFENDANT THEN WALKED TO HIS VEHICLE AND OPENED HIS DOOR. I AGAIN ADVISED HIM NOT TO DRIVE AND TO CONTACT FAMILY OR FRIENDS TO COME AND TAKE HIM HOME, SO THAT HE WOULD GET HOME SAFELY. AT THAT TIME, THE DEFENDANT WAS VERY UNSTEADY ON HIS FEET AND WITNESS YEARLING ADVISED HIM TO SIT DOWN SO THAT HE WOULD NOT FALL AND GET HURT. THE DEFENDANT THEN STATED TO WITNESS YEARLING âWHAT THE HELL DID YOU JUST SAY TO MEâ AND BEGAN TO APPROACH WITNESS YEARLING IN AN AGGRESSIVE MANNER WITH HIS HANDS BALLED IN TO FISTS. I THEN WALKED IN BETWEEN THE DEFENDANT AND WITNESS YEARLING AND ADVISED THE DEFENDANT TO STOP AND TO CALM DOWN. THE DEFENDANT GOT ANGRY AND TOOK BOTH OF HIS HANDS AND PUSHED ME IN THE CHEST, CAUSING ME TO STEP BACK. HE CONTINUED TO WALK TOWARDS WITNESS YEARLING IN AN AGGRESSIVE MANNER AND I THEN GRABBED THE DEFENDANTâS LEFT ARM AND PUT HIM IN AN ARM BAR AND GOT HIS ARM BEHIND HIS BACK. THE DEFENDANT BEGAN TO PULL AWAY FROM ME SEVERAL TIMES AND CONTINUED YELLING AT WITNESS YEARLING. WITNESS YEARLING THEN GRABBED THE DEFENDANTâS RIGHT ARM AND PUT IT BEHIND HIS BACK. I THEN HANDCUFFED THE DEFENDANT (DOUBLE LOCKED), BEHIND HIS BACK, AND HE WAS SECURED IN THE REAR OF MY PATROL VEHICLE. THE DEFENDANT WAS ADVISED THAT HE WAS UNDER ARREST FOR BATTERY ON A LAW ENFORCEMENT OFFICER. HE WAS THEN READ HIS MIRANDA RIGHTS VIA PREPRINTED AGENCY CARD AND ASKED IF HE UNDERSTOOD HIS RIGHTS AND IF HE WISHED TO SPEAK TO ME AT THAT TIME, TO WHICH HE REPLIED THAT HE DID UNDERSTAND HIS RIGHTS AND THAT HE DID WISH TO SPEAK WITH ME AT THAT TIME. HE STATED THAT HE DID NOT MEAN TO HURT ANYONE THAT HE WAS JUST TRYING TO HELP HIS FRIEND AND THATâS WHY HE HAD CALLED 911. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING WHERE THE DEFENDANT'S BOND WAS SET AT $5,000.00, PER THE BOND SCHEDULE. |
