SUBMITTED BY: COX, ANDY 0543 (AR08101465) did then and there unlawfully carry a concealed weapon or electric weapon or device on or about HER person, to-wit: LARGE FILET STYLE KNIFE, in violation of Florida Statute 790.01(1); DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HIS/HER NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193; DID UNLAWFULLY AND KNOWINGLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B); DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: MARIJUANA SAID OBJECT BEING A SMALL GLASS PIPE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147. ON 012808 AT APPROXIMATELY 1240 HOURS, DEPUTY S SMITH AND DEPUTY D STRICKLAND OBSERVED A GREY TOYOTA BEARING FLORIDA TAG NUMBER F362LJ PULLED OFF THE RIGHT HAND SIDE ON AQUA DUCK LANE AND SOUTH SUNCOAST BOULEVARD. THEY OBSERVED A WHITE FEMALE SLUMPED OVER IN THE PASSENGER SEAT. THEY ATTEMPTED TO AWAKEN HER AND AFTER TRYING FOR SEVERAL SECONDS, THE FEMALE WAS IDENTIFIED BY HER FLORIDA DRIVER'S LICENSE AS MS DEBORAH FUDGE. THE DEFENDANT WAS VERY INCOHERENT, VERY SLOW TO RESPOND TO QUESTIONS AND HAD MULTIPLE BOTTLES OF PRESCRIPTION MEDICATION IN HER POSSESSION. THEY ASKED IF I WOULD RESPOND TO THE SCENE TO PERFORM FIELD SOBRIETY TASKS. I ARRIVED ON SCENE A FEW MINUTES LATER AND THE DEFENDANT PERFORMED VERY POORLY ON ALL FIELD SOBRIETY TASKS. SHE HAD CONSTRICTED PUPILS, VERY SLOW, SLURRED SPEECH AND ADMITTED TO TAKING SEVERAL DIFFERENT PRESCRIPTION MEDICATIONS TO INCLUDE; MORPHINE, OXYCODONE, TRAZODONE AND ALPRAZOLAM. I DID NOT DETECT AN ODOR OF AN ALCOHOLIC BEVERAGE ON HER BREATH. DEPUTY S SMITH ADVISED ME THAT IN HER DRIVER'S DOOR POCKET WAS A LARGE FILET STYLE KNIFE. SEARCH INCIDENT TO ARREST REVEALED UNDER 20 GRAMS OF CANNABIS AND A SMALL GLASS PIPE. THE CANNABIS, GLASS PIPE AND KNIFE WERE PACKAGED AND TURNED IN TO THE CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE DEPARTMENT. THE DEFENDANT WAS THEN PLACED UNDER ARREST FOR CARRYING A CONCEALED WEAPON, DRIVING UNDER THE INFLUENCE, POSSESSION OF MARIJUANA UNDER 20 GRAMS AND POSSESSION OF PARAPHERNALIA. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) AND PLACED IN THE REAR SEAT OF MY PATROL VEHICLE. SHE WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HER TOTAL BOND WAS SET AT $2,500.00 PER THE BOND SCHEDULE. THE DEFENDANT'S BREATH ALCOHOL CONTENT (BAC) WAS .000. SHE AGREED TO PROVIDE A URINE SAMPLE, WHICH WILL BE TURNED IN TO THE CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE. *NOT-EXEMPT* |
