Probable cause affidavit: SUBMITTED BY: MARSHALL, AIDEN 0453 (AR08103638) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: A SHOPPING CART FULL OF GROCERIES FROM PUBLIX SUPERMARKET OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN TWENTY THOUSAND DOLLARS ($20,000.00), TO WIT: APPROXIMATELY $600.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014. ON 060808 AT APPROXIMATELY 2036 HOURS I WAS DISPATCHED TO PUBLIX SUPERMARKETS LOCATED AT 6760 WEST GULF TO LAKE HIGHWAY IN REFERENCE TO A GRAND THEFT WHICH HAD JUST OCCURRED. UPON ARRIVAL I MADE CONTACT WITH THE COMPLAINANT. THE COMPLAINANT ADVISED ME THAT SHE HAD OBSERVED TWO WHITE FEMALES ENTER THROUGH THE FRONT DOOR OF THE STORE, RETRIEVE A SHOPPING CART, AND PROCEED THROUGHOUT THE SUPERMARKET, FILLING THE CART WITH GROCERIES WHICH INCLUDED SEVERAL EXPENSIVE MEAT PRODUCTS, AT WHICH TIME, WHEN THE CART WAS NEARLY OVERFLOWING WITH GROCERIES, ONE FEMALE, LATER IDENTIFIED AS DEFENDANT ONE, MS LAURA NUGENT, EXITED THE STORE, APPROACHED THE LARGE U-HAUL TRUCK SHE HAD BEEN DRIVING, LOWERED THE RAMP, AND OPENED THE REAR CARGO DOOR. AT WHICH TIME THE OTHER FEMALE, LATER IDENTIFIED AS DEFENDANT TWO, MS DEBORAH LEWIS, EXITED THE STORE, AND ENTERED THE PASSENGER SIDE OF THE U-HAUL. AT THAT TIME MS NUGENT RE-ENTERED THE STORE, GRASPED THE GROCERY-FILLED CART, AND PUSHED THE CART FULL OF GROCERIES OUT OF THE DOOR, PASSING ALL POINTS OF SALE. ONCE EXITING THE SIDEWALK, SHE TURNED RIGHT WITH THE CART AND PROCEEDED TO PUSHED THE CART OF STOLEN GROCERIES UP THE CARGO RAMP OF THE U-HAUL. AT THAT TIME, MS NUGENT ATTEMPTED TO PLACE THE ENTIRE CART WITH GROCERIES, VALUED AT APPROXIMATELY $350, INTO THE CARGO AREA OF THE TRUCK. PRIOR TO PLACING THE CART INSIDE THE TRUCK, A WHEEL ON THE CART GOT STUCK ON THE BACK BUMPER, CAUSING MS NUGENT TO DUMP THE ENTER CONTENTS OF THE CART INTO THE CARGO AREA OF THE TRUCK. AFTER THE CART OF UNBAGGED GROCERIES WAS DUMPED INTO THE TRUCK, THE COMPLAINANT MADE CONTACT WITH THE DEFENDANT, MS NUGENT. MS NUGENT ADVISED THE COMPLAINANT THAT SHE HAD STOLEN THE GROCERIES AND DID NOT HAVE MONEY TO PAY FOR THE STOLEN ITEMS. AT THAT TIME, THE COMPLAINANT ASKED MS NUGENT TO RETURN TO THE STORE, TO WHICH SHE REFUSED, CLOSED THE CARGO AREA OF THE TRUCK, AND SHE DROVE OUT OF THE PARKING LOT. THE COMPLAINANT ADVISED ME THAT SHE WROTE DOWN THE SUSPECT'S VEHICLE'S TAG NUMBER AND PROVIDED ME WITH THE ARIZONA TAG OF AD09457, WHICH WHEN RUN THROUGH FCIC/NCIC REVEALED IT WAS REGISTERED TO A 2006 U-HAUL BOX TRUCK. AT THIS TIME I WAS CONTACTED VIA MY CELLULAR TELEPHONE BY DEPUTY BOUFFARD, WHO STATED THAT HE HAD JUST ISSUED A WELL-BEING CHECK BOLO FOR THE INDIVIDUAL DRIVING THE TRUCK AND IDENTIFIED THE INDIVIDUAL AS THE DEFENDANT, MS LAURA NUGENT. DEPUTY BOUFFARD STATED THAT THE DEFENDANT'S MOTHER HAD CONTACTED HIM DUE TO THE FACT THAT SHE HAD RENTED THE TRUCK FOR MS NUGENT TO MOVE AND THE TRUCK HAD NOT BEEN RETURNED. AT THIS TIME, THE COMPLAINANT SHOWED ME THE IN-HOUSE SURVEILLANCE VIDEO OF THE THEFT TAKING PLACE, AT WHICH TIME I IDENTIFIED DEFENDANT ONE, MS NUGENT, AS THE INDIVIDUAL WHO HAD REMOVED THE GROCERIES. THE COMPLAINANT ALSO STATED THAT DEFENDANT TWO, MS DEBORAH LEWIS, HAD ASSISTED MS NUGENT THROUGHOUT BY FILLING THE CART WITH GROCERIES THROUGHOUT THE STORE, AND SHE ALSO ASSISTED MS NUGENT IN REMOVING THE GROCERIES FROM THE STORE. THE COMPLAINANT WAS ISSUED A CASE CARD BEARING MY NAME AND THIS CASE NUMBER AND THE COMPLAINANT PROVIDED ME WITH A DVD COPY OF THE SUSPECTS COMMITTING THE THEFT WHICH WAS LATER TURNED IN TO THE CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE DIVISION. ON 060808 AT APPROXIMATELY 2311 HOURS, I WAS NOTIFIED BY DEPUTY L CANFIELD THAT HE HAD LOCATED THE U-HAUL TRUCK DRIVING WEST ON US HWY 44, AT WHICH TIME HE CONFIRMED THE VEHICLE TAG WITH ME AND A SUBSEQUENT TRAFFIC STOP WAS CONDUCTED AT THE INTERSECTION OF HWY 44 AND NORTH HEART PATH. UPON ARRIVAL AT THE TRAFFIC STOP, I MADE CONTACT WITH THE DRIVER AND DEFENDANT, MS LAURA NUGENT. MS NUGENT WAS READ MIRANDA AND MS NUGENT ADVISED SHE UNDERSTOOD AND WISHED TO SPEAK TO THIS DEPUTY. MS NUGENT STATED THAT SHE HAD REMOVED THE GROCERIES FROM PUBLIX AND ATTEMPTED TO TAKE BOTH THE CART AND THE GROCERIES IN THE BACK CARGO AREA OF THE U-HAUL TRUCK. MS NUGENT STATED THAT DEFENDANT TWO, MS DEBORAH LEWIS, HAD FULL KNOWLEDGE OF THE THEFT AND PARTICIPATED IN THE THEFT. MS NUGENT WAS THEN PLACED UNDER ARREST, HANDCUFFED, DOUBLE-LOCKED, IN THE FRONT AND SEATED IN THE REAR SEAT OF MY PATROL VEHICLE, AT WHICH TIME MS NUGENT STATED SHE WOULD PROVIDE ME WITH THE LOCATION OF MS LEWIS. I THEN TRANSPORTED MS NUGENT TO THE AREA OF WEST CYRUS STREET AND NORTH REYNOLDS AVENUE. UPON ARRIVAL I WAS ABLE TO MAKE CONTACT WITH DEFENDANT TWO, MS DEBORAH LEWIS. MS LEWIS WAS READ MIRANDA VIA PREPRINTED CARD, TO WHICH SHE ADVISED SHE UNDERSTOOD AND SHE WISHED TO SPEAK TO THIS DEPUTY. MS LEWIS SUBMITTED THAT SHE HAD BEEN WITH MS NUGENT WHILE A THEFT WAS OCCURRING AT PUBLIX AND THAT SHE BOTH ASSISTED AND HAD KNOWLEDGE THE THEFT WAS OCCURRING. AT THIS TIME, MS LEWIS WAS PLACED UNDER ARREST, DEPUTY LAMBERT'S PATROL VEHICLE (WHO WAS ALREADY ON SCENE) AND TRANSPORTED TO THE CITRUS COUNTY JAIL FOR BOOKING AND PROCESSING. AT THIS TIME I ALSO TRANSPORTED MS NUGENT TO THE CITRUS COUNTY JAIL FOR BOOKING AND PROCESSING. WHILE EN ROUTE TO THE JAIL, BOTH INDIVIDUALS ADMITTED THE GROCERIES WERE PLACED AT THE RESIDENCE LOCATED NEAR THE CORNER OF NORTH REYNOLDS AVENUE AND WEST CYRUS STREET, WHERE THE GROCERIES WERE USED AS PAYMENT OWED TO THE HOMEOWNER FOR CRACK COCAINE. UPON ARRIVAL AT THE CITRUS COUNTY JAIL, IT WAS REVEALED THAT MS LEWIS ALSO HAD A WARRANT OUT OF POLK COUNTY IN REFERENCE TO VIOLATION OF PROBATION, WHICH WAS SUBSEQUENTLY CONFIRMED BY THE CITRUS COUNTY WARRANTS DIVISION. IN REFERENCE TO THE GRAND THEFT, MS LEWIS'S BOND WAS SET AT $2,000 PER THE BOND SCHEDULE. *NOT-EXEMPT*
