SUBMITTED BY: FERGUSON, KYLE 1266 (AR14-10779) (14-81086) DID, KNOWING her DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2). ON 061314, I RESPONDED 8050 WEST BAJA COURT IN REFERENCE TO A HIT AND RUN TRAFFIC ACCIDENT. UPON ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT/WITNESS, MS DONNA EMMETT, WHO STATED THE DEFENDANT, MS DEBORAH SELLERS, HAD LEFT HER RESIDENCE LOCATED AT 8015 WEST BAJA COURT, MOBILE HOME 6, IN A 1996 SILVER MERCURY FOUR-DOOR, BEARING FLORIDA TAG F111LM. SHE ADVISED AS THE DEFENDANT WAS LEAVING SHE DROVE OVER the COMPLAINANTâS LAWN HITTING A WATER PIPE WITH A SPRINKLER HEAD ON IT, WHICH WAS APPROXIMATELY TWO TO THREE FOOT OFF the GROUND. THIS CAUSED THE ENTIRE MOBILE HOME PARK TO BE OUT OF WATER because THE PIPE BROKE. THE WITNESS STATED that THE DEFENDANT ASKED HER IF SHE COULD ACTIVATE HER TELEPHONE, TO WHICH THE WITNESS STATED NO AND TOLD the DEFENDANT SHE HAD BROKEN the WATER PIPE. AT THAT TIME, the DEFENDANT LEFT THE SCENE AT A HIGH RATE OF SPEED and PROCEEDED OUT OF the NEIGHBORHOOD TURNING RIGHT ON NORTH ELM DRIVE. DEPUTY CASALVIERI AND I THEN LEFT THE SCENE TO BOLO FOR the VEHICLE, SEE HIS SUPPLEMENT REPORT. WHILE SOUTH OF BAJA COURT TURNING ONTO NORTH ELM DRIVE, I OBSERVED A SILVER MERCURY FOUR-DOOR CAR HEADING SOUTH ON NORTH ELM DRIVE, AT WHICH TIME the SILVER MERCURY IMMEDIATELY TURNED ONTO WEST TANGO POINT. AT that TIME, I CAUGHT UP TO THE VEHICLE AND FOUND THAT IT WAS THE VEHICLE WE WERE LOOKING FOR AND CONDUCTED A TRAFFIC STOP ON THE VEHICLE, INITIATING MY OVERHEAD EMERGENCY LIGHTS. I THEN ASKED THE DEFENDANT, WHO WAS DRIVING THE VEHICLE, FOR HER DRIVER'S LICENSE AND REGISTRATION AND WHERE SHE WAS COMING FROM. SHE STATED SHE WAS COMING FROM her FRIENDâS HOUSE because WHEN she HIT THE WATER PIPE IN HER NEIGHBORHOOD, IT FLATTENED HER TIRE AND HER FRIEND HAD PUT A FIX-A-FLAT IN IT. I ASKED THE DEFENDANT WHY SHE HIT THE WATER PIPE, TO WHICH SHE STATED SHE DID NOT SEE IT. THE DEFENDANT THEN ADVISED SHE could NOT GIVE ME HER DRIVER'S LICENSE because IT HAD BEEN REVOKED. the DEFENDANT ALSO SAID SHE FELT SEVERELY DEHYDRATED and HAD NOT TAKEN HER INSULIN TODAY. MEDIC 113 RESPONDED TO the SCENE, AT WHICH TIME THE DEFENDANT REFUSED TRANSPORTATION TO THE HOSPITAL. DEPUTY CASALVIERI THEN RESPONDED TO THE DEFENDANTâS RESIDENCE AT HER REQUEST TO PICK UP HER INSULIN. DEPUTY CASALVIERI LOCATED THE INSULIN AND GAVE IT TO THE DEFENDANT TO USE. A NEIGHBOR ADVISED HE COULD TAKE THE DEFENDANTâS VEHICLE BACK TO HER RESIDENCE, TO WHICH THE DEFENDANT AGREED AND DEPUTY CASALVIERI FOLLOWED THE VEHICLE TO THE RESIDENCE. THE DEFENDANT WAS THEN PLACED UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED/REVOKED AND WAS HANDCUFFED (DOUBLE LOCKED) IN FRONT AND SECURED IN THE REAR OF MY PATROL VEHICLE. SHE WAS THEN TRANSPORTED TO the CITRUS COUNTY DETENTION FACILITY WHERE SHE WAS THEN HANDED OVER TO DETENTION STAFF. the DEFENDANTâS BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED A CRIMINAL CITATION, NUMBER 5094-GZP, FOR DRIVING WHILE LICENSE SUSPENDED/REVOKED AND CRIMINAL CITATION, NUMBER 5095-GZP, FOR LEAVING the SCENE OF AN ACCIDENT WITH PROPERTY DAMAGE ESTIMATED AT $100.00. |
