SUBMITTED BY: RODRIGUEZ, MARCIAL 0301 (AR12-3607) TITUS, JOSHUA 1243 DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WAL-MART, TO WIT: ONE CHILDS RIDE ON ATV 12 VOLT TOY, BY CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF $232.00, WHICH IS LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015, 812.014(1), AND 812.014(3)(A). ON 112612, AT 1553 HOURS, I WAS DISPATCHED TO 2461 E GULF TO LAKE HIGHWAY TO THE WAL-MART SUPER CENTER, IN REFERENCE TO A RETAIL PETIT THEFT THAT HAD ALREADY OCCURRED. UPON ARRIVAL I MADE CONTACT WITH THE LOSS PREVENTION OFFICER/COMPLAINANT, MR JOSEPH COMPOSTELLA, WHO SUPPLIED ME WITH A SWORN WRITTEN STATEMENT STATING THAT HE HAD OBSERVED A FEMALE, LATER IDENTIFIED AS MS DEBRA JOCK, THE DEFENDANT, DISPLAYING SUSPICIOUS BEHAVIOR IN THE TOY DEPARTMENT OF WAL-MART. MR COMPOSTELLA CONTINUED FLOOR SURVEILLANCE AND OBSERVED DEBRA JOCK SELECT A DISNEY FOUR WHEELER WHILE ACCOMPANIED BY AN UNKNOWN MALE, AND PLACE IT IN AN EMPTY SHOPPING CART. THE SUSPECT THEN PROCEEDED THROUGH THE GARDEN CENTER AND EXITED THE STORE, PASSING ALL POINTS OF SALE WITHOUT ANY ATTEMPT TO PAY FOR THE MERCHANDISE SHE HAD PLACED IN HER SHOPPING CART. MR COMPOSTELLA THEN STOPPED THE SUSPECT AND INFORMED HER WHO HE WAS AND WHY HE WAS STOPPING HER. MR COMPOSTELLA THEN ESCORTED THE SUSPECT BACK TO THE LOSS PREVENTION OFFICE AND CONTACTED THE CITRUS COUNTY SHERIFFâS OFFICE. MR COMPOSTELLA THEN SHOWED ME THE VIDEO SURVEILLANCE AND I OBSERVED THE SUSPECT TAKING THE ITEM MENTIONED AND EXITING THE STORE WITH AN UNKNOWN WHITE MALE, WITHOUT PAYING. THE SUSPECT WAS THEN READ HER MIRANDA RIGHTS, WHERE SHE STATED THAT SHE UNDERSTOOD HER RIGHTS, BUT REFUSED TO SPEAK WITH ME REGARDING THE INCIDENT. THE SUSPECT WAS THEN ARRESTED, CHARGED WITH ONE COUNT OF RETAIL PETIT THEFT, HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK AND PLACED IN THE BACK OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. THE COMPLAINANT WAS ISSUED AN AGENCY CASE CARD BEARING MY NAME AND THIS CASE NUMBER. THE ITEM WHICH HAD BEEN STOLEN, WAS TURNED BACK OVER TO WAL-MART. THE DEFENDANTâS BOND WAS SET AT $250.00, PER THE BOND SCHEDULE. |
