Probable cause affidavit: SUBMITTED BY: RAMOS, ROBALDO 0515 (AR10116155) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF SMART INTERIORS IN LECANTO, FLORIDA, TO WIT: THE DEFENDANT PLACED IN HER PURSE A GREEN DÉCOR BALL AND MADE NO ATTEMPTS TO PAY FOR SAID BALL BEFORE CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.014(3)(A). ON 080210, I WAS DISPATCHED TO THE SMART INTERIOR STORE IN LECANTO, IN REFERENCE TO A SHOPLIFTER BEING DETAINED. UPON ARRIVAL, I MADE CONTACT WITH TWO SMART INTERIOR EMPLOYEES OUTSIDE THE STORE, AT WHICH TIME THEY ADVISED THAT THE DEFENDANT HAD JUST LEFT THE STORE HEADED WESTBOUND IN HER WHITE VOLKSWAGEN CONVERTIBLE VEHICLE BEARING FLORIDA TAG, 299KVN. AT THAT TIME I BOLO'D HIGHWAY 44 GOING WESTBOUND WHICH MET WITH NEGATIVE RESULTS IN MAKING CONTACT WITH THE ABOVE LISTED VEHICLE. AT THAT TIME I RAN THE WHITE TWO DOOR VOLKSWAGEN BEARING TAG 299KVN THROUGH FCIC/NCIC TO OBTAIN AN ADDRESS, AND UPON LOCATION OF THAT ADDRESS I RESPONDED TO THE DEFENDANT'S RESIDENCE IN PINE RIDGE WHERE I MADE CONTACT WITH HER HUSBAND. UPON MY ARRIVAL, I OBSERVED THE GARAGE DOOR WAS OPEN AND THE DEFENDANT'S VEHICLE WAS NOT THERE. IN SPEAKING WITH THE DEFENDANT'S HUSBAND, HE ADVISED THAT THE DEFENDANT WAS NOT HOME AND WAS OUT AND ABOUT AT AN UNKNOWN LOCATION SHOPPING. HE DID PROVIDE ME WITH THE DEFENDANT'S CELLULAR TELEPHONE NUMBER WHICH MET WITH NEGATIVE RESULTS WHEN I ATTEMPTED TO MAKE CONTACT WITH THE DEFENDANT. I PROVIDED THE DEFENDANT'S HUSBAND WITH AN AGENCY CASE CARD BEARING MY NAME AND CONTACT INFORMATION, AND ADVISED HIM TO HAVE THE DEFENDANT CONTACT ME UPON HER ARRIVAL HOME. I THEN RESPONDED BACK TO THE SMART INTERIOR STORE IN LECANTO WHERE I OBTAINED A STATEMENT FROM THE EMPLOYEE/ WITNESS WHO ADVISED THAT SHE HAD OBSERVED THE DEFENDANT GRAB A GREEN DÉCOR BALL FROM A DISPLAY THEN PLACE THE DÉCOR BALL IN HER BLACK XOXO HANDBAG. THE WITNESS ADVISED THEY ATTEMPTED TO LOCK THE FRONT DOOR UNTIL MY ARRIVAL, HOWEVER, AFTER SEVERAL MINUTES INSIDE THE STORE, THE DEFENDANT BECAME SUSPICIOUS AND NOTICED THE FRONT DOOR WAS LOCKED AT WHICH TIME THE EMPLOYEE OPENED THE FRONT DOOR TO ALLOW THE DEFENDANT TO LEAVE. THE WITNESS ADVISED THAT SHE OBSERVED THE DEFENDANT GET INTO HER VEHICLE AND AS SHE LEFT, THE WITNESS WAS ABLE TO OBTAIN THE DEFENDANT'S TAG NUMBER. THE WITNESS ALSO ADVISED THAT WHILE AT THE STORE, THE DEFENDANT ADVISED THAT SHE WANTED TO SET UP A HOUSE CALL REFERENCE TO REMODELING AT HER RESIDENCE AND AT THAT TIME PROVIDED THE WITNESS WITH HER NAME, TELEPHONE NUMBER AND EMAIL ADDRESS. AT A LATER TIME I WAS CONTACTED BY THE DEFENDANT'S HUSBAND VIA DISPATCH TO ADVISE THAT HIS WIFE, THE DEFENDANT, WAS BACK AT THE RESIDENCE. UPON MY ARRIVAL AT THE RESIDENCE I OBSERVED THE GARAGE DOOR TO BE OPEN AND THE WHITE CONVERTIBLE BEARING THE ABOVE LISTED TAG NUMBER MATCHING THE TAG NUMBER PROVIDED BY THE INTERIOR STORE WITNESS WAS THERE. I THEN MADE CONTACT WITH THE DEFENDANT AND HUSBAND AND ADVISED THE DEFENDANT OF HER MIRANDA WARNING WHICH SHE THEN WAIVED AND AGREED TO SPEAK WITH THIS DEPUTY. I ASKED THE DEFENDANT IF SHE WAS IN THE SMART INTERIOR STORE IN LECANTO, TO WHICH SHE ADVISED, YES. I ASKED HER IF SHE PURCHASED ANYTHING INSIDE THE STORE TO WHICH SHE STATED, NO. I ASKED HER IF SHE HAD HER BLACK XOXO HANDBAG WITH HER WHILE IN THE STORE TO WHICH SHE ADVISED, YES. I ASKED HER IF SHE HAD TAKEN ANY ITEMS FROM THE STORE, TO WHICH SHE STATED, NO. AT THAT TIME I ASKED THE DEFENDANT IF SHE WAS SURE THAT SHE HAD NOT TAKEN ANYTHING FROM THE STORE TO WHICH SHE AGAIN ADVISED SHE HAD NOT TAKEN ANY ITEMS FROM THE STORE. AT THAT TIME I ADVISED THE DEFENDANT THAT SHE WAS BEING PLACED UNDER ARREST FOR RETAIL THEFT WHERE SHE WAS THEN HANDCUFFED (DOUBLE LOCKED) IN THE FRONT OF HER PERSON AND PLACED IN THE REAR OF MY PATROL VEHICLE. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING WHERE HER BOND WAS SET AT $250.00 PER THE BOND SCHEDULE. *NOT-EXEMPT*
