Probable cause affidavit: SUBMITTED BY: BERGEN, JOHN 0519 (AR13-8377) IT IS UNLAWFUL FOR ANY PERSON TO ACQUIRE OR OBTAIN OR ATTEMPT TO ACQUIRE OR OBTAIN POSSESSION OF A CONTROLLED SUBSTANCE BY MISREPRESENTATION, FRAUD, FORGERY, DECEPTION OR SUBTERFUGE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(7)(A)9, TWO COUNTS. On 12/10/13 I was following up on two separate prescription fraud cases in which the suspect called in prescriptions under Dr. Raynors name and his old DEA number. The first case was 2013-160183 which occurred at the Publix Pharmacy on HWY 44 in Citrus County. During that incident a female called into the pharmacy using the name of Elizabeth who is a current employee of Dr. Raynor. The caller requested the pharmacy fill a prescription for an antibiotic and Hydrocodone which is a schedule III controlled substance. The pharmacy thought the prescription seemed suspicious and contacted Dr. Raynors office. They spoke with Elizabeth who advised she had not called in any prescriptions for hydrocodone and the DEA number the caller provided was Dr. Raynors old DEA number which had been changed after it was compromised by a former employee Debra Singh. The second case was 2013-166491 which occurred at the Winn Dixie Pharmacy located on Highland Blvd in Citrus County Florida. During this incident a female called in to the pharmacy using the name of Anne from Dr. Raynors office and requested the pharmacy fill prescriptions for a male named Russell Yeazel. The prescriptions were an antibiotic and Tylenol 4 with Codeine which is a schedule III controlled substance. The pharmacy called Dr. Raynor to confirm and he advised that he did not call that in and does not have a patient by that name. The pharmacy then notified Law Enforcement however the suspect Russell Yeazel showed up before responding units. He provided his driver’s license information and was waiting for the prescription when he must have gotten nervous and he left before contact could be made with him. On 12/10/13 Detective Marshall and I responded to the home of Debra Singh. Debra was a former employee of Dr. Raynor whom I was familiar with from a prior arrest. During that case she called in Tylenol 4 with codeine under Dr. Raynors old DEA number and I secured an arrest warrant for her in that case. Detective Marshall and I met Debra in her driveway. I asked if she would speak to me about a current case I was investigating. She agreed to talk to me and I asked her to be honest with me and tell me if she had been calling in fraudulent prescriptions. At first she told me no, however after being confronted with her prescription profiles showing 11 prescriptions from Dr. Raynors office within the last year for Tylenol 4 with codeine she decided to tell me the truth. She indicated that she is addicted to codeine pain killers and that she did call in the 11 fraudulent prescriptions on her prescription profile but said she gave the DEA number to Russell Yeazel and she didn’t know who called that in. She told me that she has been on pain killers for a long time and that although she has gotten arrested in the past she has never received any help for her addiction. She could not stop on her own and had to resort to calling in the bad prescriptions. She knew that Dr. Raynor did not authorize her to call any of them in and she did so illegally. I told her I would have to follow up on the case by talking to Russell and I would see if I could help her get some treatment for her addiction. This interview was audio recorded and a copy was turned into evidence. On 12/13/13 Detective Marshall and I responded to the workplace of Russell Yeazel who agreed to speak with me. He also lied at the beginning of the interview and told me his doctor called that prescription in. After a few minutes Russell decided to tell the truth and said that he was a friend of the suspect Debra Singh and that he knew that the prescription was false. He said that Debra asked him if he minded if she called it in under his name and that he agreed. He knew it was the wrong thing to do and he was very sorry. This interview was also audio recorded. On 12/17/13 I made contact with Debra by telephone and told her that I had finished my investigation and I needed her to meet me at the jail to turn herself in on two counts of obtaining a controlled substance by fraud. I asked her on the phone why she lied to me about giving the DEA number to Russell and she said she was sorry and that she just didn’t want to get in any more trouble. Upon her arrival she was charged with two counts of obtaining a controlled substance by fraud and due to her cooperation and willingness to get help for her drug problem she was ror’d on all counts.
