Probable cause affidavit: SUBMITTED BY: POLLARD, RANDALL 0677 (AR09110324) did unlawfully enter or remain in a certain conveyance, to wit: COMFORT MATTRESS BUSINESS BOX TRUCK, the property of COMFORT MATTRESS, without said person's consent, with the intent to commit an offense therein, to wit: TRESPASS, and the said conveyance was not open to the public at the time, and THE DEFENDANT was not licensed or invited to enter or remain in said conveyance, in violation of Florida STATE Statute 810.02(4)(B). ON 080409 AT APPROXIMATELY 1300 HOURS, THE DEFENDANT DID UNLAWFULLY ENTER INTO A COMFORT MATTRESS BUSINESS BOX TRUCK. IT APPEARED THE DEFENDANT ENTERED THROUGH THE DRIVER'S SIDE DOOR. WHILE INSIDE THE VEHICLE, THE DEFENDANT TURNED ON THE HAZARD LIGHTS AND LEFT THE DRIVER'S SIDE DOOR OPEN. I SPOKE TO WITNESS ONE WHO INFORMED ME WHILE DRIVING NORTH BOUND ON HIGHWAY 19 HE OBSERVED THE DEFENDANT, WHO WAS WEARING A WHITE SHIRT AND BLUE MINISKIRT, STANDING NEXT TO THE COMFORT MATTRESS BOX TRUCK DRIVER'S SIDE DOOR. HE THEN TURNED AROUND AND HEADED SOUTH BOUND AND DID NOT SEE HER. HE DID NOTICE THE HAZARD LIGHTS WERE ON AT THAT TIME AND THE DOOR WAS LEFT OPEN. HE THEN CALLED AND INFORMED THE MANAGER OF COMFORT MATTRESS, WITNESS TWO, OF THE SITUATION. WITNESS TWO THEN WALKED OUTSIDE AND OBSERVED A WOMAN IN A WHITE SHIRT AND BLUE SKIRT STANDING NEXT TO THE DRIVER'S SIDE DOOR OF THE COMFORT MATTRESS TRUCK. HE DID NOTICE THE FLASHERS WERE ON. WITNESS TWO THEN WALKED BACK INSIDE TO CALL THE POLICE. WHEN THE DEFENDANT SAW WITNESS TWO WALK INSIDE TO CALL THE POLICE, SHE LEFT THE SCENE. I THEN MADE CONTACT WITH THE DEFENDANT IN THE FRONT JANACK PLAZA PARKING LOT AND DETAINED HER AT THAT TIME FOR QUESTIONING. I THEN TRANSPORTED THE DEFENDANT TO COMFORT MATTRESS WHERE WITNESS TWO MADE A POSITIVE IDENTIFICATION OF THE DEFENDANT AND STATED THIS WAS THE WOMAN HE HAD SEEN BY THE COMFORT MATTRESS BOX TRUCK DRIVER'S DOOR. THE DEFENDANT WAS THEN PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED), AND PLACED IN THE BACK SEAT OF MY PATROL VEHICLE. WHILE EN ROUTE TO THE CITRUS COUNTY DETENTION FACILITY, THE DEFENDANT WAS READ HER MIRANDA RIGHTS REFERENCE A PREPRINTED CARD. SHE ADVISED SHE UNDERSTOOD THESE RIGHTS AND CHOSE TO WAIVE THEM. I THEN OBTAINED A CONFESSION FROM THE DEFENDANT REGARDING ENTERING THE TRUCK. THE DEFENDANT STATED SHE KNEW SHE SHOULD NOT HAVE ENTERED THE VEHICLE BUT SHE CLAIMED SHE DID NOT TAKE ANYTHING. WITNESS TWO, WHO IS THE STORE MANAGER, INFORMED ME THAT HE DID NOT FIND ANYTHING MISSING AT THIS TIME AND IF HE DID, HE WOULD CALL WITH FURTHER DETAILS. *NOT-EXEMPT*
