SUBMITTED BY: DOWLING, THOMAS 0709 (AR11121336) DID UNLAWFULLY AND KNOWINGLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT UNDER TWENTY GRAMS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). ON 061811 AT APPROXIMATELY 2216 HOURS WHILE ON PATROL I WAS TRAVELING SOUTH ON SOUTH LECANTO HIGHWAY WHEN I OBSERVED A VEHICLE TRAVELING NORTH WITH AN INOPERABLE LEFT TAIL LIGHT AS WELL AS AN INOPERABLE TAG LIGHT. I TURNED AROUND AND CONDUCTED A TRAFFIC STOP ON THE VEHICLE AT THE INTERSECTION OF SOUTH LECANTO HIGHWAY AND WEST WOODLAND RIDGE DRIVE IN LECANTO. I APPROACHED THE DRIVER SIDE OF THE VEHICLE, BEARING FLORIDA TAG J542KE, AND MADE CONTACT WITH THE DRIVER/DEFENDANT, MS DENISE KRUGER. I ASKED HER FOR HER DRIVER'S LICENSE, THE VEHICLE REGISTRATION AND PROOF OF INSURANCE. WHILE WAITING FOR THE DEFENdANT TO RETRIEVE THE REQUESTED DOCUMENTS, THE DEFENDAnt was acting nervousLY. i looked at the defeNdant's lap and observed A SMALL PIECE OF A GREEN LEAFY SUBSTANCE whICH was known to ME AS cannabis. i asked the defendant what was on her lap, at which time she grabbed the GREEN LEAFY SUBSTANCE and threw it out the driver side window. the defendant stated "uh, i don't know." i retrieved the GREEN LEAFY SUBSTANCE from the ground and based on my training and experience, identified IT AS cannabis, COMMONLY REFERRED TO AS MARIJUANA. I RETURNED TO MY PATROL VEHICLE AND TESTED THE GREEN LEAFY SUBSTANCE WITH AN AGENCY ISSUED FIELD TEST KIT WHICH YIELDED A POSITIVE RESULT FOR CANNABIS. I RETURNED TO THE DEFENDANT'S VEHICLE AND asked the defendant to step out of the vehicle. the defendant was pat-down searched for guns, knives or other contraBAND WHICH WAS MET WITH NEGATIVE RESULTS. I ASKED THE DEFENDANT IF THERE WERE Any other narcotics inside of the vehicle, to which she stated no and that i could check. while looking in the front seat, through the open door, i observed more marijuana underneath the driver seat. the defendant was then placed under arrest for one count of possession of marijuana in an amount under twenty grams. SHE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK, SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. UPON ARRIVAL, THE DEFENDANT WAS BOOKED AND HELD ON A BOND OF $500.00, IN ACCORDANCE WITH THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED A FLORIDA UNIFORM TRAFFIC CITATION, CITATION NUMBER 8756-GJX6, FOR FAULTY EQUIPMENT, INOPERABLE TAG LIGHT, WITH A FINE OF $116.00 PAYABLE IN THIRTY DAYS AT THE CITRUS COUNTY COURTHOUSE. PRIOR TO LEAVING THE SCENE, THE VEHICLE THE DEFENDANT HAD BEEN DRIVING WAS TURNED OVER TO THE REGISTERED OWNER.
