Probable cause affidavit: SUBMITTED BY: AGUILERA, EMANUEL 1238 (AR14-11797) DID UNLAWFULLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: ONE GRAM OF METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 083014, AT APPROXIMATELY 0051 HOURS, I WAS TRAVELING SOUTH ON ISABEL TERRACE, IN FRONT OF 5186 ISABEL TERRACE, WHEN I OBSERVED A SILVER FORD VEHICLE TRAVELING SOUTH ON ISABEL IN FRONT OF THIS DEPUTY. I OBSERVED THE VEHICLE RUN A STOP SIGN AT WEST RENEE LANE, WHERE THE DRIVER TURNED RIGHT ON WEST RENEE LANE AND ACCELERATED, SPINNING HIS TIRES AROUND THE CORNER. I ATTEMPTED TO GET BEHIND SAID VEHICLE AND HE CONTINUED ONTO WEST SASSER STREET TRAVELING AT A HIGH RATE OF SPEED AND TURNING LEFT ON WEST VILLAGE DRIVE. I CAUGHT UP TO THE VEHICLE, ACTIVATED MY EMERGENCY EQUIPMENT AND READ THE FLORIDA LICENSE PLATE 1537PL. I THEN CONDUCTED A TRAFFIC STOP AT THE INTERSECTION OF SOUTH VELOUR LOOP AND WEST VILLAGE DRIVE.. I MADE CONTACT WITH THE DRIVER, LATER IDENTIFIED AS THE DEFENDANT, MR DENNIS COAN. THE DRIVER APPEARED VERY FIDGETY AND NERVOUS WHILE SPEAKING WITH THIS DEPUTY. I ASKED FOR HIS DRIVER'S LICENSE, REGISTRATION AND PROOF OF INSURANCE, WHERE HE COULD ONLY PROVIDE ME WITH HIS DRIVER'S LICENSE NUMBER. I ASKED THE DEFENDANT WHY HE RAN THE STOP SIGN AT WEST RENEE LANE AND SOUTH ISABEL AND THEN PROCEEDED TO SPIN HIS TIRES AND TRAVEL AT A HIGH RATE OF SPEED. THE DEFENDANT ADVISED ME THAT HE DID KNOW THAT HE RAN THE STOP SIGN, HOWEVER HE DID REMEMBER SPINNING HIS TIRES. THE DEFENDANT ADVISED THAT THE REASON HE WAS TRAVELING AT A HIGH RATE OF SPEED WAS because HE THOUGHT THERE WAS SOMEONE BEHIND HIM THAT DID NOT LIKE HIM UNTIL HE OBSERVED MY FLASHING LIGHTS AND HE REALIZED THAT IT WAS LAW ENFORCEMENT. I ASKED IF HE HAD ANYTHING ILLEGAL IN THE VEHICLE AND HE ADVISED THAT HE DID NOT. I ASKED THE DEFENDANT IF HE WOULD CONSENT TO A SEARCH OF HIS VEHICLE AND HE ADVISED THAT HE WOULD. I ASKED THE DEFENDANT TO STEP OUT OF THE VEHICLE, AT WHICH TIME HE STEPPED OUT AND WALKED TO THE FRONT OF MY PATROL VEHICLE WITH THIS DEPUTY. WHILE SPEAKING WITH THE DEFENDANT, DEPUTY HRYC ARRIVED AS A BACK UP DEPUTY AND DEPLOYED HIS CANINE PARTNER ZEUS FOR AN EXTERIOR SNIFF OF THE FREE AIR SPACE SURROUNDING THE DEFENDANT’S VEHICLE. DEPUTY HRYC ADVISED THAT CANINE ZEUS DID ALERT TO THE VEHICLE. DEPUTY HYRC STOOD BY WITH THE DEFENDANT AT THE FRONT OF MY PATROL VEHICLE WHILE I CONDUCTED A HAND SEARCH OF THE VEHICLE. WHILE SEARCHING THE DRIVER’S SIDE OF THE VEHICLE, I LOCATED AN ORIGINAL WATER PROOF PLASTIC KEY CASE WITH THE KEY CHAIN WRAPPED AROUND THE CENTER CONSOLE. INSIDE OF THE ORIGINAL KEY CASE I LOCATED A piece OF black TAPE WHICH HAD A CLEAR PLASTIC BAGGIE INSIDE. THE CLEAR PLASTIC BAGGIE CONTAINED A CLEAR CRYSTAL SUBSTANCE THAT THROUGH MY TRAINING AND EXPERIENCE I BELIEVED TO BE METHAMPHETAMINE. I TOOK THE BAGGIE BACK TO MY PATROL VEHICLE AND READ THE DEFENDANT HIS MIRANDA RIGHTS VIA PREPRINTED CARD. I ASKED HIM ABOUT the CRYSTAL SUBSTANCE, TO WHICH HE ADVISED THAT HE DID NOT know IT WAS THERE. I EXPLAINED TO THE DEFENDANT THAT HE WAS GOING TO BE PLACED UNDER ARREST AND HE WAS HANDCUFFED, (DOUBLE LOCKED), BEHIND HIS BACK, SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING THE CRYSTAL SUBSTANCE WAS TESTED WHICH YIELDED A POSITIVE REACTION FOR METHAMPHETAMINE. THE METHAMPHETAMINE WAS WEIGHED ON SCENE FOR AN APPROXIMATE TOTAL WEIGHT OF ONE GRAM. DEPUTY HRYC PACKAGED THE METHAMPHETAMINE AND LATER TURNED IT INTO EVIDENCE. THE DEFENDANT’S VEHICLE WAS LEFT ON THE SIDE OF THE ROAD PER THE DEFENDANT’S REQUEST FOR HIS AUNT TO PICK UP. WHILE EN ROUTE TO THE JAIL, THE DEFENDANT ADVISED ME THAT HE WAS JUST COMING FROM A FRIEND’S RESIDENCE AND WHEN HE SAW THE ORIGINAL WATERPROOF CASE HE KNEW THAT THERE WAS DRUGS INSIDE OF IT AND I WAS GOING TO FIND THEM. UPON ARRIVAL AT THE JAIL THE DEFENDANT WAS TURNED OVER TO THE DETENTION FACILITY STAFF. THE DEFENDANT WAS ISSUED WRITTEN WARNING NUMBER 387255B, FOR RUNNING THE STOP SIGN AT WEST RENEE LANE AND ISABEL TERRACE. THE DEFENDANT WAS ALSO ISSUED WRITTEN WARNING NUMBER 387256B, FOR CARELESS DRIVING WHEN HE SPUN HIS TIRES. THE DEFENDANT’S BOND WAS SET AT $2,000.00, PER THE BOND SCHEDULE.
