SUBMITTED BY: PATTERSON, DEREK 0560 (AR11121164) DID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). on 060911, while traveling east on main street approaching the intersectIon of citrus avenue in inverness, i observed a tan chevrolet malIbu with nEW YORK tag azt1148 attached to it, traveling west, directly in FRONT OF my vehicle. upon running THE tag through fcic/ncic it was learned that the registration for the vehicle had been suspended by the state of new york due to an insurance lapse. at that time i conducted a traffic stop ON THE vehicle, which stopped on line avenue, near main street. contact was then made with the driver/defendAnt, mr dennis pOMIETLASZ, JR., who provided me with his new york driver's license. i then returned to my vehicle and upon running his driver's license through fcic/ncic, learned it had been susPended as Well. i then ran mr pOMIETLASZ'S name through the florida department of highway safety and motor vehicles and learned that MR POMIETLASZ only has an identification card in florida. i then made contact with mr pOMIETLASZ and explained to him that his driver's license was suspended. he then responded that it had been suspended for failing to appear in court, but stated he had it reinstated prior to leaving new york. mr pOMIETLASZ additionally stated he had not obtained a florida driver's license because he is not certain he is going to remain in florida since he is not employed. since mr pOMIETLASZ, JR., has no ties to citrus county or to the state of florida, he wAs placed under ARREST FOR driving while his license was suspended or revoked, and was transported to the citrus county detention facility WHERE HIS bond was set at $500.00 per the bond schedule. he was Additionally issued florida uniform traffic citation number 6196-gjx-x with mandatory court date of 062711 at 1300 hours.
