| Probable cause affidavit: | SUBMITTED BY: FERGUSON, KYLE 1266\t\t(AR16-22053) did unlawfully and knowingly obtain, use or endeavor to obtain or use the property of THE VICTIM, to-wit: 2006 FORD F-150 BEARING TAG NUMBER GGJS32 VALUED AT APPROXIMATELY $15,000.00, by exercising control over said property with the intent to either temporarily or permanently deprive THE VICTIM of a right to the property or a benefit thereof, or did appropriate the property to HIS own use or the use of any person not entitled thereto, and knew or should have known that said property was stolen, in violation of Florida Statute 812.014(2)(c)(3). ON 120516, A THEFT OF A MOTOR VEHICLE WAS REPORTED TO THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO) WITH THE VICTIM BEING MR BRIAN HAMILTON AND THE SUSPECT BEING THE DEFENDANT, MR DENVER NAYLOR. ON 120516, THE VICTIM HAD TOLD THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO) THAT HE ALLOWED THE DEFENDANT INSIDE OF HIS MOTEL ROOM AT BELL VILLA SO HE COULD DO WORK FOR THE VICTIM. THE VICTIM FURTHER ADVISED THAT AFTER HE LET THE DEFENDANT INSIDE THE ROOM, THE VICTIM TOOK A SHOWER AND UPON HIM EXITING THE SHOWER HE OBSERVED THAT HIS VEHICLE KEYS THAT WERE SITTING ON THE NIGHTSTAND HAD BEEN REMOVED AND HIS 2006 BLACK IN COLOR FORD F-150 BEARING TAG NUMBER GGJS32 WAS MISSING. THE VICTIM HAD ADVISED THAT THE DEFENDANT WAS THE ONLY PERSON THAT WAS IN THE ROOM AND THAT HE HAD NEVER LET THE DEFENDANT DRIVE HIS VEHICLE OR HAVE ACCESS TO IT. THE VICTIM COMPLETED AN AUTO THEFT AFFIDAVIT AND A SWORN STATEMENT WAS COLLECTED. A BOLO EMAIL WAS ALSO SENT OUT FOR THE DEFENDANT, MR DENVER NAYLOR. ON 122416, I RESPONDED AS BACKUP TO 10515 WEST PALMETTO STREET IN REFERENCE TO AN UNRELATED CALL FOR SERVICE WHERE I OBSERVED DEPUTY AGUILERA (1238) READ THE DEFENDANT, MR DENVER NAYLOR, HIS MIRANDA WARNINGS VIA AN AGENCY PREPRINTED CARD. THE DEFENDANT WAS ALREADY PLACED IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK. THE DEFENDANT ADVISED HE WOULD SPEAK TO MYSELF AND DEPUTY AGUILERA IN REFERENCE TO THE STOLEN VEHICLE AND THE UNRELATED CALL FOR SERVICE. WHILE SPEAKING WITH THE DEFENDANT ABOUT THE STOLEN VEHICLE, HE ADVISED THAT HE DID NOT KNOW MR HAMILTON AND FURTHER STATED ââTHE NEXT TIME YOU SEE BRIAN TELL HIM THAT HIS OLD LADY IS TRYING TO FUCK ME.ââ I AGAIN ASKED THE DEFENDANT IF HE KNEW THE VICTIM, MR HAMILTON, TO WHICH HE STATED ââNO.ââ WHEN I ASKED HOW HE KNEW THE VICTIMâS GIRLFRIEND AND NOT THE VICTIM HE REPLIED, ââOH, SHIT.ââ AT THAT TIME, THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY AND WAS TURNED OVER TO DETENTION STAFF FOR BOOKING. THE DEFENDANTâS BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE AND CHARGED WITH ONE COUNT THEFT OF VEHICLE. |
