SUBMITTED BY: HAYNES, TRAVIS 0546 (AR11119120) did then and there unlawfully carry a concealed weapon or electric weapon or device IN HIS BACKPACK, to-wit: A TITAN 22 CALIBER HANDGUN WITH SERIAL NUMBER 239417, in violation of Florida Statute 790.01(2); ON 020211 AT APPROXIMATELY 1320 HOURS, I RESPONDED TO THE AREA OF WEST HALLS RIVER ROAD and SOUTH TAYLOR TERRACE IN REFERENCE TO A DISTURBANCE IN PROGRESS. WHILE IN ROUTE I WAS ADVISED BY DISPATCH THAT A BLACK MALE WAS CHASING A WHITE FEMALE ON HALLS RIVER ROAD. UPON MY ARRIVAL IN THE AREA, I OBSERVED A BLACK MALE, LATER IDENTIFIED AS THE DEFENDANT DEONDRAY HILL, WALKING EAST ON THE SOUTH SIDE OF HALLS RIVER ROAD. CONTACT WAS MADE WITH MR HILL AT THE INTERSECTION OF HALLS RIVER ROAD AND TAYLOR TERRACE. MR HILL WAS CARRYING CLOTHES and A BACKPACK IN HIS HANDS. I ASKED MR HILL TO PUT THE ITEMS DOWN AND HE DID. I THEN CHECKED MR HILL FOR WEAPONS AND FOUND . I THEN PICKED UP THE ITEMS MR HILL WAS CARRYING AND PLACED THEM ON the HOOD OF MY VEHICLE. MR HILL IMMEDIATELY STATED "THAT BACKPACK IS NOT MINE". I THEN LIFTED THE BACKPACK, WHICH WAS ALMOST EMPTY EXCEPT FOR ONE HEAVY ITEM. WHEN I FELT THE ITEM from the OUTSIDE OF THE BACKPACK, I IMMEDIATELY REALIZED THAT THE ITEM WAS A HOLSTERED HANDGUN. I THEN LOOKED INSIDE AND CONFIRMED THAT A BLACK HANDGUN IN A BLACK LEATHER CASE WAS INSIDE THE BACKPACK. MR HILL STATED THAT HE DID NOT KNOW THERE WAS A GUN IN THE BACKPACK AND HE FOUND THE BACKPACK NEAR THE WOODS. I THEN HANDCUFFED MR HILL FOR INVESTIGATIVE PURPOSES AND PLACED HIM IN THE REAR OF MY PATROL VEHICLE. THE TITAN 22 CALIBER HANDGUN WAS NOT LOADED and HAD NO MAGAZINE IN IT. INSIDE THE BACKPACK THERE WAS ALSO FIVE ROUNDS OF 22 CALIBER AMMUNITION, AN EMPTY PACK OF CIGARETTES and A BLACK AND MILD CIGAR. THE HANDGUN WAS CHECKED IN NCIC/FCIC AND NO HITS WERE FOUND. MR HILL WAS IN THE REAR OF MY PATROL VEHICLE AND I READ HIM HIS MIRANDA WARNINGS FROM A PRE-PRINTED CARD. MR HILL ADVISED HE UNDERSTOOD HIS RIGHTS AND THAT HE DID WISH TO SPEAK WITH ME. MR HILL ADMITTED THAT HE KNEW THE GUN WAS IN THE BACKPACK AND THAT WHEN HE AND HIS GIRLFRIEND WERE HAVING AN ARGUMENT SHE GAVE HIM THE CLOTHES AND BACK PACK AND HE STARTED WALKING DOWN THE ROAD. MR HILL STATED HE FOUND the GUN and THE BOX OF AMMUNITION NEAR THE WOODS LAST NIGHT, TUESDAY 020111. MR HILL DOES NOT HAVE A PERMIT TO CARRY A CONCEALED WEAPON. MR HILL LIVES APPROXIMATELY 300 YARDS FROM WHERE I MADE CONTACT with HIM AND HAD BEEN ARGUING WITH HIS GIRLFRIEND IN the FRONT YARD, WHICH IS WHY THIS AGENCY WAS CONTACTED. DEPUTY COX MADE CONTACT WITH MR HILL'S GIRLFRIEND and SHE ADVISED THAT MR HILL DID LEAVE THE RESIDENCE with THE BACKPACK AND THE ARGUMENT WAS ONLY VERBAL. MR HILL ADVISED THE SAME. UPON RUNNING MR HILL IN NCIC/FCIC THROUGH TELETYPE, IT WAS DETERMINED THAT HE HAD TWO WARRANTS OUT OF PASCO COUNTY. ONE FOR A FAILURE TO APPEAR, ON A DRIVING WHILE LICENSE SUSPENDED CASE and ANOTHER FOR FAILURE TO APPEAR ON A DRIVING UNDER THE INFLUENCE CASE. MR HILL WAS PLACED UNDER ARREST FOR POSSESSION OF A CONCEALED FIREARM WITHOUT A PERMIT and TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HIS BOND WAS SET AT $2,000.00.
