SUBMITTED BY:\tSUDLOW, JAMES 0759 (16-19575) BANKS, ANGELINA 1426 DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: ONE PLASTIC BAGGIE CONTAINING 1.61 GRAMS OF METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: ONE CLEAR PLASTIC BAGGIE CONTAINING 0.48 GRAMS OF HEROIN, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: ONE HYPODERMIC NEEDLE, TWO STRAWS, DIGITAL SCALE, CLEAR PLASTIC BAGGIE WITH RESIDUE, SPOON WITH RESIDUE AND A GIFT CARD WITH RESIDUE, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). ON 052316, I RESPONDED TO THE CITGO LOCATED AT 7810 SOUTH FLORIDA AVENUE IN FLORAL CITY IN REFERENCE TO PROVIDING BACKUP FOR DETECTIVE STRICKLAND (0583) WHO HAD CONDUCTED A TRAFFIC STOP ON A SILVER IN COLOR FORD F150 BEARING FLORIDA LICENSE PLATE NUMBER DV0699G. UPON EXITING MY VEHICLE, I APPROACHED THE DRIVER SIDE OF THE VEHICLE AND OBSERVED THE DRIVER, LATER IDENTIFIED AS DEFENDANT, MR DONALD GIDEONS, REACH DOWN IN BETWEEN HIS FEET. I ALSO OBSERVED THE FRONT SEAT PASSENGER, LATER IDENTIFIED AS DEFENDANT, MS SARA BRANDON, PLACE A DARK COLORED GLASS VIAL UNDER HER LEFT THIGH. ALSO LOCATED IN THE VEHICLE I OBSERVED A MALE, LATER IDENTIFIED AS DEFENDANT, MR CHRIS ARMSTRONG, SITTING IN THE BACK PASSENGER SEAT. I THEN ASKED ALL OCCUPANTS IF THERE WAS ANYTHING ILLEGAL IN THE VEHICLE. AT THAT TIME, K-9 DEPUTY RITLI (0426) ARRIVED ON SCENE. I ASKED ALL OF THE DEFENDANTS TO ROLL THEIR WINDOWS UP THREE-QUARTERS OF THE WAY AND PLACE THEIR HANDS WHERE I COULD SEE THEM. K-9 DEPUTY RITLI DEPLOYED CANINE KHAOS FOR AN EXTERIOR SNIFF OF THE VEHICLE TO WHICH K-9 DEPUTY RITLI ADVISED CANINE KHAOS SHOWED A POSITIVE ALERT. AT THAT TIME, I REQUESTED DEFENDANT GIDEONS TO EXIT THE VEHICLE. HE GAVE ME PERMISSION TO SEARCH HIS PERSON AND I LOCATED NOTHING. DEPUTY TITUS (1243) AND DEPUTY SHERIFF TRAINEE BANKS (1426) REQUESTED DEFENDANT BRANDON TO EXIT THE VEHICLE. I OBSERVED THE GLASS VIAL SHE HAD PLACED UNDER HER LEFT THIGH ROLL TO THE CENTER OF THE PASSENGER SEAT. LOCATED IN THAT VIAL WAS HALF OF A PILL OF 8 MILLIGRAM DILAUDID AND THREE 0.5 MG ALPRAZOLAM. DEPUTY TITUS INSTRUCTED DEFENDANT BRANDON TO STAND BY THE BUMPER OF HIS PATROL VEHICLE. AT THAT TIME, I ASKED DEFENDANT BRANDON IF THE PILLS BELONGED TO HER AND IF SHE EVER HAD PRESCRIPTIONS FOR THEM. SHE ADVISED THEY DID BELONG TO HER AND SHE NEVER HAD PRESCRIPTIONS FOR THEM. I PLACED DEFENDANT BRANDON IN HANDCUFFS, DOUBLE-LOCKED, BEHIND HER BACK AND PLACED HER IN THE REAR OF DEPUTY TITUS' PATROL VEHICLE. DEPUTY TITUS THEN REMOVED DEFENDANT ARMSTRONG AND WHILE SEARCHING HIM, HE FELT AN OBJECT ON THE LEFT SIDE OF HIS GROIN AREA. DEPUTY TITUS THEN REQUESTED ME TO SEARCH DEFENDANT ARMSTRONG, AT WHICH TIME I FELT THE SAME OBJECT. I ASKED DEFENDANT ARMSTRONG WHAT WAS IN HIS PANTS, WHICH HE ADVISED "METH PILLS AND WEED." DEFENDANT ARMSTRONG THEN RETRIEVED WHAT LOOKED LIKE A CHANGE PURSE FROM HIS UNDERWEAR. UPON LOOKING INSIDE, I OBSERVED THREE DIME BAGS OF CRYSTAL-LIKE SUBSTANCES INSIDE, WHICH TESTED POSITIVE FOR METHAMPHETAMINE FOR A TOTAL WEIGHT OF 2.90 GRAMS AND ANOTHER DIME BAG THAT CONTAINED 13 PILLS, TWO (2) OF WHICH WERE MORPHINE 30 MILLIGRAMS AND ELEVEN (11) WHICH WERE ALPRAZOLAM 0.5 MILLIGRAMS. THERE WAS ALSO ANOTHER DIME BAG THAT HAD A GREEN LEAFY SUBSTANCE IN IT, WHICH TESTED POSITIVE FOR MARIJUANA. THERE WAS A PLASTIC STRAW LOCATED INSIDE THAT HAD METHAMPHETAMINE RESIDUE IN IT. DEFENDANT ARMSTRONG ADVISED HE DID NOT HAVE PRESCRIPTIONS FOR THE MORPHINE OR THE ALPRAZOLAM. DEFENDANT ARMSTRONG WAS PLACED IN HANDCUFFS, DOUBLE-LOCKED, BEHIND HIS BACK AND PLACED IN THE REAR OF MY PATROL VEHICLE. UPON SEARCHING THE DRIVER COMPARTMENT OF THE VEHICLE, I LOCATED A BLACK IN COLOR ZIPPERED BAG ON THE DRIVER FLOORBOARD. UPON LOOKING INSIDE, I LOCATED A CLEAR PLASTIC BAG CONTAINING 1.61 GRAMS OF A CRYSTAL-LIKE SUBSTANCE THAT TESTED POSITIVE FOR METHAMPHETAMINE. ALSO, LOCATED IN THE SAME BLACK BAG WAS A SMALL DIGITAL SCALE, A DIME BAG WITH METHAMPHETAMINE RESIDUE IN IT, A SMALL PINK BASKIN ROBBINS SPOON WITH METHAMPHETAMINE RESIDUE AND A BIG LOTS REWARDS GIFT CARD WITH METHAMPHETAMINE RESIDUE. I THEN LOCATED A LONG SILVER METALLIC CONTAINER SITTING NEXT TO THE BLACK IN COLOR ZIPPERED POUCH THAT CONTAINED A SYRINGE AND TWO PLASTIC STRAWS, WHICH TESTED POSITIVE FOR METHAMPHETAMINE. LOCATED BY THESE TWO ITEMS WAS A CLEAR CELLOPHANE WRAPPER THAT CONTAINED 0.48 GRAMS OF A BROWN SUBSTANCE, WHICH TESTED POSITIVE FOR HEROIN. AT THAT TIME, DUE TO THE DEFENDANT REACHING DOWN TOWARDS THE FLOORBOARD AT THE TIME I MADE CONTACT WITH HIM AND THE FACT THERE WAS NOTHING ELSE ON THE FLOORBOARD OTHER THAN THE BLACK IN COLOR ZIPPERED POUCH THAT CONTAINED METHAMPHETAMINE, PARAPHERNALIA, A CELLOPHANE WRAPPER THAT CONTAINED HEROIN AND THE RECTANGULAR SILVER METALLIC BOX THAT CONTAINED DRUG PARAPHERNALIA, I PLACED DEFENDANT GIDEONS UNDER ARREST FOR THOSE ITEMS. ALL DEFENDANTS WERE TRANSPORTED TO CITRUS COUNTY DETENTION FACILITY WHERE EACH ONE WAS INTERVIEWED BY THIS DEPUTY (0759). POST MIRANDA, WHILE BEING RECORDED, DEFENDANT BRANDON ADMITTED THE ALPRAZOLAM 0.5 MILLIGRAM, DILAUDID 8 MILLIGRAMS AND PARAPHERNALIA BELONGED TO HER. DEFENDANT GIDEONS ADMITTED THE 1.6 GRAMS OF METHAMPHETAMINE AND THE PARAPHERNALIA WAS HIS; HOWEVER, DENIED OWNERSHIP OF THE HEROIN. DEFENDANT ARMSTRONG ADMITTED TO THE THREE BAGS OF METHAMPHETAMINE WITH A TOTAL WEIGHT OF 2.90 GRAMS, MORPHINE 30 MILLIGRAMS, ALPRAZOLAM 0.5 MILLIGRAMS, CANNABIS AND PARAPHERNALIA ALL BELONGED TO HIM. THE DEFENDANT'S BOND WAS SET AT $4,000.00 FOR TWO COUNTS OF POSSESSION OF A CONTROLLED SUBSTANCE AND $1,000.00 FOR ONE COUNT OF POSSESSION OF DRUG PARAPHERNALIA, FOR A TOTAL OF $5,000.00, PER THE BOND SCHEDULE. |
