SUBMITTED BY: TEWELL, MICHELE 0535 (AR11121830) DID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2). On 082011, while on routine patRol, I observed the defeNdant, MR donald M Kellman, driving a white 2002 ford econO-van bearing FLORIDA tag u140ef. The defeNdant was observed traveling south on NORTH line aveNUE. The defeNdant stopped at the traffic signal at NORTH line aveNUE and STATE ROAD 44 WEST IN INVERNESS, then proceeded to make a right hand turn on red, traveling west on STATE ROAD 44 wEST. A traffic stop was conducted for failing to obey A traffic control device, No turn on red SIGN. The defeNdant's driver's license was requested and the defeNdant advised THAT he left his wallet at home but provided his name and date of birth. A records check was then conducted through fcic/ncic. The records check revealed the defeNdant had FIVE pages of suspensionS, the latest on 071811 for DRIVING WHILE LICENSE SUSPENDED (dwls.) When questioned about the suspensions, the defeNdant advised that he had taken care of everything and that his license should be good. The defeNdant was placed under arrest, handcuffed (DOUBLE LOCKED) BEHIND HIS BACK, secured in the rear SEAT of my patrol vehicle and transported to THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. UPON ARRIVAL, The defendant WAS CHARGED WITH ONE COUNT OF DRIVING WHILE LICENSE SUSPENDED, KNOWINGLY, WITH BOND SET AT $500.00, PER THE BOND SCHEDULE. THE DEFENDANT was issued WRITTEN WARNING NUMBER warning 320358B FOR VIOLATION OF A TRAFFIC CONTROL DEVICE, NO RIGHT ON RED SIGN. HE WAS ALSO ISSUED FLORIDA UNIFORM TRAFFIC citation NUMBER 6636-GJX2, for driving whILE license SUSPENDED, KNOWINGLY.
