Probable cause affidavit: SUBMITTED BY: SUNDBERG, KURT 1268 (AR 16-20122 DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: 1.15 GRAMS OF METHAMPHETAMINE, ONE AND ONE HALF PILLS OF OXYCODONE, ONE PARTIAL SUBOXONE STRIP, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 070316, I ARRIVED AT DEPUTY LABORDA’S TRAFFIC STOP LOCATED AT WEST LONGFELLOW STREET AND SOUTH HULL TERRACE, HOMOSASSA. UPON ARRIVAL, I OBSERVED HIM TO HAVE A 2012 WHITE IN COLOR GMC PICKUP BEARING FLORIDA LICENSE PLATE 7860PB PULLED OVER. I THEN MAKE CONTACT WITH DEPUTY LABORDA. DEPUTY LABORDA ADVISED THAT HE STOPPED THE VEHICLE FOR FAILING TO STOP AT THE STOP SIGN LOCATED AT SOUTH MELANIE DRIVE AND SOUTH IROQUOIS AVENUE. DEPUTY LABORDA ADVISED ME THAT THE DRIVER WAS MR DONALD MAYNARD, LATER IDENTIFIED AS THE DEFENDANT AND THE PASSENGER WAS MR CALVIN BISHOP. DEPUTY LABORDA ADVISED ME HE WAS GOING TO WALK HIS CANINE PARTNER AROUND THE VEHICLE WHICH HE DID. AFTER HE WAS FINISHED with the WALK AROUND, DEPUTY LABORDA ADVISED THAT HIS CANINE PARTNER GUNNY HAD ALERTED TO THE VEHICLE. DEPUTY LABORDA THEN ASKED THE DRIVER/DEFENDANT TO EXIT THE VEHICLE AND ASKED PERMISSION TO SEARCH THROUGH THE DEFENDANT’S POCKETS TO WHICH HE GRANTED. AFTER SEARCHING THE DEFENDANT’S POCKETS, DEPUTY LABORDA LOCATED APPROXIMATELY 1.15 GRAMS OF METHAMPHETAMINE, ONE AND ONE HALF 30 MILLIGRAMS OF OXYCODONE, AND ONE PARTIAL SUBOXONE STRIP IN THE DEFENDANT’S WALLET. THE DEFENDANT WAS THEN DETAINED, PLACED IN THE REAR OF MY PATROL VEHICLE. THE FRONT SEAT PASSENGER WAS ASKED TO STEP OUT OF THE VEHICLE TO WHICH HE DID. DEPUTY LABORDA THEN CONDUCTED A HAND SEARCH OF THE VEHICLE. CONTACT WAS LATER MADE WITH THE DEFENDANT WHERE HE WAS READ MIRANDA RIGHTS BY DEPUTY LABORDA VIA PREPRINTED AGENCY CARD. HE WAS ASKED IF HE UNDERSTOOD HIS RIGHTS, TO WHICH HE REPLIED THAT HE DID. HE WAS ASKED IF HE WISHED TO SPEAK WITH US AT THIS TIME, TO WHICH HE ADVISED THAT HE WOULD. THE DEFENDANT ADVISED THE METHAMPHETAMINE OXYCODONE AND SUBOXONE WAS HIS AND HE WAS CURRENTLY USING THE SUBOXONE TO TRY TO HELP WITH HIS PILL ADDICTION. I ADVISED THE DEFENDANT HE WAS BEING PLACED UNDER ARREST FOR THREE COUNTS OF POSSESSION OF CONTROLLED SUBSTANCE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT’S BOND WAS SET AT $2,000.00 FOR EACH COUNT OF POSSESSION OF A CONTROLLED SUBSTANCE FOR A TOTAL BOND OF $6,000.00 PER THE BOND SCHEDULE. DEPUTY LABORDA ISSUED THE DEFENDANT WRITTEN WARNING NUMBER 406364B FOR THE STOP SIGN INFRACTION. SEE DEPUTY LABORDA’S SUPPLEMENT FOR FURTHER.
