SUBMITTED BY: SCHAFFER, HEATH 0652 (AR16-20185) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: TEN LORTAB 7.5 MILLIGRAM TABLETS AND ONE DILAUDID 8 MILLIGRAM TABLET, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A ZIPPER POUCH CONTAINING PARAPHERNALIA TO INCLUDE A SPOON WITH RESIDUE AND TIE-OFF BANDS, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). ON 070816, AT APPROXIMATELY 2032 HOURS, I BEGAN FOLLOWING A BLUE SATURN SPORTS UTILITY VEHICLE BEARING FLORIDA LICENSE PLATE NUMBER DXSX54 NORTHBOUND ON SOUTH APOPKA AVENUE. I OBSERVED THE VEHICLE WAS INCREASING THE DISTANCE BETWEEN US. I CAUGHT UP AND BEGAN TO PACE THE VEHICLE WITH MY AGENCY ISSUED CALIBRATED PATROL VEHICLE. WHILE PACING THAT VEHICLE, IT REACHED A MAXIMUM SPEED OF 42 MILES PER HOUR IN A 35 MILE PER HOUR ZONE. I THEN ACTIVATED MY EMERGENCY LIGHTS AND SIREN AND STOPPED THE VEHICLE NEAR THE INTERSECTION OF SOUTH APOPKA AVENUE AND EAST GENTRY STREET. I APPROACHED THE DRIVER SIDE OF THE VEHICLE AND MADE CONTACT WITH THE DRIVER/DEFENDANT, MS DONNA GREER. I ASKED THE DEFENDANT FOR HER DRIVER LICENSE, REGISTRATION AND PROOF OF INSURANCE, WHICH SHE PROVIDED. I THEN ENGAGED A CONVERSATION WITH HER ABOUT WHERE SHE WAS COMING FROM AND GOING TO. SHE ADVISED SHE HAD JUST BROUGHT GROCERIES TO A FRIEND'S HOUSE AND WAS HEADED BACK HOME. I ASKED THE DEFENDANT IF SHE WAS CURRENTLY TRANSPORTING ANYTHING ILLEGAL, AND SHE SAID NO. I ASKED FOR CONSENT TO SEARCH THE VEHICLE AND THE DEFENDANT SAID, "YES, YOU CAN TAKE A LOOK AROUND IF YOU WANT." I HAD THE DEFENDANT EXIT THE VEHICLE AND STAND WITH SERGEANT MARSHALL (0453) WHILE I BEGAN TO SEARCH THE VEHICLE. DURING MY SEARCH, I FOUND A MULTICOLORED POCKETBOOK, WHICH THE DEFENDANT PULLED HER DRIVER'S LICENSE FROM, IN THE FRONT PASSENGER SEAT. I OPENED THE CHANGE SECTION OF THE POCKETBOOK AND FOUND TEN OVAL TABLETS WITH THE MARKINGS OF "G 036" AND ONE TRIANGULAR SHAPED TABLET WITH THE MARKINGS OF "PD" ON ONE SIDE AND THE NUMBER "8" ON THE OTHER SIDE. THESE NUMBERS WERE ENTERED INTO DRUGS.COM PILL IDENTIFIER WHICH FOUND THESE MEDICATIONS TO BE TEN LORTAB 7.5 MILLIGRAM TABLETS AND ONE DILAUDID 8 MILLIGRAM TABLET. ALSO LOCATED IN THE PASSENGER SEAT WAS A BLACK ZIPPERED POUCH THAT CONTAINED A BROKEN SPOON WITH WHITE RESIDUE ON IT ALONG WITH TWO PIECES OF CLOTH. THE DEFENDANT WAS THEN READ HER MIRANDA RIGHTS VIA A PREPRINTED CARD. SHE ADVISED SHE UNDERSTOOD HER RIGHTS AND WISHED TO SPEAK WITH ME. THE DEFENDANT WAS ASKED ABOUT THE MEDICATION. SHE FIRST ADVISED SHE WAS PRESCRIBED THEM. SHE LATER ADVISED SHE WAS PRESCRIBED DILAUDID MEDICATION BUT ONLY IN 4 MILLIGRAM FORM. SHE ALSO ADVISED THE LORTAB TABLETS WERE HERS FROM AN OLD PRESCRIPTION; HOWEVER, THEY WERE NOT IN A PRESCRIPTION BOTTLE. SHE LATER ADVISED SHE HAD PURCHASED THREE DILAUDID FROM A FRIEND EARLIER TODAY AND GAVE AWAY THE OTHER TWO. THE DEFENDANT WAS THEN ASKED ABOUT THE ZIPPERED POUCH CONTAINING THE PARAPHERNALIA. SHE ADVISED SHE USED THOSE MATERIALS WHEN INJECTING THE MEDICATION. A RECORDED INTERVIEW WAS CONDUCTED WITH THE DEFENDANT, WHICH INCLUDED AN ADMISSION OF THE ABOVE FACTS. THE STATEMENT WILL LATER BE UPLOADED TO QUETEL, AND THE MEDICATION WILL BE PACKAGED AND TURNED IN TO EVIDENCE. THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED IN THE FRONT, AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT WAS ADVISED SHE WAS BEING CHARGED FOR ONE COUNT OF POSSESSION OF A CONTROLLED SUBSTANCE WITH A BOND WAS SET AT $2,000.00 AND ONE COUNT OF POSSESSION OF DRUG PARAPHERNALIA WITH A BOND SET AT $1,000.00 FOR A TOTAL BOND OF $3,000.00, PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED A WRITTEN WARNING CITATION, NUMBER 390904B, FOR THE TRAFFIC INFRACTION. |
