SUBMITTED BY: SMITH, STEVE 0292 (AR09107484) DID UNLAWFULLY AND KNOWINGLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). ON 020209, DEPUTY ANDY COX AND I WERE TRAVELLING EASTBOUND ON TURKEY OAK IN the AREA OF 488 WHEN WE PASSED A GRAY 4-DOOR PONTIAC BEARING FLORIDA TAG NUMBER 886HXI, WHICH WAS PERSONALLY KNOWN TO THESE DEPUTIES. IT IS ALSO knowN THAT DEPUTY COLEMAN AT THAT TIME HAD PROBABLE CAUSE ON A MS MILLS, WHICH WAS IDENTIFIED BY BOTH OFFICERS TO BE SEATED IN THE PASSENGER'S FRONT SEAT. AT THAT TIME, WE MADE CONTACT with DEPUTY COLEMAN, WHO ADVISED HE DID HAVE PROBABLE CAUSE FOR THE ARREST OF MS MILLS. IT SHOULD BE NOTED, AS WE FOLLOWED THE VEHICLE THE DRIVER/DEFENDANT DONNA THOMPSON AND THE PASSENGERS WERE MOVING AROUND EXCESSIVELY AND CONTINUED TO LOOK IN THEIR MIRRORS. IT SHOULD ALSO BE NOTED, IT WAS RAINING VERY HARD. THE OCCUPANTS WERE OBSERVED TO ROLL DOWN BOTH PASSENGER SIDE WINDOWS WHILE WE WERE FOLLOWING THEM. AT THAT TIME, WE CONDUCTED A TRAFFIC STOP AT US HIGHWAY 19 AND SEVEN RIVERS HOSPITAL. UPON MAKING CONTACT WITH DEFENDANT THOMPSON, WHO WAS the DRIVER, AND HER ROLLING HER WINDOW DOWN, A STRONG ODOR OF MARIJUANA EMITTED FROM INSIDE THE VEHICLE. WHEN SHE ASKED WHY SHE HAD BEEN STOPPED, I TOLD HER I would EXPLAIN IN A MINUTE. AT THAT TIME, WE ASKED CO-DEFENDANT MILLS TO STEP FROM the VEHICLE. DEPUTY COLEMAN THEN ARRESTED CO-DEFENDANT MILLS. I ASKED THE PASSENGER SEATED IN THE BACK AND DEFENDANT THOMPSON TO STEP FROM THE VEHICLE. UPON SPEAKING WITH DEFENDANT THOMPSON I NOTICED A STRONG ODOR OF MARIJUANA EMITTING FROM HER PERSON. She WAS ALLOWED TO HAVE A SEAT IN THE REAR OF MY PATROL VEHICLE. A SEARCH OF THE VEHICLE DID LEAD TO THE DISCOVERY OF A SMALL MARIJUANA ROACH CIGARETTE IN THE DRIVER'S SIDE FLOORBOARD, WHICH WEIGHED APPROXIMATELY ONE GRAM. IT SHOULD ALSO BE NOTED, THERE WERE SMALL PIECES OF MARIJUANA SHAKE AROUND THE DRIVER'S SEAT. DEFENDANT THOMPSON WAS ARRESTED, HANDCUFFED DOUBLE LOCKED AND SEATED in the REAR OF MY PATROL VEHICLE. SHE WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY, WITHOUT INCIDENT. THE DEFENDANT WAS CHARGED WITH POSSESSION OF MARIJUANA, LESS THAN 20 GRAMS, WITH BOND SET AT $500.00, PER THE BOND SCHEDULE. IT SHOULD BE NOTED, THE CAR WAS A RENTAL AND WAS TURNED OVER the RENTAL COMPANY. ALL CONTRABAND WAS TURNED INTO EVIDENCE. *NOT-EXEMPT* |
