SUBMITTED BY: MOORE, ANDREW 0619 (AR08106117) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: MARIJUANA METAL SMOKING PIPE, THREE SYRINGES, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) ON 110608, WHILE CONDUCTING A SECURITY CHECK OF FLORAL CITY, I OBSERVED A RED DODGE DAKOTA PICK UP BEARING FLORIDA LICENSE PLATE NUMBER J23QHJ, TRAVELING SOUTHBOUND ON US HIGHWAY 41. I THEN BEGAN TO follow BEHIND the VEHICLE IN ATTEMPT TO RUN THE VEHICLE'S LICENSE PLATE. WHILE TRYING TO RETRIEVE the INFORMATION ON THE TAG, THE DRIVER/DEFENDANT, MS DOROTHY HOFFMAN, TURNED ON the LEFT TURN SIGNAL. UPON DOING SO THE REAR TURN SIGNAL FLASHED RAPIDLY. UPON THE VEHICLE TURNING SIDEWAYS, THIS DEPUTY OBSERVED THE FRONT TURN SIGNAL NOT TO BE WORKING. I THEN STOPPED the VEHICLE USING EMERGENCY LIGHTS AT EAST ORANGE AVENUE and EAST BUSHNELL ROAD. I THEN MADE CONTACT WITH THE DRIVER/DEFENDANT TO TURN ON HER LEFT BLINKER, AT WHICH TIME SHE COMPLIED. I THEN CONFIRMED the FRONT LEFT BLINKER TO NOT BE WORKING. I THEN ASKED THE DEFENDANT TO PROVIDE ME WITH DRIVER'S LICENSE, VEHICLE REGISTRATION, AND PROOF OF INSURANCE. THE DEFENDANT PROVIDED ME WITH HER DRIVER'S LICENSE AND HER INSURANCE CARD, HOWEVER, COULD NOT PROVIDE ME WITH HER REGISTRATION. I THEN ASKED the PASSENGER/WITNESS FOR his IDENTIFICATION CARD, TO which HE STATED THAT HE DID NOT HAVE ONE. I ASKED THE DRIVER IF AFTER THE TRAFFIC STOP WAS COMPLETED, IF WE could LOOK INSIDE OF HER VEHICLE, TO WHICH SHE STATED, NO because THIS DEPUTY ONLY STOPPED HER FOR HER TURN SIGNAL. I THEN RESPONDED BACK TO MY PATROL VEHICLE AND REQUESTED FOR BACK UP. DEPUTY LAUGHLIN THEN RESPONDED AND ARRIVED ON SCENE, AT WHICH TIME HE WENT BACK TO THE VEHICLE AND ASKED THE PASSENGER FOR HIS NAME AND DATE OF BIRTH. UPON RUNNING the PASSENGER'S NAME, IT WAS discovered THAT THE PASSENGER HAD A WRIT OF BODILY ATTACHMENT. the PASSENGER AND DRIVER WERE THEN ASKED TO EXIT THE VEHICLE. UPON EXITING THE VEHICLE, THE DRIVER/DEFENDANT WAS ASKED IF THERE WAS ANYTHING ILLEGAL INSIDE THE VEHICLE, TO WHICH SHE STATED that SHE DID NOT KNOW. I THEN SEARCHED THE CAB OF THE DODGE DAKOTA. UPON LOOKING INSIDE THE GLOVE BOX, I FOUND A METAL MARIJUANA SMOKING PIPE which HAD MARIJUANA RESIDUE INSIDE the PIPE. the DRIVER/DEFENDANT WAS ASKED IF THE PIPE BELONGED TO HER, TO WHICH SHE STATED THAT ANYTHING INSIDE THAT VEHICLE WAS HERS, DUE TO HER OWNING THE VEHICLE. UPON SEARCHING THROUGHOUT the CAB OF THE TRUCK, I FOUND A RED MAKEUP CONTAINER THAT CONTAINED THREE NEEDLE SYRINGES. UPON LOOKING IN THE REST OF THE VEHICLE, THIS DEPUTY ALSO LOCATED ANOTHER MAKE UP CONTAINER WHICH WAS SILVER IN COLOR, AND INSIDE THIS CONTAINER THIS DEPUTY FOUND THREE CLEAR PLASTIC BAGGIES CONTAINING A WHITE CRYSTAL SUBSTANCE. THE SUBSTANCE WAS FIELD TESTED, AND TESTED POSITIVE FOR METHAMPHETAMINES. THE SUBSTANCE INSIDE THE BAG WAS ONLY A RESIDUE and COULD NOT BE COLLECTED. BOTH THE PASSENGER AND the DEFENDANT WERE HANDCUFFED (DOUBLE-LOCKED), BEHIND their BACKS AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE. THEY WERE THEN TRANSPORTED TO the CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. IT SHOULD BE NOTED that BOTH THE DEFENDANT AND the PASSENGER WERE READ MIRANDA VIA PREPRINTED CARD, AND BOTH STATED that THEY DID NOT WISH TO SPEAK with his DEPUTY. THE DEFENDANT'S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. *NOT-EXEMPT* |
