SUBMITTED BY: CLAUDE, RICHARD 0602 (AR08104639) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN DWELLING OR CURTILAGE THEREOF, LOCATED IN THE COUNTY AND STATE AFORESAID, THE PROPERTY OF THE VICTIM, AS OWNER OR CUSTODIAN THEREOF, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO WIT: IN VIOLATION OF FLORIDA STATE STATUTES 810.02(1) AND 810.02(3). did unlawfully have in HIS possession a tool, machine, or implement, to-wit: A HAMMER, ONE PAIR OF PLIERS, ONE SCREWDRIVER AND A PAIR OF RUBBER WORK GLOVES, with the intent to use the same or allow the same to be used to commit any burglary or trespass, in violation of Florida Statute 810.06; ON 081108 AT APPROXIMATELY 1044 HOURS, THIS DEPUTY WAS DISPATCHED TO 3111 NORTH AMPHIBIAN POINT IN CRYSTAL RIVER REGARDING A BURGLARY OF A RESIDENCE IN PROGRESS. WHILE EN ROUTE, DISPATCH GAVE FURTHER DETAILS OF A SILVER FOUR DOOR VEHICLE, POSSIBLY A CHEVROLET CAVALIER, LEAVING THE SCENE. AS THIS DEPUTY WAS EN ROUTE, ALONG WITH CORPORAL CASOLA LEADING THE ROUTE ON WEST GULF TO LAKE HIGHWAY, JUST EAST OF NORTH TURKEY OAK DRIVE, CORPORAL CASOLA SPOTTED A GREY IN COLOR VEHICLE WITH A WHITE MALE OCCUPANT HEADED WESTBOUND ON WEST GULF TO LAKE HIGHWAY. BOTH UNITS TURNED THEIR PATROL CARS AROUND AND PROCEEDED TO FOLLOW THE VEHICLE, WHICH MADE A RIGHT TURN HEADED NORTH ON WEST TURKEY OAK DRIVE. CORPORAL CASOLA DID A FELONY VEHICLE STOP, WITH MY ASSISTANCE ON WEST TURKEY OAK DRIVE ABOUT ONE FOURTH MILE SOUTH ON NORTH HOLIDAY DRIVE. CORPORAL CASOLA AND THIS DEPUTY DID APPROACH THE VEHICLE, AND IN CLEAR VIEW, SAW WHAT APPEARED TO BE SOME SORT OF VCR OR DVD PLAYER AND A SAFE IN THE REAR SEAT OF THE VEHICLE. CORPORAL CASOLA REMOVED THE DEFENDANT FROM THE VEHICLE AND PLACED HIM IN THE REAR OF HIS VEHICLE, AT WHICH TIME THIS DEPUTY DID SECURE THE DEFENDANT. AFTER A BRIEF RADIO TRANSMISSION FROM CORPORAL CASOLA TO DISPATCH, THIS DEPUTY WAS INSTRUCTED TO RESPOND TO AMPHIBIAN POINT, WHICH WAS THE ADDRESS OF THE BURGLARY. UPON ARRIVAL, THIS DEPUTY WAS MET BY DEPUTY FERGUSON, 05050, WHO STATED HE HAD A PARTIAL FOOTPRINT IN DRIVEWAY THAT HE SAFEGUARDED AND POINTED TO THE SOUTH SIDE OF THE RESIDENCE WHERE THERE WAS A LADDER PROPPED AGAINST THE WINDOW ALONG WITH BROKEN GLASS. THIS DEPUTY WAS THEN MET BY THE OWNER OF THE RESIDENCE, WHO STATED THAT SHE WAS AT COURT AND HAD LEFT THE RESIDENCE AT 0815 HOURS ON THIS DATE REGARDING A DOMESTIC HEARING AND RETURNED TO THE SCENE TO FIND POLICE AT HER RESIDENCE. THE BURGLARY WAS CALLED IN TO 9-1-1 BY A CALLER KNOWN TO THIS AGENCY, WHO WAS INTERVIEWED BY CORPORAL CASOLA AT THE VEHICLE STOP SCENE AT TURKEY OAK AND HOLIDAY DRIVER WHERE A WRITTEN STATEMENT WAS PREPARED BY THAT THAT CALLER. THIS DEPUTY DID PERFORM CRIME SCENE PROCESSING (SEE CRIME SCENE TECHNICIAN REPORT) AND ASKED THE OWNER OF THE RESIDENCE TO RESPOND BACK TO THE SCENE OF the VEHICLE STOP ON NORTH HOLIDAY DRIVE AND WEST TURKEY OAK TO IDENTIFY HER PROPERTY, WHICH SHE DID. A PROPERTY RECEIPT WAS PREPARED AND THE PROPERTY WAS RELEASED TO THE OWNER AT THE SCENE. AT THAT TIME THIS DEPUTY HAD A BRIEF CONVERSATION WITH CORPORAL CASOLA, WHO STATED the VEHICLE WAS NOT THE DEFENDANT'S, BUT THE DEFENDANT'S GIRLFRIEND'S, AND THE VEHICLE WAS GOING TO BE TOWED AT THAT TIME BY CORPORAL CASOLA. AT THAT TIME, THIS DEPUTY DID REMOVE THE DEFENDANT FROM CORPORAL CASOLA'S REAR PATROL SEAT AND PLACED MY HANDCUFFS ON HIM IN the REAR OF THE BACK, DOUBLE LOCKED AND THEN PLACED HIM IN THE REAR OF MY PATROL VEHICLE. THIS DEPUTY ALSO DID CRIME SCENE PROCESSING ON THE VEHICLE AT THE SCENE OF THE VEHICLE STOP AT WEST TURKEY OAK AND HOLIDAY DRIVE AND DID RECOVER EVIDENCE OF BURGLARY TOOLS, TO INCLUDE ONE HAMMER, ONE PAIR OF PLIERS, ONE SCREWDRIVER AND A PAIR OF RUBBER WORK GLOVES. THESE WERE TAKEN INTO EVIDENCE. THIS DEPUTY DID READ the DEFENDANT HIS MIRANDA RIGHTS AND HE DID UNDERSTAND THEM, BUT REFUSED TO ANSWER ANY QUESTIONS. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING. HIS BOND WAS SET AT $6,000.00 PER THE BOND SCHEDULE. PRIOR TO LEAVING THE SCENE, AN AGENCY CASE CARD BEARING MY NAME AND THIS CASE NUMBER WAS ISSUED TO THE VICTIM WITH INSTRUCTIONS AND REQUESTING HER TO CONTACT THIS DEPUTY UPON LEARNING OF ANY NEW INFORMATION, EVIDENCE OR MISSING PROPERTY THAT MAY COME ABOUT. *NOT-EXEMPT* |
