SUBMITTED BY: RUBY, SAMUEL 0562 (AR11123739) did then and there unlawfully carry a concealed weapon or electric weapon or device on or about HIS person, to-wit: A K-BAR FIXED BLADE KNIFE, in violation of Florida Statute 790.01(1). ON 113011 I RESPONDED TO THE AREA OF NORTH TALLAHASSEE ROAD IN CRYSTAL RIVER WHERE DEPUTIES WERE ALREADY ON SCENE IN REFERENCE TO A SUSPICIOUS PERSON. UPON ARRIVAL, I MADE CONTACT WITH DEPUTY DERA, WHO WAS STANDING NEXT TO THE DEFENDANT, LATER IDENTIFIED AS MR DOUGLAS BROWNSON, WHO ADVISED US THAT HE WAS INTOXICATED. DEPUTY DERA WENT TO HIS VEHICLE TO RETRIEVE INFORMATION ON THE DEFENDANT. I ASKED THE DEFENDANT IF HE HAD ANY WEAPONS ON HIS PERSON, TO WHICH HE ADVISED THAT DEPUTY DERA HAD ALREADY TAKEN A SILVER FOLD BLADE KNIFE FROM HIS FRONT POCKET which I OBSERVED LYING ON THE DASH OF DEPUTY DERA'S PATROL VEHICLE. I ASKED THE DEFENDANT IF HE HAD ANY OTHER WEAPONS ON HIS PERSON, TO WHICH HE ADVISED NO. I ASKED THE DEFENDANT IF I COULD PAT HIM DOWN, TO WHICH HE ADVISED YES. I ADVISED THE DEFENDANT TO TURN AROUND AND PLACE HIS HANDS ON THE HOOD OF THE PATROL VEHICLE. AS I BEGAN MY PAT DOWN, ON HIS RIGHT WAIST, I LOCATED A LARGE KA-BAR KNIFE IN A BLACK CANVAS BUCK SHEATH INSIDE OF HIS WAIST BAND ON HIS RIGHT BACK SIDE WITH THE HANDLE TUCKED UNDER HIS SHIRT. I REMOVED THE KNIFE FROM THE SHEATH and PLACED IT ON TOP OF THE LIGHT BAR ON DEPUTY DERA'S VEHICLE. I ASKED THE DEFENDANT WHY HE DID NOT ADVISE US OF THIS KNIFE AFTER BEING ASKED, TO which I DID NOT GET AN ANSWER. THE DEFENDANT ADVISED THAT HE WANTED TO SPEAK WITH A LAWYER. THE DEFENDANT WAS LEFT WITH DEPUTY DERA WHILE I MADE CONTACT WITH THE COMPLAINANT. UPON MY RETURN, I REMOVED THE DEFENDANT FROM THE BACK OF DEPUTY DERA'S PATROL VEHICLE and ADVISED HIM THAT HE WAS BEING PLACED UNDER ARREST FOR CARRYING A CONCEALED WEAPON, HANDCUFFED, BEHIND HIS BACK, (DOUBLE LOCKED), SECURED IN THE REAR OF DEPUTY DERA'S PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. I COMPLETED A PROPERTY RECEIPT WHICH ALONG WITH THE KNIVES WILL BE TURNED IN TO EVIDENCE.
