Probable cause affidavit: | SUBMITTED BY: RICCI, ANTHONY 0606 (AR08103266) UNLAWFULLY ENDANGER THE SAFETY OF ANOTHER OR THEIR PROPERTY WHILE INTOXICATED OR DID WHILE INTOXICATED OR DRINKING AN ALCOHOLIC BEVERAGE IN A PUBLIC PLACE CAUSE A PUBLIC DISTURBANCE, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 856.011. ON 051708 AT 2147 HOURS, I ARRIVED ON SCENE AT 354 WEST HALLS RIVER ROAD IN HOMOSASSA, NATURE'S RESORT, REFERENCE A HEAVILY INTOXICATED MALE CAUSING A DISTURBANCE. UPON ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT AT THE FRONT OFFICE AREA OF NATURE'S RESORT. THE COMPLAINANT STATED THAT SHE, HER SON, AND HER HUSBAND WERE STAYING AT A CAMPSITE NEXT TO THE DEFENDANT. THE COMPLAINANT ADVISED THAT AS SHE APPROACHED HER CAMPSITE VIA HER VEHICLE, SHINNING THE HEADLIGHTS ON HER CAMPSITE TABLE, SHE EXITED HER VEHICLE, AT WHICH TIME, THE DEFENDANT STARTED THROWING VARIOUS OBJECTS AT HER AND HER SON . THE COMPLAINANT ALSO STATED THE DEFENDANT WAS USING VERY FOUL LANGUAGE STATING "FUCK YOU GUYS". THE COMPLAINANT ALSO STATED THE DEFENDANT'S GUEST AND THE DEFENDANT WERE GETTING INTO A VERY HEATED VERBAL ARGUMENT TO WHICH SHE OVERHEARD THE DEFENDANT ALLEGED CHOKING HIS GUEST. THE COMPLAINANT ALSO ADVISED THE DEFENDANT'S MANNER WAS SCARING HER YOUNGER SON TO THE POINT HE WAS VISIBLY UPSET AND CRYING TO WHICH THIS DEPUTY OBSERVED AS WELL. I MADE CONTACT WITH THE DEFENDANT'S GUEST TO WHICH SHE ADVISED THE TWO WERE ARGUING, HOWEVER, SHE ADVISED THE DEFENDANT DID NOT CHOKE HER. I OBSERVED THE CAMPSITE OF THE COMPLAINANT WHERE SHE POINTED AT VARIOUS OBJECTS THE DEFENDANT HAD THROWN IN THE DIRECTION OF HER AND HER SON. I THEN MADE CONTACT WITH A WITNESS, MR KEN DARLEY, SECURITY GUARD AT THE NATURE'S RESORT. HE ADVISED HE WAS APPROACHED BY THE COMPLAINANT REFERENCE THE DEFENDANT'S DISTURBANCE AND THROWING VARIOUS OBJECTS. THE WITNESS STATED THAT HE APPROACHED THE DEFENDANT AT HIS CAMPSITE WHERE THE DEFENDANT WAS KICKING VARIOUS OBJECTS AT THE CAMPSITE, YELLING AND SCREAMING, AND APPROACHED HIM IN AN AGGRESSIVE MANNER TO WHICH THE WITNESS PLACED HIM ON THE GROUND AND WAITED FOR LAW ENFORCEMENT. I THEN MADE CONTACT WITH THE DEFENDANT SITTING ON THE GROUND AT HIS CAMPSITE. THE DEFENDANT HAD AVERY STRONG ODOR OF ALCOHOL EMANATING FROM HIS BREATH AND HIS CLOTHING. I ASKED THE DEFENDANT WHAT HAD OCCURRED TO WHICH HE RESPONDED IN A VERY SLURRED MANNER THAT NOTHING HAD OCCURRED. I THEN ASKED THE DEFENDANT IF HE HAD THROWING OBJECTS OR USED PROFANITY IN THE PRESENCE OF THE COMPLAINANT TO WHICH HE STATED NO. I THEN PLACED THE DEFENDANT IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK, PLACED HIM IN MY PATROL VEHICLE, AND INFORMED HIM HE WAS UNDER ARREST FOR DISORDERLY INTOXICATION. WHILE COLLECTING INFORMATION PERTINENT TO THIS INVESTIGATION, THE DEFENDANT BEGAN KICKING THE INTERIOR WINDOW OF THE PATROL VEHICLE. I THEN ALONG WITH DEPUTY PAUL APPROACHED THE DEFENDANT AND SECURED HIM VIA SEAT BELT INSIDE THE VEHICLE. ALL PARTIES WERE ISSUED AN AGENCY CASE CARD BEARING THE CASE NUMBER. *NOT-EXEMPT* |
