SUBMITTED BY: VENTIMIGLIA, LISA 0621 (AR11120018) did knowingly, willfully and feloniously be in the actual or constructive possession of a controlled substance, to-wit: HYDROCODONE, in violation of Florida Statutes 893.13(6)(A). ON 033011, I RESPONDED TO HIGHLAND SQUARE AT 333 EAST HIGHLAND BOULEVARD IN INVERNESS, REGARDING A WHITE MALE STAGGERING IN THE PARKING LOT. I LOCATED THE SUBJECT, LATER IDENTIFIED AS MR DRAKE EUGENE WOLFE (DEFENDANT). I DID OBSERVE HIM SWAYING AND HE STOOD TALKING WITH ME. HIS EYES WERE BLOODSHOT AND GLASSY. MR WOLFE STATED HE WAS JUST TIRED because HE HAD BEEN UP ALL NIGHT. I CONFIRMED HIS NAME THROUGH FCIC/NCIC. I WAS ABOUT TO TRANSPORT HIM TO HIS RESIDENCE. I HAD MR WOLFE PLACE HIS BACK PACK IN MY TRUNK AND ASKED HIM TO EMPTY HIS POCKETS FOR MY SAFETY. AS MR WOLFE DID SO, A BLUE SCREWDRIVER WAS IN HIS FRONT RIGHT POCKET AND A PILL BOTTLE FELL OUT AND ROLLED UNDER MY PATROL VEHICLE. DURING THIS TIME MR WOLFE STARTED TO VOMIT. EMERGENCY MEDICAL SERVICES (EMS) MEDIC ONE LATER RESPONDED AND EXAMINED MR WOLFE WHO DECLINED TREATMENT. WHILE HE WAS BEING EXAMINED, I RETRIEVED THE PRESCRIPTION BOTTLE, WHICH WAS MADE OUT TO KENNETH LINK ON 090109, FOR LEVAQUIN 500 MILLIGRAMS (MG). INSIDE THE BOTTLE EMS IDENTIFIED TWO 500 MG LEVAQUIN PILLS, OVER 40 50 MG TRAMADOL (ANG 27), AND ONE AND A HALF PILLS OF HYDROCODONE 500 MG (WAT S). I LATER IDENTIFIED THE PILLS AS THE SAME USING PILLIDENTIFIER.COM. POISON CONTROL WAS CONTACTED AND ALSO CONFIRMED THE SAME EXCEPT FOR THE HYDROCODONE BECAUSE THE PILLS ONLY HAD PARTIAL MARKINGS. MR WOLFE WAS ASKED WHO HE GOT THE PILLS FROM AND HE SAID HE GAVE SOME GUY $10.00 FOR WEED, BUT THE GUY TOOK HIS MONEY AND NEVER RETURNED. HE LATER SAID THE GUY LEFT THE PILLS SO HE TOOK THEM. MR WOLFE WAS THEN PLACED UNDER ARREST, PLACED IN THE REAR OF MY PATROL VEHICLE, AND TRANSPORTED TO CITRUS COUNTY DETENTION FACILITY WITHOUT INCIDENT WHERE he was TURNED OVER TO STAFF. HIS BOND WAS SET AT $5,000.00. THE PILLS AND PRESCRIPTION BOTTLE WERE PLACED IN TO EVIDENCE.
