Charge description: | Duy Tan Truong was convicted by a jury on December 4, 2013 for stealing a blender from the Sugar Land Wal-Mart in July 2012. According to Assistant District Attorney Grayson Miller, Truong, a 39 year-old Houston man, went straight to the appliance aisle where he selected three items, including an $89.00 Ninja Blender. He went directly to the self-checkout line where he laboriously scanned two of the items, but feigned scanning the Ninja Blender. Truong immediately pressed finish, paid $60 cash in three $20 bills, and tried to leave the store. Wal-Marts Asset Protection Associate testified that he had followed Truong through the store and personally observed his actions. He heard the register beep when Truong scanned the first two items but not the third. The defendants actions at the checkout line were also caught on video. Truong was stopped in the vestibule just feet from the parking lot entrance. Truong was tried in County Court at Law No. 2 before Presiding Judge Jeffrey McMeans. Theft in this case is a Class B Misdemeanor punishable by up to 180 days in the county jail and/or a fine up to $2,000. Truong was sentenced to a one-year probation during which he must pay a $1,008 fine, perform 36 hours of community service, and attend antitheft classes. Probation is a good choice in cases like this where you want the defendant to give back to the community through community service, said Miller. It is all about taking responsibility for what you do; especially what you do when you think no one is looking. Assistant District Attorneys Grayson Miller and Melissa Gimenez prosecuted the case.
