SUBMITTED BY: BLOTZ, GEOFFREY 0752 (AR15-13470) (15-4809) DID, KNOWING her DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2). ON 011215, WHILE RUNNING TRAFFIC LOCATED IN CRYSTAL RIVER, I WAS ADVISED BY DEPUTY PAUL VIGGIANO THAT HE HAD OBSERVED A WHITE MUSTANG IN the AREA OF NORTH SUNCOAST BOULEVARD AND WEST GODFREY LANE TRAVELING NORTHBOUND WITH THE SPEED OF 105 MILES PER HOUR (MPH) IN A POSTED 45 MPH ZONE. AT THAT TIME, I OBSERVED THE WHITE MUSTANG IN THE AREA OF SOUTHWEST HIGHWAY 19 AND KINGS BAY DRIVE, AT WHICH TIME I ACTIVATED MY EMERGENCY LIGHTS AND ATTEMPTED TO CONDUCT A TRAFFIC STOP. THE WHITE MUSTANG, BEARING FLORIDA TAG RVT12, COME TO A STOP AT 101 SOUTHEAST HIGHWAY 19. AT THAT TIME, I APPROACHED the DRIVER SIDE DOOR AND MADE CONTACT WITH THE DRIVER, MS EDITH HAYS. I REQUESTED HER DRIVER'S LICENSE, REGISTRATION AND PROOF OF INSURANCE, AT WHICH TIME MS HAYS STATED SHE DID NOT have ANY OF IT AND IT WAS LOCATED IN A PURSE BACK AT HER RESIDENCE. AN NCIC/FCIC CHECK ON the TAG WHICH WAS ATTACHED, RVT12, CAME BACK TO A HONDA CIVIC. I THEN ASKED MS HAYS WHY SHE WOULD HAVE A TAG REGISTERED TO A HONDA ON HER 1998 FORD MUSTANG, TO WHICH SHE STATED IT WAS HER ROOMMATE'S AND IT CAME OFF OF HER WRECKED HONDA CIVIC. MS HAYS THEN ADVISED ME SHE HAD PLACED THE TAG OFF the HONDA CIVIC ON HER MUSTANG DUE TO HER HAVING TO SURRENDER HER LICENSE PLATE DUE TO HAVING A SUSPENDED LICENSE. AFTER CONDUCTING AN NCIC/FCIC CHECK OF MS HAYS, THERE WAS A SUSPENSION WITH AN EFFECTED DATE OF 080814 AND A NOTICE WAS PROVIDED ON 072415. AT 0100 HOURS, MIRANDA WAS READ FROM A PREPRINTED CARD. I THEN ASKED WHY MS HAYS WAS SPEEDING IN EXCESS OF 105 MPH, TO WHICH SHE DID ACKNOWLEDGE she WAS SPEEDING BUT JUST STATED SHE WAS CRUISING. I THEN ASKED HER IF SHE WAS AWARE OF HER LICENSE BEING SUSPENDED, TO WHICH SHE STATED SHE WAS DUE TO BEING PULLED OVER AND GIVEN A WRITTEN WARNING FOR THE SUSPENSION AND ALSO SURRENDERING HER TAG. AT 0118 HOURS, the DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED) IN THE FRONT AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE. DEPUTY VIGGIANO STAYED ON SCENE UNTIL ADAM'S TOWING ARRIVED AND TOOK POSSESSION OF the VEHICLE. I SEIZED the TAG OFF THE VEHICLE, WHICH WILL LATER BE TURNED INTO EVIDENCE. SHE WAS ISSUED FLORIDA UNIFORM TRAFFIC CITATION, NUMBER A1BU1YP, FOR DRIVING WHILE LICENSE SUSPENDED (KNOWINGLY), ALSO FLORIDA UNIFORM TRAFFIC CITATION, NUMBER A1BU1ZP, FOR THE ATTACHED TAG NOT ASSIGNED, WITH A MANDATORY COURT DATE OF 012915 AT 1300 HOURS. SHE WAS ALSO ISSUED FLORIDA UNIFORM TRAFFIC CITATION, NUMBER A1BU20P, FOR THE UNLAWFUL SPEED, ALSO HAVING A MANDATORY COURT DATE OF 012915 AT 1300 HOURS. SHE WAS ADVISED SHE WAS BEING PLACED UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED (KNOWINGLY). SHE WAS THEN TRANSPORTED TO the CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. HER BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. |
