SUBMITTED BY: WILSON, EDWARD 0457 (AR11120708) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN STRUCTURE OR CURTILAGE THEREOF, TO-WIT: THE RESIDENCE, LOCATED AT 1809 COLONADE STREET, INVERNESS, IN THE COUNTY AND STATE AFORESAID, THE PROPERTY OF THE VICTIM, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO-WIT: GRAND THEFT, IN VIOLATION OF FLORIDA STATUTE 810.02(1) AND 810.02(4); AND DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: A GUITAR, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN TWENTY THOUSAND DOLLARS ($20,000.00), WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014. ON 011511, A BURGLARY AND THEFT WERE REPORTED TO THIS AGENCY and ON 011811, I WAS ASSIGNED THE CASE MY INVESTIGATION REVEALED THAT A PERSON (WITNESS ONE) HAD BEEN APPROACHED BY THE DEFENDANT, MR EDWARD AMMIRATA, TO BE A LOOKOUT (DECLINED) WHILE HE STOLE TWO GUITARS FROM THE VICTIM. WITNESS ONE SUBSEQUENTLY SAW DEFENDANT AMMIRATA WITH A GUITAR CASE IN HIS RESIDENCE AREA. SHORTLY AFTER THE REPORTED THEFT, WITNESS ONE ALSO STATED THAT DEFENDANT AMMIRATA ASKED HIM TO PAWN THE STOLEN GUITAR. ANOTHER PERSON (WITNESS THREE) STATED THAT DEFENDANT AMMIRATA CALLED HER SHORTLY AFTER THE THEFT AND TOLD HER TO TELL THE "COPS" THAT THE VICTIM SOLD THE GUITAR IF THEY (COPS) APPROACHED HER AND ASKED ABOUT THE THEFT. FURTHER WITNESS TWO WAS WITH DEFENDANT AMMIRATA WHEN HE DROVE TO THE VICTIM'S RESIDENCE, WENT INSIDE, AND RETURNED WITH A GUITAR AND PUT IT IN HIS VEHICLE. WITNESS TWO ALSO STATED THAT SHORTLY AFTER THE THEFT DEFENDANT AMMIRATA TOOK THE GUITAR TO AN UNKNOWN LOCATION ON SOUTH APOPKA IN INVERNESS AND SOLD IT FOR SOME MONEY AND PILLS. ON 051111, CONTACT WAS MADE WITH DEFENDANT AMMIRATA AT HIS RESIDENCE WHERE HE WAS READ HIS MIRANDA RIGHTS FROM A PREPRINTED CARD. HE STATED HE UNDERSTOOD HIS RIGHTS AND WOULD SPEAK TO ME. HE ADMITTED TO STEALING THE GUITAR AND TO SELLING THE GUITAR. HE PROVIDED A WRITTEN STATEMENT TO THIS EFFECT. AT THAT TIME, HE WAS ARRESTED, HANDCUFFED (DOUBLE LOCKED) AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY BY DEPUTY ROUSH WHERE HE WAS PROCESSED AND CHARGED WITH ONE COUNT OF BURGLARY AND ONE COUNT OF GRAND THEFT. THE DEFENDANT'S BOND WAS SET AT RELEASE ON OWN RECOGNIZANCE (ROR) TO CARE FOR HIS MINOR CHILD.
