Probable cause affidavit: | SUBMITTED BY: FARMER, MARK 0452 (AR08103133) DID UNLAWFULLY AND WILLFULLY ENTER OR REMAIN IN A STRUCTURE OR CONVEYANCE, TO WIT: SUBJECT REFUSED TO LEAVE THE AREA OF SWEET BAY PLAZA AFTER TRESPASS WARNING THE PROPERTY OF THE VICTIM, WITHOUT BEING AUTHORIZED, LICENSED, OR INVITED TO DO SO BY THE OWNER, LESSEE, OR THEIR AGENT, IN VIOLATION OF FLORIDA STATE STATUTE 810.09(2)(B) ON 1315 HOURS, I WAS DISPATCHED TO THE AREA OF 4554 SOUTH SUNCOAST BOULEVARD IN REFERENCE TO AN AID OTHER AGENCY. TO GIVE ASSISTANCE TO BOTH EMERGENCY MEDICAL SERVICES (EMS) AND FIRE REGARDING A SIXTY YEAR OLD MALE WHO WAS SEEN IN THE REAR OF SWEET BAY PLAZA. WHILE EN ROUTE, I WAS ADVISED THAT THE SUBJECT WAS POSSIBLY INTOXICATED AND HAD POSSIBLY BROKEN HIS LEG DUE TO HIM FALLING OFF OF A BICYCLE. UPON MY ARRIVAL AT THE CURTILAGE BEHIND THE SWEET BAY PLAZA, I DID OBSERVE FIRE AND EMERGENCY MEDICAL SERVICES (EMS) ATTENDING TO A MALE SUBJECT LATER IDENTIFIED AS THE DEFENDANT, EGBERT DELROSA, LYING DOWN IN THE GRASS IN THE REAR OF THE SWEET BAY PLAZA. THE MALE DID IDENTIFY HIMSELF AS EGBERT DELROSA, (DEFENDANT) WHO APPEARED COHERENT ENOUGH TO ANSWER SOME QUESTIONS FROM "EMS" AND FIRE PERSONNEL. THIS DEPUTY ALONG WITH THE MEDICS GOT THE DEFENDANT TO HIS FEET AND AT THAT TIME, I DID NOTICE A ONE INCH GASH ON THE SUBJECTS LEFT ARM AND THE ELBOW AREA. I WAS ABLE TO ASSIST THE MEDICS IN GETTING THE DEFENDANT TO THE AMBULANCE UNIT WHERE THEY CHECKED HIS VITAL SIGNS AND ATTENDED TO THE WOUND ON HIS ARM. IT SHOULD BE NOTED THAT THE DEFENDANT WAS COHERENT ENOUGH TO ANSWER THE MEDICS QUESTIONS HOWEVER; HE DID HAVE EXTREMELY SLURRED SPEECH AND KEPT MAKING UTTERANCES THAT AT TIMES WERE NOT ABLE TO BE COMPREHENDED. THE DEFENDANT DID APPEAR TO BE INTOXICATED AND I DID DETECT A STRONG ODOR OF AN ALCOHOLIC BEVERAGE EMITTING FROM HIS PERSON. WHILE THE MEDIC UNITS WERE ATTENDING TO THE INJURIES OF THE DEFENDANT, I DID OBTAIN HIS IDENTIFICATION AND THE SUBJECT WAS POSITIVELY IDENTIFIED THROUGH TELETYPE AS BEING A SUBJECT THAT HAD BEEN PREVIOUSLY TRESPASSED FROM SWEET BAY PLAZA EARLIER IN THE DAY BY DEPUTY S. SMITH. THE SUBJECTS BICYCLE WAS FOUND BEHIND 4554 SOUTH SUNCOAST BOULEVARD ALL THE WAY ON THE OTHER SIDE OF THE PLAZA IN THE REAR OF THE BUSINESS CITRUS 95. I THEN MADE CONTACT WITH THE WITNESS WHO ADVISED THAT THE DEFENDANT HAD REPEATEDLY BEEN IN THE AREA OF CITRUS 95 INCLUDING INSIDE THE BUSINESS AND OUTSIDE THE REAR OF THE BUSINESS. THE WITNESS ADVISED THAT THE DEFENDANT WAS NOT INVITED TO BE NEAR THE BUSINESS NOR DID HAVE PERMISSION TO BE ON THE PROPERTY. THE WITNESS ADVISED THEY CONTACTED THE SHERIFFS OFFICE SEVERAL TIMES REGARDING THE DEFENDANT BECAUSE HE HAD BECOME MORE BELLIGERENT AND OFFENSIVE. THE DEFENDANT WAS CLEARED BY "EMS" ON SCENE AND THE SUBJECT WAS THEN INFORMED THAT HE WOULD BE ARRESTED FOR TRESPASS AFTER WARNING. THE DEFENDANT WAS THEN HANDCUFFED, (DOUBLE LOCKED), AND SECURED IN THE REAR OF MY PATROL VEHICLE. THE SUBJECT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANTS BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. *NOT-EXEMPT* |
