Probable cause affidavit: SUBMITTED BY: CALLAHAN, CRAIG 0643 (AR2012-1810) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN STRUCTURE OR CURTILAGE THEREOF, TO-WIT: LAPERLE MONUMENTS, LOCATED AT 5009 SOUTH FLORIDA AVENUE IN INVERNESS, IN THE COUNTY AND STATE AFORESAID, THE PROPERTY OF THE VICTIM, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO-WIT: GRAND THEFT, IN VIOLATION OF FLORIDA STATUTE 810.02(1) AND 810.02(4); (AND) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, LAPERLE MONUMENTS, TO-WIT: $600.00 CASH AND AN HP LAPTOP COMPUTER VALUED AT $500.00, THUS BEING GRAND THEFT OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: $1,100.00 WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014. ON 062512, THE CITRUS COUNTY SHERIFF’S OFFICE RESPONDED TO LAPERLE MONUMENTS LOCATED AT 5009 SOUTH FLORIDA AVENUE IN INVERNESS, IN REFERENCE TO A BURGLARY WHICH HAD ALREADY OCCURRED. UPON ARRIVAL THE VICTIM, LATER IDENTIFIED AS TRAVIS LAPERLE ADVISED THAT SOMEONE HAD BROKEN INTO HIS BUSINESS THROUGH THE REAR DOOR OF THE OFFICE. THE VICTIM FURTHER ADVISED THAT A BLACK HP LAPTOP COMPUTER VALUED AT APPROXIMATELY $500.00, AND $600 IN US CURRENCY WERE MISSING. CONTACT WAS MADE WITH DEPUTY CROSNOE WHO ADVISED ME THAT HE HAD SPOKEN TO WITNESS KENNETH NICHOL WHO ADVISED DEPUTY CROSNOE THAT HE HAD HEARD THAT THE DEFENDANT, LATER IDENTIFIED AS ELIJAH MOTT HAD BROKEN INTO LAPERLE MONUMENTS AND STOLEN A COMPUTER. ON 070212, CONTACT WAS MADE WITH THE DEFENDANT AND PRIOR TO SPEAKING TO HIM, I READ HIM HIS MIRANDA RIGHTS VIA PREPRINTED AGENCY CARD. UPON EXPLAINING TO HIM THAT HE WAS A SUSPECT IN THIS CASE, HE ADMITTED TO ASSISTING IN BREAKING INTO LAPERLE MONUMENT. THE DEFENDANT ADVISED APPROXIMATELY ONE WEEK AGO HE AND THE SUSPECT MR CHRISTOPHER COLLAZO HAD ENTERED THE PROPERTY OF LAPERLE MONUMENT BY JUMPING OVER A FENCE. THE DEFENDANT STATED IT HAD BEEN PREDETERMINED THAT HE WOULD BE THE “LOOK OUT” AS COLLAZO ENTERED THE OFFICE. MOTT STATED AFTER A SHORT TIME COLLAZO REAPPEARED FROM THE OFFICE WITH A COMPUTER. MOTT EXPLAINED TO ME THAT COLLAZO HAD GIVEN HIM THE COMPUTER AND HE HAD TAKEN IT TO WITNESS TWO, MR KENNETH KARESHO IN ORDER TO HAVE THE COMPUTER DECODED, WHICH HE WAS ABLE TO SUCCESSFULLY DO. MOTT ADVISED THAT UPON HEARING THAT LAW ENFORCEMENT WAS INVESTIGATING THIS CASE, HE GAVE THE COMPUTER TO KARESHO WHO LATER THREW IT INTO A LAKE. AT THAT TIME I ADVISED MR MOTT HE WAS BEING PLACED UNDER ARREST AND HE WAS HANDCUFFED, DOUBLE LOCKED, AND PLACED IN THE REAR SEAT OF MY PATROL VEHICLE. PRIOR TO RESPONDING TO THE JAIL CONTACT WAS MADE WITH MR KENNETH NICHOL IN REFERENCE TO THIS CASE. UPON CONDUCTING A DIGITALLY RECORDED INTERVIEW WITH NICHOL, HE ADVISED THAT THE DEFENDANT HAD ADMITTED TO HIM THAT HE HAD BROKEN INTO LAPERLE MONUMENT AND STOLEN A COMPUTER AND APPROXIMATELY $600.00. CONTACT WAS ALSO MADE WITH KENNETH KARESHO, WHERE A DIGITALLY RECORDED INTERVIEW WAS CONDUCTED, DURING WHICH HE ADVISED THAT APPROXIMATELY ONE WEEK AGO THE DEFENDANT AND SUSPECT, MR CHRISTOPHER COLLAZO HAD REQUESTED HE DECODE A COMPUTER. KARESHO STATED THAT COLLAZO TOLD HIM HE HAD BOUGHT THE COMPUTER FROM A YARD SALE; HOWEVER, NEVER TOLD HIM IT WAS STOLEN. KARESHO DESCRIBED THE COMPUTER AS A DARK COLORED HP LAPTOP WHICH MEETS THE DESCRIPTION OF THE ONE STOLEN. KARESHO ADVISED HE WAS ABLE TO SUCCESSFULLY DECODE THE COMPUTER FOR COLLAZO. UPON ARRIVAL TO THE DETENTION FACILITY A DIGITALLY RECORDED INTERVIEW WAS AGAIN CONDUCTED WITH THE DEFENDANT. THE DEFENDANT WAS AGAIN READ HIS MIRANDA VIA A PREPRINTED AGENCY CARD. THE DEFENDANT AGAIN ADMITTED TO HIS INVOLVEMENT IN THIS CASE AND STATED THAT THE COMPUTER THAT WAS BROUGHT TO KARESHO WAS, INDEED, THE ONE STOLEN FROM LAPERLE’S. UPON COMPLETION OF THE INTERVIEW THE DEFENDANT WAS TURNED OVER TO DETENTION FACILITY STAFF FOR BOOKING AND PROCESSING WHERE BOND WAS SET AT $7,000.00, PER THE BOND SCHEDULE.
