Probable cause affidavit: SUBMITTED BY: WILSON, JAMES 0707 (AR1939) THE DEFENDANT, MS ELLEN DORIS SCHWIDEREK, DID UNLAWFULLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO-WIT: ONE PILL OF OXYCOTIN 30 mg AND EIGHT PILLS OF OXYCODONE 10 mg/325 mg acetaminophen, WITH THE INTENT TO SELL THE SAID SUBSTANCE TO ANOTHER PERSON, IN VIOLATION OF FLORIDA STATUTE 893.13(1)(A)(1). ON 071112 I WAS TRAVELING EASTBOUND ON COUNTY ROAD 48, WHEN I OBSERVED A 1995, 2 DOOR OLDSMOBILE, and TRAVELLING WEST BOUND ON CR 48. THE VEHICLE THEN TURNED NORTH ONTO EAST TRAILS END ROAD, AND I FOLLOWED THE VEHICLE. I THEN RAN THE VEHICLE’S TAG, U155GR, THROUGH FCIC/NCIC, WHICH CAME BACK AS REGISTERED TO THE DEFENDANT, WHO HAD A SUSPENDED LICENSE. WHEN I OBSERVED the VEHICLE MAKE THE NORTH BOUND TURN, AND ALSO AS I OBSERVED THE VEHICLE THROUGH ITS UNTINTED REAR WINDOW, IT APPEARED THAT THE DRIVER OF the VEHICLE WAS THE SAME GENDER AND AGE OF THE REGISTERED OWNER. I ALSO OBSERVED the VEHICLE AS IT FAILED TO MAINTAIN A SINGLE LANE ON TWO OCCASIONS, WHILE MAKING CURVES ONTO TRAILS END ROAD I THEN INITIATED A TRAFFIC STOP AT THE INTERSECTION OF SOUTH KANGA WAY, AND EAST TRAILS END ROAD. I APPROACHED the VEHICLE, WHICH WAS OCCUPIED ONLY BY THE DRIVER. AS I ASKED THE DEFENDANT FOR HER LICENSE AND REGISTRATION, I DID DETECT THE ODOR OF ALCOHOL TO BE EMITTING FROM the VEHICLE. THE DRIVER PROVIDED ME WITH HER DRIVER'S LICENSE AND VEHICLE REGISTRATION. I ASKED HER IF SHE WAS AWARE THAT HER LICENSE WAS SUSPENDED, TO WHICH SHE ADVISED that SHE was not. THE DEFENDANT FURTHER ADVISED THAT SHE BELIEVED THAT SHE HAD JUST HAD HER DRIVER'S LICENSE REINSTATED RECENTLY FROM A PREVIOUS DUI. I THEN RETURNED TO MY VEHICLE, AND RESEARCHED FURTHER, AT WHICH TIME I DISCOVERED THE HER DRIVER’S LICENSE HAD BEEN SUSPENDED IN APRIL FOR CANCELLED AT PIP INSURANCE, AND WAS SUSPENDED IN MAY FOR FAILURE TO PAY A TRAFFIC FINE. I THEN RETURNED TO the VEHICLE, AND ASKED HER IF SHE HAD RECEIVED ANY CITATIONS IN the RECENT PAST. SHE ADVISED that SHE WAS UNAWARE OF AY CITATIONS. I ASKED HER IF ANYONE ELSE HAD DRIVEN THE VEHICLE TO WHICH SHE ADVISED NO. I ASKED THE DEFENDANT IF THERE WERE ANY ILLEGAL WEAPONS DRUGS, BOMBS OR GRENADE LAUNCHERS INSIDE OF THE VEHICLE, TO WHICH SHE ADVISED THERE WERE NOT. I ASKED THE DEFENDANT, “MAY I have CONSENT TO SEARCH YOUR VEHICLE FOR NARCOTICS?” TO WHICH the DEFENDANT REPLIED, “YES.” SHE THEN EXITED the VEHICLE, AND STOOD WITH DEPUTY SCHAFFER AT the FRONT OF MY PATROL VEHICLE WHILE I SEARCHED THE VEHICLE. WHILE SEARCHING the VEHICLE, I OBSERVED A SMALL COIN PURSE WITH CHEETAH PRINT, IN SIDE OF THE CENTER CONSOL OF THE VEHICLE. THE TOP COVER OF THE CONSOLE HAD BEEN BROKEN OFF PRIOR TO MY MAKING CONTACT WITH THE DEFENDANT, AND WAS SITTING ON THE PASSENGERS SEAT. I OBSERVED the POUCH TO BE UNZIPPED AND OPEN. AS I PICKED IT UP, I OBSERVED SEVERAL SMALL WHITE ROUND PILLS TO BE INSIDE OF the POUCH. UPON SEARCHING THE POUCH, IT WAS DISCOVERED THAT THERE WERE EIGHT WHITE ROUND PILLS WITH THE IMPRINT OF “WATSON 932” ON THEM. THERE WAS ALSO A ROUND BROWN PILL WITH THE IMPRINT OF “30” ON ONE SIDE, AND “OP” ON THE OTHER. AT THIS TIME, THE DEFENDANT WAS PLACED IN HANDCUFFS, AND SHE ADVISED tHIS DEPUTY THAT, THE ANIMAL PRINT POUCH WAS HERS, BUT THEY WERE NOT HER PILLS. SHE WAS JUST BRINGING THEM TO SOMEONE. I THEN FINISHED SEARCHING THE VEHICLE, AT WHICH POINT I FOUND A OPEN BEER CAN COVERED BY A HAND TOWEL ON the PASSENGER’S SIDE FRONT FLOORBOARD. I ALSO FOUND TWO EMPTY BEER CANS AND ONE UNOPENED BEER CAN IN A PLASTIC BAG ON THE BACK FLOOR BOARD. I THEN READ THE DEFENDANT HER MIRANDA WARNING, AND SHE ADVISED that SHE UNDERSTOOD HER RIGHTS AND DID WISH TO SPEAK WITH ME AT THIS TIME. SHE ADVISED that SHE HAD BOUGHT THE PILLS IN SAINT PETERSBURG, FLORIDA. SHE ADVISED THAT SHE HAD BOUGHT THEM FOR A FRIEND, AND SHE WAS ONLY GOING TO KEEP the OXYCOTIN FOR HERSELF, FOR HER ARTHRITIS. SHE ALSO ADVISED that SHE HAD INTENTIONS OF PROFITING APPROXIMATELY $10.00 FOR PICKING UP THE PILLS AND DELIVERING THEm TO AN UNNAMED SUBJECT. poison control was CONTACTED, and CONFIRMED that the white pills were OXYCODONE 10 MG pills, and the oxycotin was a 30 mg/325 mg acetaminophen pill. THE VEHICLE WAS RELEASED TO A FRIEND OF THE DEFENDANT, PER HER REQUEST. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY, FOR BOOKING AND PROCESSING; WHERE HER BOND WAS SET AT $10,000.00 PER the BOND SCHEDULE THE DEFENDANT RECEIVED A WRITTEN WARNING, 346513B, FOR UNKNOWINGLY DRIVING ON A SUSPENDED LICENSE, AND FOR FAILURE TO MAINTAIN A SINGLE LANE.
