SUBMITTED BY: ALEXANDER, DAWN 0561 (AR11120991) (0120) DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HIS/HER NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193. ON 052711, MYSELF AND DEPUTY DERA WERE DISPATCHED TO A POSSIBLE DRUNK DRIVER IN A BLUE PICKUP TRUCK HEADING NORTH ON U S HIGHWAY FROM OZELLO TRAIL. I WAS ON HIGHWAY 19 AND OBSERVED A BLUE PICKUP TRUCK BEARING FLORIDA REGISTRATION T535PB, HEADING NORTHBOUND ON HIGHWAY 19 IN THE AREA OF STATE ROAD 44. THE TRAFFIC LIGHT TURNED RED AT U S HIGHWAY 19 AND NORTHEAST 3RD AVENUE AND THE VEHICLE DID STOP FOR THE RED LIGHT AND THE LIGHT THEN TURNED GREEN. THE DRIVER JUST SAT AT THE GREEN LIGHT WHEN EVERYONE BEHIND HIM WAS HONKING THEIR HORNS. AT THIS POINT I PULLED UP IN THE TURN LANE AND GOT BEHIND THE VEHICLE AND A SUBJECT DRIVING A BLACK PICKUP TRUCK POINTED TO ME, INDICATING THAT WAS THE PICKUP TRUCK HE HAD CALLED IN ABOUT. I OBSERVED THE TRUCK GO FROM THE LEFT LANE, SWERVE INTO THE RIGHT LANE AND SWERVE BACK INTO THE LEFT LANE AND AGAIN BACK INTO THE RIGHT LANE. THIS ALL HAPPENED IN LESS THAN A TENTH OF A MILE ON US HIGHWAY 19. I ACTIVATED MY EMERGENCY LIGHTS AND THE DRIVER PULLED INTO BRANNEN BANKS. I APPROACHED THE DRIVER AND ASKED HIM FOR HIS LICENSE, REGISTRATION AND PROOF OF INSURANCE. HE PRODUCED A FLORIDA DRIVER'S LICENSE WITH THE NAME OF ERIC JASON SAVA, AND I DETECTED AN ODOR OF AN ALCOHOLIC BEVERAGE COMING FROM MR SAVA. HE WAS ALSO VERY CONFUSED, ATTEMPTING TO LOOK FOR HIS REGISTRATION AND INSURANCE CARDS. HIS EYES WERE ALSO VERY BLOODSHOT AND GLASSY, AND I NOTICED HE WAS NOT WEARING HIS CORRECTIVE LENSES, AS HIS LICENSE DICTATES HE MUST DO. I ASKED MR SAVA IF HE HAD ANY MEDICAL CONDITIONS, AND HE ADVISED HE WAS A DIABETIC. I ASKED IF HE NEEDED EMERGENCY MEDICAL SERVICES, AND HE STATED HE IS INSULIN DEPENDENT. I CALLED EMS TO CHECK HIS SUGAR AS A PRECAUTION, AND THEY ADVISED HIS SUGAR WAS FINE. I THEN HAD MR SAVA EXIT HIS VEHICLE TO PERFORM A SERIES OF FIELD SOBRIETY TASKS. HE ADVISED HE COULD NOT PERFORM ANY. I THEN READ HIM IMPLIED CONSENT, WHICH HE ADVISED HE WOULD NOT TAKE A BREATHALYZER TEST. THE SUBJECT WAS PLACED UNDER ARREST AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. ON HIS DRIVING RECORD IT SHOWS THAT HE HAS TWO PRIOR DUI'S, BUT ONE WAS DROPPED TO RECKLESS DRIVING. THIS WILL BE MR SAVA'S SECOND DUI. THE DEFENDANT WAS ISSUED DUI CITATION 4632-XDX-6 WITH A COURT DATE OF 061611 AT 1300 HOURS. HE WAS ALSO ISSUED CITATION 7260-GJX-9 FOR NOT WEARING HIS EYE GLASSES. HE WAS ISSUED WRITTEN WARNING NUMBER 325616B FOR FAILURE TO MAINTAIN A SINGLE LANE. THE DEFENDANT'S BOND WAS SET AT $1,000.00 PER THE BOND SCHEDULE. UPON ARRIVAL AT THE DETENTION FACILITY, THE DEFENDANT DID REFUSE THE BREATHALYZER TEST.
