Probable cause affidavit: SUBMITTED BY: LAUGHLIN, JEREMY 0617 (AR10128327) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: OXYCODONE 30 MILLIGRAMS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: MARIJUANA 487 GRAMS TOTAL, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 121010 AT APPROXIMATELY 2020 HOURS, I WAS CONDUCTING TRAFFIC ENFORCEMENT IN THE AREA OF HIGHWAY 41 SOUTH AND HIGHWAY 48 WHEN I OBSERVED A RED DODGE PICKUP TRAVELING NORTH BOUND ON HIGHWAY 41 with AN INOPERABLE TAG LIGHT. UPON PULLING BEHIND THE VEHICLE, I RAN THE VEHICLE'S FLORIDA TAG OF B015PH WHICH REVEALED AN EXPIRED REGISTRATION ON 111510. A TRAFFIC STOP WAS THEN CONDUCTED ON HIGHWAY 41 AND KABRICH AVENUE. UPON MAKING CONTACT WITH THE DRIVER/DEFENDANT, I REQUESTED HIS DRIVER'S LICENSE, REGISTRATION, AND PROOF OF INSURANCE. THE DRIVER ADVISED HE DID NOT HAVE HIS DRIVER'S LICENSE WITH HIM, HOWEVER, HIS NAME WAS MR ERIC TAYLOR AND HE WAS THE REGISTERED OWNER OF THE VEHICLE. WHILE MR TAYLOR WAS LOOKING FOR THE REMAINDER OF THE PAPERWORK, I ASKED HIM IF HE HAD ANY WEAPONS OR DRUGS IN HIS VEHICLE TO WHICH HE ADVISED THAT HE HAD AN UNLOADED FIREARM IN THE GLOVE BOX OF THE VEHICLE. MR TAYLOR THEN GAVE THIS DEPUTY PERMISSION TO RETRIEVE THE FIREARM. I THEN RETRIEVED A BLACK BAIKAL 9MM PISTOL BEARING SERIAL NUMBER AK8095 WHICH WAS IN A BROWN LEATHER CASE INSIDE THE VEHICLE'S GLOVE BOX. I THEN ASKED MR TAYLOR IF HE HAD ANY OTHER ITEMS IN THE VEHICLE THAT I SHOULD KNOW ABOUT TO WHICH HE ADVISED HE DID NOT. I THEN ASKED MR TAYLOR IF HE WOULD CONSENT TO THE SEARCH OF HIS VEHICLE FOR ANY OTHER CONTRABAND AND THE COMPLETION OF THE TRAFFIC STOP TO WHICH HE ADVISED HE WOULD NOT ALLOW. I THEN RETURNED TO MY PATROL VEHICLE TO RUN MR TAYLOR'S DRIVER'S LICENSE THAT WAS LISTED ON HIS REGISTRATION FOR WANTS AND WARRANTS AND REQUESTED A K-9 UNIT RESPOND TO MY LOCATION. WHILE COMPLETING A CITATION AND WARNINGS, DETECTIVE BLAIR, DEPUTY LAKATIS, AND K-9 DEPUTY TACKETT ARRIVED ON SCENE, AT which TIME, K-9 DEPUTY TACKETT DEPLOYED K-9 PRIEST FOR AN EXTERIOR SNIFF OF THE VEHICLE. DEPUTY TACKETT ADVISED THAT K-9 PRIEST HAD ALERTED ON THE TOOLBOX AREA OF MR TAYLOR'S VEHICLE. AT THAT TIME, MR TAYLOR WAS REMOVED FROM THE VEHICLE AND PROVIDED THE KEYS TO THE TOOLBOX TO DEPUTY LAKATIS. UPON OPENING THE TOOLBOX, DEPUTY LAKATIS DISCOVERED A BLACK AIR JORDAN BACK PACK WHICH CONTAINED A LARGE CLEAR ZIPLOC BAGGIE CONTAINING A LARGE AMOUNT OF A GREEN LEAFY SUBSTANCE COMMONLY REFERRED TO MARIJUANA. THE ZIPLOC BAGGIE ALSO HAD GREEN WRITING ON THE OUTSIDE OF THE BAGGIE THAT READ "SMELLY PROOF". ALSO LOCATED in the BACK PACK WAS A SMALLER ZIPLOC BAGGIE ALSO CONTAINING A GREEN LEAFY SUBSTANCE COMMONLY REFERRED TO AS MARIJUANA. AT THAT TIME, MR TAYLOR WAS READ MIRANDA BY DETECTIVE BLAIR AND POST MIRANDA, HE ADVISED THAT THE MARIJUANA WAS USED FOR HIS OWN PERSONAL USE AND THAT NO OTHER MARIJUANA WOULD BE LOCATED IN THE VEHICLE. A SEARCH OF THE VEHICLE ALSO REVEALED ONE ROUND BLUE PILL WITH THE IMPRESSION OF AN "m" AND THE NUMBER "30" ON THE DRIVER'S COMPARTMENT LOCATED BY THE FRONT SEAT AND DRIVER'S DOOR. THE PILL WAS IDENTIFIED AS AN OXYCODONE 30 MILLIGRAM BY POISON CONTROL. MR TAYLOR WAS ASKED IF HE HAD A PRESCRIPTION FOR OXYCODONE TO WHICH HE ADVISED HE DID NOT. MR TAYLOR WAS THEN PLACED UNDER ARREST FOR POSSESSION OF A CONTROLLED SUBSTANCE and POSSESSION OF MARIJUANA OVER 20 GRAMS AND WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. MR TAYLOR'S VEHICLE WAS LEFT ON SCENE WITH DETECTIVE BLAIR FOR THE DEFENDANT'S WIFE TO PICK UP. UPON ARRIVAL AT THE DETENTION FACILITY, MR TAYLOR WAS ISSUED CITATION NUMBER 3176-GJX-5 FOR AN EXPIRED TAG WITH A FINE OF $113.00 PAYABLE IN 30 DAYS. HE WAS ISSUED WARNING 310422B FOR NO TAG LIGHT, WARNING 310423B FOR FAILURE TO CARRY DRIVER'S LICENSE, AND WARNING 310424B FOR NO PROOF OF INSURANCE. WHILE AT THE DETENTION FACILITY, THE BAGGIES OF MARIJUANA WERE WEIGHED WITH THE SMALL ZIPLOC BAGGIE CONTAINING 8.5 GRAMS AND THE LARGE ZIPLOC BAGGIE CONTAINING 478.5 GRAMS, FOR A TOTAL OF 487 GRAMS. MR TAYLOR'S FIREARM WAS ALSO COLLECTED AND RAN THROUGH FCIC/NCIC WITH A NEGATIVE HIT. THE FIREARM AND ALL CONTRABAND WILL BE TURNED IN TO EVIDENCE. THE DEFENDANT'S BOND WAS SET AT $10,000.00 PER THE BOND SCHEDULE.
