Probable cause affidavit: SUBMITTED BY: FWC OFFICER JOSEPH J SIMPSON (AR13-7111) did drive or was in the actual physical control of a veSSEL while under the influence of alcoholic beverages, model glue or any substance controlled under Chapter 893 or Chapter 877.111 to the extent HIS normal faculties were impaired, in violation of Florida Statute 327.35(1)(A). On 083113 at approximately 1845 HOURS, I Officer Joseph J Simpson OF THE Florida Fish and Wildlife Conservation Commission (FWC) and Officer Justin Henry (FWC) were on water patrol in Crystal River, Kings Bay. Officer Henry and I observed a large pontoon boat with approximately SEVEN occupants leaving a popular swimming area. I observed the driver of the vessel as a white male with tattoos and he appeared to be sunburned. Officer Henry and I stopped the vessel to perform a routine vessel safety inspection. I asked the operator (later identified as DEFENDANT, MR Eric Steven Young) to see SEVEN wearable lifejackets. I observed Young had bloodshot glassy eyes and he was speaking very slowly and slightly slurred. Young did not know where all the lifejackets were and walked to the back of the vessel to find them. Young picked up an anchor and fell forward onto a bench seat. I believed at this point Young was impaired. I asked Young to come to the front of the vessel and produce his identification and the registration. Young was unable to find his identification and did not know where the registration was located. Officer Henry and I had Young come aboard our vessel to perform several afloat field sobriety tasks. The results were as follows: Horizontal Gaze Nystagmus Lack of smooth pursuit in both eyes Distinct Nystagmus at max deviation in both eyes Onset of Nystagmus prior to 45 degrees in both eyes Palm Pat Subject kept hands together and rotated and did not count Did not increase speed Finger Count During instructions stated “I’m not going to 5?” Didn’t speed up Counted 1-2-3-4, 4,3,3,1, 4,3,3,1 Finger to Nose Did not keep eyes closed appeared to be peeking Touched bridge of his nose on all left hand attempts Performed task slowly Recite Alphabet Slow and Slurred Backwards Count Slow Counted 76,75,76, 75,74 Counted 68, 67,68, 67, 66 One Leg Stand Did not look at foot and had to be told to do so Swayed while balancing Did not keep hands at sides he was over 6 inches Walk and Turn Lost balance during instructions Took only 8 steps on 1st line Because of my training and experience and my observations of Young’s actions and poor performance of field sobriety tasks I believed Young was impaired. I placed him under arrest and he was transported by Officer Craig Reese and I to the Citrus County Jail. Young was asked to give a sample of his breath to determine its alcohol content.
