| Probable cause affidavit: | SUBMITTED BY: LIEUTENANT JONES FWC F460 (AR13-6345) did drive or was in the actual physical control of a veSSEL while under the influence of alcoholic beverages, model glue or any substance controlled under Chapter 893 or Chapter 877.111 to the extent HIS normal faculties were impaired, in violation of Florida Statute 327.35(1)(A); On 070613 AT approximately 1945 hours, I was on water patrol on the Crystal River, Kings Bay area of Citrus County. I observed Florida vessel FL 5172 LE traveling West out of Kings Bay at the mouth of the bay. I observed one subject later identified as MR Ethan Burgess, operating the vessel. As I made eye contact with MR Burgess, he released his hands from the wheel and stepped to the port side of the vessel at which time, the other white male on the vessel only identified as Mike started operating the vessel. When I first made eye contact with MR Burgess, while he was operating his vessel, he appeared to be unsteady and swaying while he operated his vessel. At that time I advised my passenger, Intern Ashley MCCAIG THAT âMan that guy looks trashedâ. A vessel stop was initiated on MR Burgessâ vessel. I asked MR Burgess why he switched drivers, at which time he said,â I didnâtâ. I asked MR Burgess for his vessel registration. while he was trying to locate the vessel registration, I advised the other male passenger known as Mike to go to the front of the boat and TO please be seated at which he complied. MR Burgess located the vessel registration and handed it to me. While stepping toward my vessel, he used his right hand to steady himself as he stepped forward to the console. There was little vessel traffic in the area and the seas were calm. As he was handing me his vessel registration, I detected a distinct odor consisting of someone who had been drinking alcoholic beverages. MR Burgess had glassy, blood shot eyes and his speech was impaired. At that time, I asked MR Burgess to show me FOUR life jackets for his vessel and his fire extinguisher. MR Burgess went to port side rear compartment area of the vessel AND while bending to open the hatch on the COMPARTMENT lost his balance and had to use his left hand to steady himself on a nearby bulk head. After MR Burgess regained his balance, he opened the compartment, which held numerous empty beer bottles as well as his fire extinguisher. At that time, I advised MR Burgess that I had probable cause to believe he was operating his vessel while impaired and I asked him to submit to some field sobriety tasks. MR Burgess refused. At that time I advised MR Burgess he was under arrest for operating a vessel while impaired. MR BURGESS was assisted to my patrol vessel and placed in handcuffs that were double locked. MR Burgess was placed in a life jacket and was seated at the front of the patrol boat. MR Burgess was transferred to FWC Officer Craneâs patrol vessel and later transported to THE CITRUS COUNTY DETENTION FACILITY (CCDF). MR Burgessâ vessel was placed in tow and was taken to Peteâs Pier, where his wife had made arrangements for someone to meet them. Upon his arrival at the jail, MR Burgess was read his implied and was asked to submit a test of his breath to determine the alcohol content. MR Burgess refused. MR Burgess was issued a citation (V368686) for operating a vessel while impaired with a court date of August 1, 2013 Citrus County Courthouse, Courtroom B, Judge Mark Yerman. THE DEFENDANTâS BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. |
